1. Problem statement

Colombia is a Social State under the rule of law that focuses on the protection of

human dignity, as well as on life and death, as stipulated in Articles 1, 42, 53 and 70 of the

Colombian Constitution, which establish human dignity as a basic element for the

protection of fundamental rights in the Colombian population.

Crimes such as homicide and murder are inspected, measured and punished by the

Colombian penal code, however, to reach a trial an investigation must be carried out where

both the situation and the circumstances are analyzed, among these circumstances the

emotional behavior of the victimizer is analyzed, thus some factors can be obtained that

may be key when judging the convicted person.

Criminal psychology is a branch of psychology that focuses on crime scene analysis among

other factors, a criminal psychologist can play an important role in the development of a

criminal investigation, detailing the signature, pattern and modus operandi of the

perpetrator through psychological profiling, even through witness analysis criminal

psychologists can help to tie together an investigation.

An expert witness is a person with training and knowledge of a subject, who, before a

judge, is capable of giving testimony that can influence the making of a decision at the time

of a trial or a prejudgment,
As mentioned above, emotional behavior is an investigative factor that can change the

course of the trial and the conviction of the perpetrator. By analyzing his emotional and

mental behavior, an explanation can be given and the auditors can try to understand the

actions of the individual at the time of committing the crime, in certain cases it can affect

the time and form of the sentence, as in the case of the Colombian ex-colonel Aldana.

For this reason, the following question is asked: What emotional factor could have caused

Colonel Aldana to make the decision to murder his wife and why?
2. Objectives

I General objective:

To carry out a psychological profile which allows to understand the influence of

emotions in the victimizers through the analysis of a case.

II Specific objectives:

 Analyze the usefulness of criminal psychology through the study of a psychological

profile.

 Conduct a detailed study from the perspective of criminal psychology to determine

the case of Colonel Aldana, using as a basis the psychological study presented in the

verdict of the case.

 To support a testimony from the perspective of a court expert using a psychological

profile of the present case.


3. Justification

In the wild nature, what the human being knows as violence is only a

survival instinct to which animals frequently resort, however, as the Greek philosopher

Aristotle said, "the human being is a rational animal", focusing on this quote, it is clear to

understand that reasoning allows the human being to have a moral perspective on this

violence, defining what is right and what is wrong by means of his rationality.

A large part of the human population finds it difficult to understand

how it is possible for a human being to attempt against the life of another in such particular

and cruel ways, that is why this research project seeks to expose how emotions are seen, a

factor that is present in every human being, involved in a crime with the intention of

analyzing the behaviors of a criminal, The project seeks to inform, because in these

situations there are doubts, but few people think about resolving those doubts and this leads

them to a pit of ignorance (taking into account that ignorance is an insult to the intellectual

capacity and responsibility of human beings) in which only the superficial is seen and not

what transcends it.

As codependents who participate and usually live in community,

humanity must take into account that the problems in society belong to everyone, that is

why getting into these problems makes the human being a responsible being with his own

community, in this project we seek to expose the mind of a criminal, because this way, as

mentioned before, through samples, exhibitions and warnings such as those that are sought

to denote in this project, the human being can be informed, show interest, responsibility and

even be participants in the solution of problems before the events that happen every day in

our society.
As previously mentioned, the project seeks to analyze a case from the

perspective of criminal psychology, this may be allowed through an extensive research of

different terms in order to be instruments for the realization of the psychological profile

(purpose of the project) which will raise and expose this terminology focused on the case to

understand the mind of a criminal, in this case, Colonel Aldana through an analysis of

documentation focusing on this case with the intention of finding advances that can

complement the development of the project.

5. Methodology

The main objective of the current project is the elaboration of a psychological


document, which will be based on the analysis of several guiding documents. These
documents will provide accurate information on the construction of psychological profiles,
especially those related to the main case of the project: the case of Colonel Aldana. This
case will be the object of an exhaustive investigation and analysis of the available data,
covering relevant aspects such as the crime scene, the development of the trial and the
verdict. In addition, an expert simulation will be carried out from the perspective of
criminal psychology, delving into the details of the case.

The approach adopted for this study will be qualitative in nature, which implies
detailed attention to the meanings, facts and results that emerge from the analysis. The aim
is to obtain a deep understanding of the elements that contribute to the construction of
Colonel Aldana's psychological profile. To achieve this purpose, a bibliographic method
will be used, in which a variety of sources that address relevant aspects of the case will be
resorted to. These references will play a fundamental role in the case study, providing
valuable information for the elaboration of the psychological document.

The bibliographic method will allow access to a wide range of academic and
scientific resources that delve into the psychological dynamics involved in cases similar to
that of Colonel Aldana. Likewise, a critical review of the existing literature in the field of
criminal psychology will be carried out, which will enrich the analysis and interpretation of
the data collected. This methodological approach guarantees a rigorous and evidence-based
approach for the elaboration of the psychological profile of the protagonist of the case.
6. Theoretical Framework

Psychological profiling: Psychological profiling is a technique used in forensic


psychology and criminalistics to understand and describe the psychological characteristics
of an individual, usually in relation to the commission of a crime. This process involves
analyzing various factors, such as behavior, personality, motivations and possible mental
disorders of the subject, in order to create a profile that helps in the identification, capture

Verdict: The verdict is the final decision rendered by a court, based on the evidence
presented during a trial. It can be of different types, such as guilty, not guilty, or in some
legal systems, specific verdicts related to the defendant's mental health. The verdict plays a
crucial role in the judicial system, as it determines the defendant's legal responsibility and

