AMITY LAW SCHOOL,
PUNJAB
'Amity Law School (ALS)' was established in 2021 under the aegis of 'Amity University
Punjab. Though being young on the scales of its establishment, ALS is growing as one
of the most preferred organisations for law aspirants as a Centre of Excellence in the
eld of legal education. The school o ers three undergraduate courses in law i.e.
B.A.LL.B.(Hons.), BB.A.LL.B.(Hons.) and LL.B.(Hons.) with specialisation in Corporate,
Criminal, Constitutional and International Law. In the arena of post-graduate courses, a
one year LL.M. course is also o ered to the students with the selective options of
specialisation in Corporate, Criminal, Constitutional and International Law. Striving to
achieve the motto of 'excelling in higher education and research', ALS not only focuses
upon theoretical training but also provides a requisite platform for the practical
exposure to the students.

watch the live streaming of the Supreme Court of India proceedings followed by
debate and discussion among themselves to develop analytical and articulative skills.
The course curriculum has been designed to facilitate the students to thrive in
theoretical as well as practical aspects of legal education. The law school is leaving no
stone unturned to develop a strong mooting culture to create the best lawyers,
judges, policymakers, prosecutors, and corporate lawyers as well. With profound
delight, this young Amity Law School is introducing its flagship event, the First
National Moot Court Competition 2024. The students from different law schools in
the entire country are invited to participate in this mega competition. The
competition will be judged by eminent academicians, lawyers, and esteemed judges
of the district as well as the High Court. Let the students all around put their minds to
the test, inculcate the litigation skills and ignite the lamp of knowledge by learning
from each other.

REGISTRATION
DETAILS
1. All the participating teams have to confirm team participation through
submission of the registration form to the Registration Committee.

2. The registration fee of Rs. 4,000 is to be paid online by 8th April, 2024
to confirm your slot. For information regarding accommodation and food,
please contact the Registration team. The participants shall pay on the
Bank Details given below.

3. Receipt/Screenshot of the online payment is to be sent by email to:

[email protected] along with Registration Form.
Confirmation of the same will be mailed after receiving the mail.

4. While making the payment, the teams are required to add on their
respective name of universities in the notes.

5. Note: Mere payment will not amount to booking of the seat in the said
moot. The booking will be done on the basis of first come first serve .
Only the first 32 teams shall be entertained for the same. Everything else
will be done at the discretion of the host university.
RULES AND REGULATIONS
GENERAL GUIDELINES
1.No change in the names & composition of the team shall be permitted after the
receipt of the Registration Form, except at the sole discretion of the Host University.

2.A provisional team code shall be allotted to the registered teams by the Host
University after providing a receipt of nal registration and payment via mail
[email protected]. Any delay in the completion of the nal
registration process within the stipulated deadline may result in the cancellation of
the participant's con rmed provisional registration at the host university s sole
discretion. Once the team code is allotted, every team must use the Team Code for
any communication with the Organizers during the course of the Competition.

3.The participants are strongly advised to ensure that there are no spelling errors in
the information provided in pursuance of the certi cates.

4.In the event, if a team drops out of the competition or is disquali ed, the team next
in line as per registration data (when the registration exceeds the permitted (32
teams) will be o ered the chance to participate in the competition at a short notice.
Such teams will have to submit their memorials to be eligible at least 3 days prior to
the dates of the competition.
5.Oral Pleadings shall be con ned to the pleading in
the Memorials except at the discretion of the
bench.

6.The Researcher can pass notes discreetly to the

Speakers during the Oral Pleading round subject
to the discretion of the Judges.

7.The attendance of the Researcher at the time of

Oral Pleading Rounds is compulsory.
GENERAL
RULES
1.The 1st Edition of Kindle National Moot Court Competition shall be held on 20th-21st
April, 2024.

