Approves the Conformity Assessment Requirements


for Flat – Consolidated Tempered Glass.

THE PRESIDENT OF THE NATIONAL INSTITUTE OF METROLOGY, QUALITY AND TECHNOLOGY –


INMETRO, in the exercise of the competence granted to him by articles 4, paragraph 2, of Law No. 5,966,
of December 11, 1973, and 3, items I and IV, of Law No. 9,933, of December 20, 1999, combined with the
provisions of article 18, item V, of Annex I to Decree No. 11,221, of October 5, 2022, considering Decree
No. 10,139, of November 28, 2019, and what is contained in SEI Process No. 0052600.002225/2023-30,
resolves:
Object and scope from application
Art. 1 The Conformity Assessment Requirements and the Specifications for the Conformity
Identification Seal for Flat Tempered Glass, set out, respectively, in Annexes I and II of this Ordinance, are
hereby approved.
§ 1 The conformity assessment of flat tempered glass, on a voluntary basis, through the
certification mechanism, must be carried out by a Product Certification Body – OCP, established in Brazil
and accredited by Inmetro, according to the Requirements approved herein.
§ 2 These Requirements apply to flat tempered glass used in civil construction, photovoltaic solar
modules, the furniture industry and white goods.
Art. 2 It is not incumbent upon Inmetro to exercise the administrative police power regarding the
object, and it is exclusively responsible for supervising the use of the trademark, focusing on compliance
with the rules of Conformity Assessment.
Deadlines and provisions Transitional
Article 3 The publication of this Ordinance does not imply the need to initiate a new certification
process based on the requirements consolidated herein.
Sole paragraph. The certificates already issued must be reviewed, for reference to the Ordinance
published herein, in the next stage of evaluation.
Art. 4 Certificates issued based on Inmetro Ordinance No. 327 of 2007 shall have their validity
adjusted, pursuant to item 6.2.6.2 of the RAC established in Annex I of this Ordinance, with reference to
the date of granting.
Art. 5 Manufacturers and importers of tempered glass will have until July 30, 2024 to update the
layout of the Conformity Identification Seal, as established in Annex II of this Ordinance.

Article 6 On the effective date of this Ordinance, Inmetro Ordinance No. 327, of August 24, 2007,
published in the Federal Official Gazette of August 28, 2007, section 1, page 66, is hereby revoked.

ATTACHMENT I – REQUIREMENTS FROM EVALUATION OF


COMPLIANCE TOWARDS GLASS TEMPERATE
PLAN

1. GOAL
Establish conformity assessment criteria and procedures for flat tempered glass, with a focus on safety,
through the certification mechanism, aiming at the prevention of accidents in its use.
1.1 Grouping towards effects from certification
For certification of the object of this RAC, the concept of family applies.
Product certification must be carried out for each family of flat tempered glass, as defined in item 4.3 of
this RAC.

2. ACRONYMS
For the purposes of this RAC, the following acronyms are adopted, complemented by those
mentioned in the RGCP. VTP Flat tempered glass

3. DOCUMENTS COMPLEMENTARY
3.1 For the purposes of this RAC, the following complementary documents are adopted, in addition to
those mentioned in the RGCP.
Inmetro Ordinance No. 200, of General Product Certification Requirements – GDPR.
2021 or substitute
ABNT NBR 14698 Tempered Glass
3.2 The updated version of the aforementioned ABNT NBR standard must be used, or its substitute
(in case of cancellation), and it is up to the OCP, when applicable, to promote the necessary
adjustments in the conformity assessment procedures, in order to enable the use of the most recent
normative basis.
3.3 The deadline for the adoption of the most up-to-date version of the standard or its substitute is
12 (twelve) months or the period for adapting the standard itself, whichever is longer.

4. DEFINITIONS
For the purposes of this RAC, the following definitions are adopted, complemented by the definitions
cited in the supplementary documents of item 3 of this RAC.
4.1 Class from goods
Glass grouped by strips, with different thicknesses, predetermined according to Table 4 of this RAC. 4.2
Body from Proof
Representative sample of tempered glass, according to defined standards, for greater assurance of test
results.
4.3 Family
Flat tempered glass produced in the same manufacturing unit and that have the same class, and may
present variations in their thicknesses.

