HIGHER EDUCATIONINSTITUTION (HEI),

hereafter referred to as the
STUDENT TRAINEE.
Witnessed: The parties hereby bind themselves to undertake a Memorandum of Agreement for supporting the
HEI’s
Student Training Program (STP) or Practicum/Work IntegratedLearning for student trainees aimed at developing a globally competitive professionalthrough actual exposure under the following terms and conditions: 1.The student training program is for a maximum of
600
hours and shall start on
August 2023
and ends on
December 2023
broken down as follows:1.1
560 hours
for company exposure; however, work schedule shall in no case less thanfour (4) hours and more than eight (8) hours for each practicum day, Monday to Friday, andshall be agreed upon by and between the
STUDENT TRAINEE
and the
HTE;
and 1.2
40 hours
allotted for activities organized by the university, college and departmentlike seminars, conventions and the like, which the STP Coordinators have identified andagreed upon. WHEREAS, the
HEI
offers practicum/work integrated learning subjects or defined as an on-the-job training for the different programs of the School of Business and Economics under the Student Training Program with a Coordinator for each department to oversee theimplementation and management of the program and to liaise with the
HTEs
;WHEREAS,
HEI
assigns a faculty adviser for each practicum/work integrated learningsubject who foresees the student’s progress within the company, compliance of therequirements, and most importantly, the development of the student’s skills andcompetences; Page 1 of 5
WHEREAS, the
HTE
agrees to receive applicants deemed worthy of the company’s visionand mission with student’s portfolio, merit and review; and WHEREAS, the On-the-Job Training program shall be conducted Purely Onsite. NOW THEREFORE, the
HIGHER EDUCATION INSTITUTION (HEI), HOSTTRAINING ESTABLISHMENT (HTE),
and
STUDENT TRAINEE
hereby bindthemselves to undertake this Agreement under the following terms and conditions:1.The
HIGHER EDUCATION INSTITUTION
1.1shall be responsible for briefing the on-the-job student trainee who intends to conduct practicum exposure in the
HTE
as part of the
HEI’s
curriculum and CHED MemorandumOrder (CMO) No. 23 Series of 2009 and CMO No. 104, Series of 2017;1.2shall provide the on-the-job student trainee the basic orientation on work values, behavior, and discipline to ensure smooth cooperation with the
HTE
; 1.3shall guarantee that the
STUDENT TRAINEE
is adept in the various hardware andoffice management software for the use in the discharge of his/her duties; 1.4shall coordinate with the
HTE
for effective monitoring of the student training program; 1.5shall assign a coordinator/faculty adviser, who will maintain open communicationwith and who shall visit the
HTE
workplace, (
HEI
and
HTE
, using their best efforts to setin advance schedules so as not to disrupt work within the
HTE
); and1.6shall withdraw or pull-out the
STUDENT-TRAINEE,
who is found to misbehaveand/or act in disobedience to existing standard, rules, regulations of the
HEI
and
HTE
andimpose the necessary sanctions against the
STUDENT-TRAINEE.
1.6.1
PROVIDED
that the terminating party shall formally inform the STP Coordinator of the grievance before any decision to terminate is made and finalized. The STP Coordinator shall exert efforts to provide intervention to rectify the situation in the interest of all partiesconcern; and1.6.2The
HEI, HTE
and
STUDENT TRAINEE
shall exert all efforts necessary toachieve the objectives of this tripartite undertaking.2The
HOST TRAINING ESTABLISHMENT
2.1shall commit to take in the
STUDENT TRAINEE
for the current semester consistent with the requirements of the
HEI
, especially in the observance but not limited tothe health protocol requirements for contagious diseases like COVID 19;2.2shall assign work to the
STUDENT TRAINEE
in the areas related to his/her field of specialization based on the Training Areas provided together with the Endorsement Letter; 2.3shall provide free relevant instructions and training to the
STUDENT TRAINEE,
consistent with its policies, rules and regulations. It shall treat the
STUDENT

in a professional manner, and shall not subject him/her to task and work assignments that are risky, dangerous or unrelated to the purpose of this Agreement;2.4shall assign a responsible employee from its workforce who will supervise the work of the STUDENT TRAINEE and shall maintain open communication with the
HEI
either through the STP Coordinator or the Faculty Adviser;2.5shall not be required to provide the
STUDENT TRAINEE
compensation/ benefitsaccorded to a regular employee. However, may grant the
STUDENT TRAINEE
trainingallowance, if possible, in accordance with the Company’s existing rules and regulations;2.6shall fill out and accomplish the performance evaluation sheet and the attendancesheet, which will be signed and placed inside a sealed envelope by its responsible employee,and thereafter be given to the
STUDENT TRAINEE
for submission to either the STPcoordinator or faculty adviser; 2.7shall provide a Certificate of Completion to the
STUDENT TRAINEE
for having completed the training program; if not, a certification on the number of hours renderedduring the period; 2.8shall acknowledge and warrant that it does not have an employer-employeerelationship with the
STUDENT TRAINEE
during the period of the student training program; and2.9shall not be obliged to employ the
STUDENT TRAINEE
upon completion of theOJT Program. However, upon consultation with the
HE
I, may require qualified students tosubmit themselves to the Human Resource Department for employment procedures such asexaminations, interviews and submit pertinent documents to support their application.3The Parties shall be responsible to ensure that the
STUDENT TRAINEE
3.1shall comply with the provisions of the Agreement at all times and with the rules andregulations of the
HEI
and
HTE
; 3.2shall keep a work journal and submit weekly reports to the faculty adviser using thetemplate specified in the STP Manual and on the deadline set by the faculty adviser; 3.3shall be personally responsible for any and all liabilities arising from grossnegligence in the performance of his/her duties and functions while under training; 3.4shall maintain confidentiality, when and where appropriate during and after thetraining period of all the data, business or trade secrets where such information is not withinthe public domain and as indicated and understood as confidential.
HTE
may require the
STUDENT TRAINEE
to sign a non-disclosure agreement; 3.5shall be evaluated by his/her work supervisor/mentor accordingly based on thePerformance Evaluation specified in the STP Manual and provided by
HEI
; 3.6shall fill out evaluations on the practicum experience with the business partner, practicum program, coordinator and faculty adviser on the deadline set by the STPcoordinator/faculty adviser; and Page 3 of 5
3.7shall submit a portfolio at the end of the semester to and on the deadline set by thefaculty adviser and copies of additional company requirements requested of the Work Supervisor provided with the approval of the latter;Both the
HEI
and the
HTE
shall have the right to pre-terminate this agreement if: 1.The
STUDENT TRAINEE
violates the rules and regulations of the
HTE
or for anyserious misconduct on the part of the
STUDENT TRAINEE
; 2.The
HTE
does not provide the relevant and responsible training as agreed upon; or 3.There is any violation of the foregoing covenants that will warrant the cancellation of this Agreement.EFFECTIVITY/DURATIONThis Memorandum of Agreement shall take effect on the date of the signing and shallcontinue to be in force for a period of One (1) year unless earlier terminated for just cause, by either party within thirty (3) days prior written notice to the other party.