2. Medium of the competition shall be English.

3.The competition is open to participation by teams of all the students pursuing an

integrated 5-year B.A.LL.B Course or 3-year LL.B. course in any recognised
University or College in India. A maximum of 32 teams in all will be allowed to
participate. Teams will be entertained on 'First come rst serve basis'.

4.A team shall comprise of three members; consisting of two speakers and one
researcher. The team amongst its members is required to identify speakers and
researcher at the time of registration itself. This composition cannot be altered
under any circumstances.

5.The dress code for the competition is an advocate's uniform as per Advocates Act,
1961 without band and gown. Violation of the dress code will bar a contestant from
appearing in the pleading rounds.

6.All participants are required to conduct

themselves in a responsible and professional
manner throughout the competition. All
participants are required to act in a digni ed
manner and respect the Court. Members of a
participating team must not communicate with
the judges or opposite counsels in private, to
the detriment of the competition.
TEAM
COMPOSITION

1. The maximum number of participants per team shall be restricted to 3

wherein only 2 shall be speakers and 1 shall be the designated researcher.
The researcher shall be allowed to argue at the discretion of the host
university.
2. No Team Coach, mentors, observer or any other person shall be
accompanying registered participating team members. Only the
designated speaker in the Preliminary Rounds shall be eligible for the best
speaker award.
3. Teams should not disclose the identity of their institution; such disclosure
shall invite penalties including disqualification. The decision for the same
shall be at the discretion of the host university.

FORMAT OF THE
COMPETITION

The Competition is divided into following rounds:

a. Preliminary Rounds,
b. Quarter-Finals Round
b. Semi-Finals Round; and
c. Finals Round.
PRELIMINARY
ROUNDS
1. There shall be two preliminary rounds of arguments per team, one for appellant
& another for respondent.

2. No team shall face each other more than once in the preliminary rounds.

3. Each team shall face a di erent bench in their second round of arguments.

4. Each team shall get a total of 30 minutes to present their case. This time will
include
rebuttal and sur-rebuttal.

5. The division of time between the speakers is at the discretion of the team
members, subject to a maximum of 15 minutes per speaker. Each team shall
indicate to the court - clerk as to how they decide to allocate their 30 minutes.

6. The top 8 teams based on cumulative marks (written and oral submissions) shall
qualify for the Quarter- nals, which shall be held on the same day.

7. In case of a tie, the teams shall advance to the next round on the basis of
highest memorial score. If the tie is still not broken, then the highest speaker
score will determine which team advances to the Quarter- nals.
QUARTER-FINALS
/SEMI-FINALS
1. Draw of lots shall decide the side of the arguments in Quarter- nals & Semi-
nals.

2. The teams shall argue only for one side in the said rounds.

3. Each team shall get a total of 35 minutes to present their case. This time will
include rebuttal and sur-rebuttal.

4. The division of time between the speakers is the discretion of the team
members, subject to a maximum of 20 minutes per speaker. Each team shall
indicate to the court - clerk as to how they decide to allocate their 35 minutes.

5. For quarter- nals, on the basis of knock out, 4 (four) teams shall advance to the
Semi- nals and for Semi- nals, on the basis of knock out, 2 (two) teams shall
advance to the Finals.

FINALS
1. Draw of lots shall decide the side of the arguments in Finals.

2. The teams shall argue only for one side in the said round.

3. Each team shall get a total of 45 minutes to present their case. This time will
include rebuttal and sur rebuttal.

4. The division of time between the speakers is the discretion of the team
members, subject to a maximum of 25 minutes per speaker. Each team shall
indicate to the court - clerk as to how they decide to allocate their 45 minutes.

5. The winner in Finals shall be judged by way of knock-out.

 MEMORIAL
GUIDELINES
1. All participating teams shall submit 4 sets of written memorials each (4
Appellant and 4 Respondent memorials).