Criminal Psychologist: A criminal psychologist is a professional specializing in


forensic psychology who applies psychological principles and techniques in the legal and
criminal field. Their work involves assessing and understanding criminal behavior,
providing psychological expertise in court cases, developing criminal profiles, assessing the
mental competence of defendants, and providing treatment to criminals or persons involved

Mental Disorders: Mental disorders are conditions that affect a person's thinking,
mood or behavior, and can cause significant distress or impairment in daily functioning. In
the forensic context, the assessment of mental disorders is important in understanding a
person's ability to understand the nature of his or her actions, assume legal responsibility,

Pathologies: Pathologies are physical or mental abnormalities or disorders that


affect an individual's health and functioning. In the forensic setting, the term can refer to
any medical or psychological condition that may influence criminal behavior or an
individual's ability to participate in a fair trial. The assessment of pathology is essential to
understanding how these conditions may have influenced the subject's behavior. (guardiola,

Expert witness: An expert witness is an expert in a specific field, such as


psychology, medicine, engineering, among others, who offers his or her knowledge and
experience to assist a court in the resolution of legal cases. In the context of forensic
psychology, a court expert can provide reports, testimony and expert opinions on issues
related to mental health, personality assessment, legal competence and other psychological
aspects relevant to a particular case.

2. Development of the psychological profile

2.1. The case

The process of psychological mapping of the personality pointed out Joaquín


Henrique Aldana Ortiz as a loving husband and holy father, highlighting that he was not
a psychopath or a monster or an insane person with gloves, but a person who was in
situations where abandonment, pawning, deceit and amorous betrayal took place. At the
sentencing level, the defense insisted on its character approach, highlighting the fact
that Aldana Ortiz was not in conditions to develop the criminal acts for which he was
accused, a fact that the prosecution considered as possible for a murderer. In addition,
the defense at times highlighted the impossibility of Aldana Ortiz at various times to
commit the crime.

However, different aspects of the psychological profile of the implicated


Joaquín Enrique Aldana Ortiz are also mentioned; he mentions his dependent and
affective part of his relationship with his partner, which highlights his attitude with
compulsive, perfectionist and controlling traits in his work environment. He also
mentions his great emotional reaction, the situation of indolence towards his daughter
and the complaints regarding his behavior towards female police officers. It also
mentions his attitude towards his wife's infidelity, the possibility of a violent reaction
by recording details of his wife's infidelity and his behavior after the crime with the
distribution of wrong information by his location and the manipulation of physical
traces of the elements related to the crime.

Main facts

On September 9, 2009, in the San Isidro hacienda located at km 5 on the


road to Alvarado Tolima, a worker found a black bag containing a human head
with a disfigured face. Subsequently, other body parts were found on different
dates and places, all identified as belonging to Erika Cecilia Yeneris Gutierrez.
The parts were taken to forensic medicine for necropsies, revealing that the
victim had suffered multiple blunt trauma to the head.

Alteration in evidence

The soft tissues and internal organs had been removed from the body,
preserving only the intentionally dissected skin fragment of the trunk, the mammary
prosthesis, fragments 3 and 4 of the chondral cost joint and the skin at the pubis
level were removed, all with the purpose of making the identification process more
difficult. The description of the crime reflects a scene where the individual victimizer
attacks his victim in the midst of anger and jealousy, feelings that had been cultivated for
some time, which is proven by the discovery of a spy program that was introduced in the
victim's computer which allowed knowing the emails and dialogues that the victim had.

Celopathy can be broken down into other emotional and even mental conditions
that the perpetrator may suffer from, such as a possible Othello syndrome which is also
known to be secondary to cerebral tuberculoma, a brain condition whose symptoms are
delusions of infidelity and violence, something that has already been made clear through
the case exposition.

Psychopathy

Colonel Aldana, on September 8, atrociously murdered his wife, dismembered her


in one night and scattered evidence in at least three days, weeks later, it was the birthday of
his daughter, a child he had had with the victim whose life he had cruelly snatched, and not
enough of that, he devised a perfect alibi to cover the disappearance of his partner, to the
victim's family, responding short and crudely, he informed them that she had gone to
Medellin with a lover, however, a father should have enough heart and love for his
daughters, not to tell them the truth, because clearly this would make all his alibi fall apart,

partner, which, consequently, can lead to jealous attitudes and violent behavior towards

7. Conclusions

Through the analysis of the case, it was possible to find certain psychological
characteristics that Colonel Aldana possibly suffered from such as those exposed in the
psychological profile made previously, following that psychological profile it is
possible to generate the theory that Colonel Aldana acted consciously under anger, fear
and insecurity following the following points:

1. Colonel Aldana, visualizing that his relationship was in decline and with a
severe obsession with the idea of a possible infidelity, decides to track his wife's
messages by accessing her computer with a spy system.
2. The accused refutes that he found messages indicating that his partner was going
to go to Medellin with her lover, however, the prosecution stated that no
conclusive evidence of this was found, simply messages where the victim asked
her brother to arrange her apartment in Medellin to go there at the end of the
year, possibly, the victim, also noting that their relationship was plummeting and
already exhausted from the pressure and control of her husband, was
considering going to live in Medellin and perhaps terminate the marriage.
3. Colonel Aldana, seeing the messages and suspecting abandonment, under the
fear of loneliness, possibly of losing his "beloved" daughters and dependence on
his partner, moreover under delirium and celopathic conditions, acts maniacally
and murders his wife, something he could have considered before, which is why
his crime was well organized and prepared.
4. Finally, the accused hides the body (a process already described above) and
devises an alibi based on his delusions of infidelity.
