D. N. PATEL, Chief Justice (Oral)


1. This public interest has been preferred with the following prayers:-
"a) Direct the Commissioner of Delhi police and his
officers not to put the mandate of using Urdu and
Persian Words in the entire Fl.R. (First
Information Report).

b) Direct the Commissioner of Delhi police and his
officers to use simple Hindi or English language I
(or any language suitable to the parties of the
case) in the whole of the Fl.R'J so that it can be

comprehended to entire public at large (especially
the concerned parties) OR replace the entire
formal text with comprehensive columns just like
other parts of the Fl.R .. "

2. Having heard the learned counsel for the parties and looking to the
facts and circumstances of the case, it appears that the respondents are using
several archaic Urdu. and Persian words in registering the First Information
Reports ('FIRs') under the Code of Criminal Procedure, 1973. List of such :
words have been mentioned in our orders dated 7th August, 2019 and 25t~
November, 2019. For ready reference, these two orders are extracted
hereinbelow:-
Order dated 7th August, 2019

"1. The petitioner who is appears in person has taken this


Court to the list of Persian as well as Urdu words frequently
and commonly used by the police themselves while narrating
incidents in the FIRs and normally at the end of the FIR. The
list of such words are as under.-

4. FIR should be in words of the complainant. Too much
flowery language, the meaning of which is to be found out
with the help of dictionaries, is not to be used in the FIRs.
Moreover, the police officers are working for the common
public at large and not always for those, who are Doctorate
degree holders in Urdu, Hindi or Persian languages. As far as
possible, simple words are to be used in the FIRs.

S. We, therefore, direct the Commissioner, Delhi Police to


explain whether these words used in the sample FIRs
mentioned in the memo of this writ petition, are of the
complainant or of the police personriel. ,We also direct the
Commissioner, Delhi Police :0 file an affidavit indicating as to

why they are using such type of words which are not spoken by
the concerned complainant. The affidavit shall be filed before
the next date of hearing.

"1. Counsel for the respondent No.2 submitted that the
Deputy Commissioner of Police, Legal Cell, Police
Headquarter, Delhi has already issued a Circular dated 20th
November, 2019 regarding use of simple words instead of Urdu
and Persian words while recording the FJR. Detailed list of
Urdu words being used in FIR with their respective translation
In Hindi and English at page No.109 annexed with Circular

2. The aforementioned Urdu/Persian words are being used


mechanically by the Police without knowing the meaning
thereof and without proper application of mind. FIR should be
in the simplest language possible. It should be in the words of
the person lodging the FIR. There is no need for Police to show
their knowledge of Urdu and Persian words and these words
should not be used by them mechanically without knowing their
exact meaning. Moreover, public at large may not be able to
understand all these Urdu or Persian words, therefore with
every copy of the FIR, the aforementioned list is required to be
supplied to a person seeking a copy of the FIR so that he/she
can himself/herself see the translated version of Urdu and
Persian words used in the FIR and understand the contents of
the FIR. The aforementioned Iist- may not be exhaustive as
there can be other similar Urdu and Persian words being used in
the FIR which are not mentioned in this list. The practice of
using these words in the FIR ought to be stopped by the Police.

3. Looking to the Code of Cri minal Procedure, 1973, it


appears that FIR is the most vital document prepared by Police
as it sets the process of criminal justice in motion. In fact, copy
of the FIR is required to be sent to the Magistrate immediately
as it is an immediate version of the narration of the whole
offence. In Court, FIR is required to be read time and again,
hence, it should be in a simple language or it should be in the
language of a person who has approached the Police for lodging
of FIR.

4. In view of the Circular dated 20th November, 2019 issued


by the Deputy Commissioner of Police, Legal Cell, Police
7 Headquarter, Delhi, we hereby direct the respondent No.2 to
present before this Court at least copies of ten FIRs registered

with ten different police stations so that we can verify whether
the Circular issued by the Deputy Commissioner of Police is
being followed by the subordinate police' officers/officials in
letter and spirit. Thus, minimum hundred copies of FIRs
should be presented before the Court on the next date of hearing
with supporting affidavit."

3. Pursuant to the aforesaid observations of this Court, the respondents


have issued a Circular dated zo" November, 2019 which is at Annexure-A
to the counter affidavit filed by respondent No.2.
4. In view of the aforesaid circular, learned counsel for respondent No.2
has handed over copies of approximately 100 FIRs .. Copies thereof have
also been handed over to the counsel for the petitioner. The said FIRs are
taken on record.
S. After a perusal of the aforementioned FIRs, it appears that in most of
the FIRs, the directions contained in circular dated zo" November, 2019 by
the Deputy Commissioner of Police have been followed by the respondents.
Hence, we see no reason to further monitor this case.
6. Nonetheless, we expect that the aforesaid circular dated 20th
November, 2019 shall be followed by the Delhi Police so that the general
public at large may not face any difficulty in understanding the contents of
an FIR. We also expect from the respondents that they shall upload the list
of the· archaic Urdu and Persian words which were in use while registering
the FIRs on the website of Delhi Police.
7. We also direct the Commissioner, Delhi Police that the orders of this
Court in this writ petition as well as copy of the aforesaid circular dated zo"
November, 2019 should be circulated to the concerned Police Officers so as
to percolate the same in the hierarchy and also to the teaching/educational

institutes meant for training of Police Personnel.
8. We further clarify that the list which have been enumerated in our
orders as extracted hereinabove is not exhaustive. The respondents, in their
discretion, may curtail or add to that list.
9. Before parting, we deem it appropriate to clarify that we have not
opined against the use of Urdu words per se. Every language is entitled to
command its own respect, and we are conscious of the richness of Urdu as a
language. We only seek to emphasize that an FIR, by its very nature, has to
be worded in a manner as would make it comprehensible to the common
man. An FIR is the starting point of the criminal investigative process, and
usage of archaic expressions, which the common man rarely-if-ever-uses,
can have serious repercussions on the efficiency and efficacy of the criminal
justice delivery system. We, therefore, clarify that while the use of Urdu
words of common usage, like "kitaab", "ilzaam", "hawaalat" etc. may be
permissible, obscure and archaic expressions can findno place in an FIR.
10. With these observations, the writ petition is disposed of.

11. In view of the disposal of the writ petition, we see no reason to
entertain this application.
12. The application is accordingly dismissed.