2. The Cover pages of the memorials for the Appellants shall be in blue and the
Respondents shall be in red.

3. The teams shall not indicate their names or the names of their College or
University on the memorials. The Team code allotted to all teams will have to be
indicated at the top left corner of the memorials by the way of A-01/R-01.
FINAL

4. The soft copy of the memorial shall be submitted on or before 13 April, 2024.

5. The hardcopy of the memorial shall be submitted during the offline registration
on 20th April, 2024.

6. No change in the hard or soft copy of the memorial shall be accepted. It shall be
a ground of disqualification at the discretion of the host university.

7. The written memorials shall confirm to the set standards:t speaker

– score will determine which team advances to the Quarter-finals.

a) Written submissions shall be printed on white standard A4 size paper.

The memorial should not be printed in a double sided format.

b) The font and size of the text used in all parts of the written
submissions (except the covers where it shall be in Times New Roman
size 14) shall be in Times New Roman size 12 and footnotes shall be in
Times New Roman size 10.

c) The text in all parts of each written submission shall have double
spacing except the text of footnotes which shall be single spaced.

8. The teams shall follow the bluebook 20th edition for Citation. Arguments
advanced must not exceed 15 pages and the memorial in total must not exceed
30 pages.
9. Non-compliance with the same would entail a penalty of 5 marks per extra page.
10. Contents of Written Submissions shall include the following:

a) Cover Page; f) Statement of Facts;

b) Table of Contents; g) Summary of Arguments;
c) Index of Authorities; h) Arguments Advanced;
d) Statement of Jurisdiction; i) Prayer.
e) Issues Presented; j) Exhibits (Optional, not included
in the prescribed page limit)

RESEARCHERS
TEST
1. The Researcher Test will take place on 20th April, 2024 immediately after Draw
of lots in order to determine the best researcher. The test will consist of
questions both legal and factual, relating to the moot proposition.

2. Rules for the Researcher Test:

The Researchers Test will be divided into three parts:
a) Part 1: Multiple Choice Questions
b) Part 2: One-word answers
c) Part 3: Subjective question

The test will be of 100 marks:

a) 25 Multiple Choice Questions of 3 marks each.
b) 15 questions with one-word answers of 1 mark each.
c) 1 Subjective question of 10 marks.

DISPUTES
Any dispute about the Moot Court Competition shall be referred to the Dispute
Resolution Committee before the end of the competition. In all matters of complaints
or disputes, the decision of the Dispute Resolution Committee shall be nal.

2. All participants shall maintain the decorum at all times during the competition

profession.

3. Violation of any of the aforementioned rules or regulations would amount to

grounds for disquali cation at the discretion of the host University.

MOOT
PROPOSITION
Maya Malhotra is a renowned actress of Indika who works in Hindi, Kannada, Tamil,
and Telugu lms. She has been a huge success ever since she entered the
entertainment industry 5 years ago. Her list of recognition and popularity on the
success charts re ected in three IIFA Awards, four Filmfare Awards, Time 100 Impact
awards. In this short span of time, she surged to the position of Indika's highest-paid
actresses and recently appeared in Forbes Indika's top 100 Celebrity list. She is very
popular amongst the youngsters and has about 152 million followers on social media
platform Z. She is often invited at various public gatherings and important functions
by the who-is-who of the society. Being a huge public gure, she is very particular
about her image in the public and her physical appearance for which she maintains a
separate PR department.

Natasha Chopra, also an established actress of the entertainment industry, has been
very successful in the last decade and her work has also been recognised by awarding
her two National Film Awards, six IIFA awards, ve Filmfare awards, several Filmfare
Critics Award for the Best Actress. She owns a cosmetics brand and is involved in
various charities. However, with the growing popularity and fan-following of Maya
Malhotra, o late, Natasha Chopra has been feeling insecure and has been bad
mouthing against Maya in various quarters.