4.4 Fragmentation from glass temperate


Characteristic type of breakage of tempered glass sheet, caused by the imbalance of stresses, resulting in
small fragments.
4.5 Identification
Indelible marking made near the edge of the glass, in order to identify the manufacturer and/or
characteristics of the glass sheet.
4.6 Glass temperate
Glass consisting of a single sheet whose resistance to mechanical stress is increased as a result of the
treatment to which it is subjected and which at the moment of breakage disintegrates into small
fragments.

5. MECHANISM FROM EVALUATION OF COMPLIANCE


The conformity assessment mechanism adopted in this RAC is certification.

6. STEPS OF THE PROCESS FROM CERTIFICATION


6.1 Definition of the Model from Certification utilized
This RAC establishes the following certification model:
Certification Model 5 - Initial assessment consisting of tests on samples from the manufacturer,
including audit of the Quality Management System - QMS, followed by periodic maintenance
assessment through tests on samples at the manufacturer, to carry out conformity assessment activities,
and QMS audit.
6.2 Evaluation initial – Model 5
6.2.1 Request from Certification
The vendor applying for certification must submit a formal request to the OCP, providing the
documentation described in the GDPR.
6.2.2 Analysis Of Request and Of Compliance Of Documentation
The criteria for analyzing the request and the compliance of the documentation must follow the
requirements established in the GDPR.
6.2.3 Audit Initial of the QMS and Evaluation of the Process Productive
6.2.3.1 The criteria for the initial audit of the QMS and evaluation of the production process must follow
the provisions of the RGCP, except for those established in sub-items 6.2.3.2 and 6.2.3.3 below.
6.2.3.2 The presentation of a Quality Management System certificate, which is issued by an OCS
accredited by Inmetro or a member of the IAF's MLA, having as reference the ABNT NBR ISO 9001
standard or ISO 9001 standard, and this certification being valid for the production line of the object of
the request, exempts the applicant from certification, under the analysis and responsibility of the OCP,
of the evaluation of the QMS during the initial audit. In this case, the OCP will check the reports issued
by the Quality Management System Certification Body, the process control records, the customer
complaint records, the product tests and inspections.
6.2.3.3 The evaluation of the QMS must be carried out by the OCP based on the scope of the
certification process and in accordance with the requirements of the ISO 9001:2015 standard or the
ABNT NBR ISO 9001:2015 standard, with the minimum requirements defined in Table 2 below.

6.2.3.4 The OCP shall assess, in both situations provided for in sub-items 6.2.3.2 and 6.2.3.3, whether the
manufacturer is meeting the technical requirements set forth in Table 2 below.

6.2.4 Plan from Tests Initial


The requirements for the initial test plan shall be as set out in the GDPR. 6.2.4.1 Definition
Of Tests the Be Performed
6.2.4.1.1 The criteria for defining the tests to be performed must follow the provisions of the GDPR.
6.2.4.1.2 The OCP must perform all the tests provided for in the ABNT NBR 14698 standard, as shown in
Table 3 below.
6.2.4.1.3 The OCP must also verify that the flat tempered glass contains the information established in
the ABNT NBR 14698 standard and that the identification provided for in the standard - Indelible
marking - is made near the edge of the glass, in order to identify the manufacturer and/or characteristic
of the glass sheet.
6.2.4.2 Definition Of Sampling

6.2.4.2.1 The definition of sampling and acceptance and rejection criteria must follow the requirements
established in the GDPR.
6.2.4.2.2 The OCP must monitor the quenching process of the samples to be tested. The collection of
samples (specimens) must be carried out on the production line, provided that the product has already
been inspected and released by the factory's quality control.
6.2.4.2.3 Sampling should be performed according to Table 3 below.

Note: The Safety Test is contemplated and is classified, exempting it from the performance of retest and
witness tests, as defined in Annex A of the ABNT NBR 14698 standard.
6.2.4.2.4 Specimens must be manufactured for each product class, defined as shown in Table 4 below.

