Reference order dated 10.03.2017passed by Hon’ble Mr. Justice
R. K. Gauba in CS(OS) No. 330/2016.

Vide orders dated 21.10.2016 the Hon’ble Court has directed the
Registrar(Original) to take the requisite steps to send the document i.e.
Memorandum of understanding dated 15th June, 2013 to the Collector of
Stamps for determination of the stamp duty and penalty payable by the
plaintiff on the same under the law as the said document purports to
have been executed without any stamp duty being paid.

A letter was sent to the Collector of Stamps alongwith the certified


copy of Memorandum of understanding dated 15 th June, 2013 for taking
necessary action and file compliance report in this regard.

But till date no report has been received from The Collector of
Stamps, 5 Shamnath Marg, New Delhi. Hence vide order dated
10.03.2017

It is submitted that a Court Fee Refund Certificate was issued

The report of the SHO of P. S. Shakarpur, Delhi has been received


and the same is declaring therein that Shri Bishan Singh Bhatt and

In view of above, if approved, a letter in this regard may be sent

17.07.2018, wherein it is mentioned that plaintiff is using all the tactics for delaying
the matter thus it is requested to hear the above said matter expeditiously, preferably

It is pertinent to mention here that Sh. J. S. Malik is Defendant in the above


said suit.

In this connection, kind attention is invited to Rule 1, Chapter 1, Part A(a) of


Delhi High Court Rules & Orders Vol. V which is reproduced as under:

PUC is a letter dated 04.09.2018 received in this Court on 06.09.2018 vide


diary no. 22968 from Sh. J. S. Malik, C-4/49, Safdarjung Development Area,
New Delhi.

Vide PUC Sh. J. S. Malik (74 years old) has stated that he is defendant in
the above said suit and this is his second letter to this Hon’ble Court. It is
pertinent to mentioned here that Sh. J. S. Malik filed his first letter on
16.07.2018, which was returned to him (in original) with cover letter no. 9778-
I/Orgl./DAII/DHC dated 30.07.2018 (at flag ‘A’) referring therein Rule 1, Part
A(A), Chapter 1, Vol. V, Delhi High Court Rules & Orders, under the order of
Worthy Registrar (Original) (at flag ‘B’).

Rule 1, Part A(A), Chapter 1, Vol. V, Delhi High Court Rules & Orders
which states as under:

“1. To be deposited in petition box during Court hours –


All ordinary appeals, petitions and applications for review
or revision, written statements, affidavits or other
documents sought to be presented to the Court, shall be
presented by litigants or their Advocates by depositing them
in the petition box of the Court outside the room of the
Deputy Registrar (now on the filing counter on the ground
floor of new Delhi High Court building) between the hours
of 10 a.m. to 4 p.m. on every day which is not a Court
holiday. Petitions, written statements, affidavits or other
documents sought to be presented to the Court, sent by

In his present letter Sh. J. S. Malik (defendant) has further stated that:

of the captioned suits are trying to illegally grab the village land which land actually
is of the Gram Sabha. He further requests to this Hon’ble Court to intervene and
save the village land from being illegally captured.

objections:-
(1) Process fee filed on 30.03.2019 vide diary No. 295902 (in compliance of order dated
19.03.2019 was returned on 11.04.2019 for want of 1 Regd. AD cover. No SMS was
sent regarding this objection as there was no mobile number in the
database/software.
(2) Process fee filed on 02.07.2019 vide diary No. 551322 (in compliance of order dated
23.05.2019) was returned on 04.07.2019 for want of 1 Regd. AD cover. An SMS
regarding this objection was sent on mobile No. 9654530410 on 10.07.2019.
(3) Process fee on 26.07.2019 vide diary No. 672576 was returned as there was no fresh
order for issuance of summons/notice for the next date of hearing and without any
specific order summons cannot be issued. An SMS regarding this objection was sent
on mobile No. 9654530410 on 08.08.2019.
It is further informed that the case files of CS(COMM) 1271/2018 were and are very

It is stated in the said letter that transfer/sale of Govt. land


bearing Khasra No. 669/204, Village Pipal Thala, Tehsil-Model Town,
District North West, Delhi is illegal & pray that a fair & impartial
inquiry be conducted in the matter.

Complainant states in para 6 of his letter that

“That certain Land Mafia, including persons


associated with said Anglican Church of India
(Defendant No. 1) are involved in the grabbing of
land, belonging to the Govt. and disposing of the
same by illegal means, including forged documents
and misusing the process of law for their selfish
motives.”.

“That a number of litigations are pending


adjudication/invstigation before various
Courts/Police Stations against the persons,
associated with the said Anglican Church of India,
relating to cheating, forgery, criminal breach of
trust and misappropriation of Govt. Land”.

The captioned suit i.e. CS(OS) 1544/2005 has been decreed


vide order dated 08.01.2008 (copy enclosed) and accordingly a
decree sheet dt. 08.01.2008 (copy enclosed) was prepared.
Thereafter, the suit file was sent to the RKD branch for consignment
and the same has been weeded out on 22.11.2019.

In this connection, kind attention is invited to Rule 1, Chapter 1,


Part A(a) of Delhi High Court Rules & Orders Vol. V, which is
reproduced as under:

Court hours – All ordinary appeals, petitions and
applications for review or revision, written
statements, affidavits or other documents sought to

“1. To be deposited in petition

their Advocates by depositing them in the