Since the beginning of her career, Maya Malhotra has a manager named Sandy who
has been very e cient as well as reliable and has been like a family member to Maya
Malhotra, whose opinions mattered the most for her. However, since the past few
months, there have been several instances where Maya Malhotra and Sandy got into
arguments due to their di erence of opinion over professional issues. On March 4,
2023, Maya Malhotra was invited as a guest at a charity function for raising funds for
breast cancer. On arrival, to her surprise, she saw Natasha Chopra already present at
the venue as the Chief Guest. Though both actresses greeted each other nicely in
front of the present media, their awkwardness was apparent. Maya Malhotra came
down from the stage and called for Sandy behind the stage where she yelled at him in
front of her sta and some other crew members. Feeling humiliated in front of the
gathering, Sandy left the scene immediately.
One of Sandy's very close friends, Lokesh was also present at the event since he
happened to be a member of the PR crew of Natasha Chopra. The Industry was aware
of the closeness between Sandy and Lokesh, who had been friends before they came
to Mumbaika from their hometown Chandinagar. Since Sandy abruptly left the event,
Lokesh called him on the phone wherein Sandy said that he was very upset and
annoyed due to Maya's rude behaviour.

To make the best of the hay and to enter into the good books of Natasha, Lokesh told
the entire altercation of Maya and Sandy to Natasha who keenly listened to it and said,
Maya is a hypocrite. She is di erent in front of the media and other in person, her real
image should be brought out in public. Sandy has access to all her pictures, videos,
and social media accounts. Why doesn't he teach her a lesson? Look at the viral videos
these days. If Maya is revealed, it is worth a reward. Sandy is indolent. Something is to
be done .

On such instigation and suggestion, Lokesh called Sandy and told him that he wants
to meet him to console him and change his mood for which he would be coming to his
place in the evening. Lokesh came to Sandy's house at 9. 30 pm with two bottles of
liquor. Bobby, Sandy's younger brother who is a B.Tech nal year student and an
enthusiastic techie studying in ABC university at Mumbaika, was also present at
home. All three of them shared a few drinks; however, Lokesh made Sandy consume
more liquor than the other two. Suddenly, Sandy started crying and howling and
yelled What attitude she shows to me? She was zero, a struggler. I did everything for
her. I have her best kept secrets and if I leak her real pictures in the media, many
people would be shocked to see her real looks. She's a plastic, a pigmy! . Sandy
narrated the entire incident of what happened earlier in the day and how insulted he
felt by Maya's rude behaviour with great pain to the other two.

He was so angry and annoyed that he also revealed that Maya had been rude to him
even earlier. She had humiliated him on various occasions at her residence mostly
when she was drunk and had threatened to throw him out of the job as well to ensure
that no one else in the industry appoints him. However, she would be back to being
normal when she was not drunk. He was so upset that he said that he managed every
personal as well as professional things for her from managing her appointments with
the doctors and dentists to appointments with the director and scriptwriters, to
managing her social media accounts, ltering her private and personal photographs
and videos, having access to her personal life in every possible manner.

Bobby idolises Sandy because he is the sole bread earner for the entire family and a
guardian to Bobby. Sandy especially called Bobby to study in Mumbaika and later
introduced him to the stalwarts of the industry and took care of all of his education
and other expenditures. Thus, Bobby was quite protective of Sandy.

In the garb of consoling Sandy, Lokesh asked him to leave the job if he was not happy
and o ered to help him if he ensured a banging news about Maya. He asked Sandy not
to worry about a good future in the industry as Natasha is a kind lady and has many
times appreciated him (Sandy) and always envied Maya having a good manager, as
Sandy is. Lokesh further dropped a hint at Sandy that if he could do something to
malign Maya's reputation, Natasha has speci cally said that she would do anything to
shelter Sandy and would give him nancial support too. Bobby was listening to the
whole conversation. Suddenly, Sandy got a phone call at 11:10 pm from his friend,
working as an assistant with another superstar who mocked him about the incident
with Maya at the function and while on that call, Sandy left the room. Lokesh and
Bobby in his absence concerted that whatever happened was highly unacceptable
and Maya should be taught a lesson. They noticed Sandy's laptop which was kept on
the table. Bobby turned the laptop on. Both started feeling tipsy and started foul
commenting on seeing private pictures of Maya Malhotra.