6.2.4.3 Definition of the Laboratory


The criteria for laboratory selection must follow the requirements established in the RGCP.
6.2.5 Treatment from No Conformities in Stage from Evaluation Initial
The criteria for handling non-conformities in the initial assessment stage must follow the requirements
established in the GDPR.
6.2.6 Emission of the Certificate from Compliance
6.2.6.1 The criteria for issuing the Certificate of Conformity in the initial assessment stage must follow
the requirements established in the GDPR.
6.2.6.2 The Certificate of Conformity must be valid for four (4) years from the date of its issuance.
6.2.6.3 In the certificate of conformity, the model(s) belonging to the family must be noted as shown in
Table 5 below:

6.3 Evaluation from Maintenance


The criteria for the evaluation of maintenance shall follow the requirements set out in the GDPR. The
purpose of the maintenance assessment is to verify whether the technical and organizational conditions
that gave rise to the initial granting of the certification continue to be met. The frequency of audits and
maintenance tests is 12 (months) months from the granting of the certificate.
6.3.1 Audit from Maintenance of the QMS and Evaluation of the Process
Productive 6.3.1.1 The criteria of the Maintenance Audit are contemplated in
the RGCP.
6.3.1.2 The audit must be carried out and concluded every 12 (twelve) months, counted from the
issuance of the Certificate of Conformity, observing the QMS evaluation requirements set forth in Table
1 and whether the manufacturer is meeting the technical requirements set forth in Table 2 of this RAC.
6.3.1.3 The manufacturer must present, during the performance of maintenance audits, records that
prove the performance of routine Fragmentation and Flatness tests, in accordance with the ABNT NBR
14698 standard.
6.3.2 Plan from Tests from Maintenance
The criteria for the maintenance test plan must follow the requirements set out in the GDPR, and the
maintenance test must be carried out and completed every 12 (twelve) months after the Certificate of
Conformity is granted.
6.3.2.1 Definition from Tests the Be Performed
The tests must follow the requirements established in the GDPR and in sub-item 6.2.4.1 of
this RAC. 6.3.2.2 Definition Of Sampling from Maintenance
The definition of sampling and acceptance and rejection criteria must follow the requirements
established in the RGCP and in sub-item 6.2.4.2 of this RAC.
6.3.2.3 Definition from Laboratory
The definition of a testing laboratory shall follow that described in the GDPR.
6.3.3 Treatment from No Conformities in Stage from Evaluation from Maintenance
The criteria for handling non-conformities in the maintenance assessment stage must follow the
requirements established in the GDPR.
6.3.4 Confirmation Of Maintenance
The criteria for confirming maintenance must follow the requirements set out in the GDPR. 7.
EVALUATION FROM RECERTIFICATION

The general recertification evaluation criteria are included in the RGCP. The recertification assessment
must be carried out and completed before the expiry date of the Certificate of Conformity.

8. TREATMENT FROM COMPLAINTS


The criteria for handling complaints must follow the requirements set forth in the GDPR.

9. ACTIVITIES PERFORMED BY OCP BELIEVED BY MEMBER OF THE MLA OF THE IAF


Activities performed by an accredited OCP by an IAF MLA member must follow the requirements set out
in the GDPR.

10. TRANSFER OF CERTIFICATION


The criteria for certification transfer must follow the requirements set forth in the GDPR.

11.CLOSING OF CERTIFICATION
The criteria for termination of certification must follow the requirements set forth in the GDPR.

12.SEAL FROM IDENTIFICATION OF COMPLIANCE


The criteria for the Conformity Identification Seal shall follow the requirements set out in the GDPR and
Annex II.

13.AUTHORISATION TOWARDS Or USE OF THE STAMP FROM IDENTIFICATION OF COMPLIANCE


The criteria for Authorization to Use the Conformity Identification Seal must follow the requirements set
forth in the GDPR.

14.RESPONSIBILITIES And LIABILITIES


The criteria for responsibilities and obligations should follow the requirements set out in the GDPR.

15. FOLLOW-UP IN MARKET


The criteria for monitoring in the market shall follow the requirements set out in the GDPR.

16.PENALTIES
The criteria for penalties must follow the requirements set forth in the GDPR.

17.COMPLAINTS, COMPLAINTS And SUGGESTIONS


The criteria for complaints, complaints and suggestions must follow the requirements established in the
RGCP.

ATTACHMENT II – STAMP FROM IDENTIFICATION OF COMPLIANCE

The Conformity Identification Seal must be affixed in an easily visible place on certified flat tempered
glass, or on its packaging, by means of affixing or printing, as long as it complies with the defined
dimensions, and one of the versions of the Complete Seal can be chosen, as shown in Figure 1 below.