Sandy came back into the room at 12:30 am. He got surprised to see Karan there, his
associate in Maya's PR team. Karan said that he came to check whether everything is
ne with him. Karan is seen to have developed good bonding with Maya in last few
months. After a very brief conversation, he left the place. Lokesh and Bobby were
sleeping on the sofa. Sandy immediately went to his room, switched o his phone and
went to sleep.

On March 5, 2023, at around 12:35 am, a deep-fake AI-generated video of Maya

Malhotra appeared online on the social media platform Z. In the clip, Maya entered a
private gym wearing a translucent gym wear, a style which Maya otherwise has never
been seen wearing. In the video, she indulged in activities that came across as vulgar.
The video quickly went viral and generated a lot of negative sentiments for Maya. Her
account was quickly lled with million trolls making inappropriate remarks about her
character and looks. The video was rapidly shared, circulated and published across
various media platforms and entertainment social media accounts resulting in diverse
reactions from the public.

To attend her friend's surprise birthday party, Maya was in a ight for Dubaika when
this video was being posted. When she landed at around 3:00 am and switched on her
phone, it was lled with trolls and negative remarks from the public and several
missed calls and messages of concern from her family and near friends. She took a
ight back home from the Dubaika airport itself. She landed at 9:00 am in Mumbaika
and rushed directly to a local police station from the airport to lodge a complaint. She
said that she suspected Sandy behind this. Police reached their home and found that
the door was not locked, and Sandy and Bobby were still sleeping. Later, the police
took them into their custody. Bobby alleged that Karan has uploaded the deepfake
video for the sake of negative publicity of Maya as a part of conspiracy and both the
brothers have no knowledge of the same. A Laptop was recovered by the police
which was sent for forensic investigation and report. Fingerprints were also taken
from the house.

During the investigation, it was further discovered that;

1) It was captured in the CCTV cameras of Maya's residence that Sandy had visited her
place around 11:30 pm on 4 March 2023 with a baseball bat. However, he kept on
ringing the doorbell and when he got no response he was seen leaving in his car.

2) In this video, the woman showcased was not Maya but someone else whose face
was morphed with Maya's face using AI tools. The IP address of the laptop through
which the said deepfake video was uploaded matched with Sandy's laptop.

3)A whole bottle of whiskey was polished o that night and 3 used glasses were
procured.

Police registered an FIR against Sandy and Bobby under Sections- 469, 465, 471, 408,
448, 509, 292, 511,120-B read with 34 IPC and Sections 66C, 66E of the IT Act, 2000.

During the course of Trial, the Court of JMIC, exercised its powers Under Section 319
of CrPC and summoned Lokesh and Natasha Chopra, who after approaching the
Hon'ble High Court got the summoning order quashed on 20 April 2023. Aggrieved
by this, the prosecution led an SLP before the Hon'ble Supreme Court on 30 April
2023 against the order of quashing of summons.

In the interregnum, the Court of Judicial Magistrate carried on with the Trial and
acquitted both of the accused on 18 January 2024, holding that the Prosecution
failed to prove the case beyond reasonable doubt due to lack of su cient evidence.

The Prosecution as well as Maya Malhotra have assailed the judgement of acquittal
where the following issues are before the High Court of Mumbaika;-

1. Whether the appeal is maintainable before the High Court of Mumbaika?

2. Whether the judgement under challenge is sustainable in law and the JMIC has
rightly acquitted the accused?

3. Whether the Trial Court was just and reasonable in abstaining from examining the
part of Lokesh, Natasha and Karan?

Laws of Indika are in Pari Materia with the laws of India.
