AFFIDAVIT OF UNDERTAKING
I, ANTONIO COYOCA, of legal age, Filipino, and a resident of Magdugo,
Toledo City, Province of Cebu under oath hereby declare and depose that:

1. I am the duly authorized representative of Humprey R. Benitez who


applied for the issuance of a Certificate of Precondition with the National
Commission on Indigenous Peoples (NCIP) in connection with his exploration
project denoted as EXPA-000197VII pending before the Mines Geosciences Bureau
(MGB) of Department of Environment and Natural Resources, Region VII;

2. The exploration project site is situated and covers certain barangays in


the Municipality of Pinamungahan and Toledo City, Province of Cebu which the
NCIP Cebu personnel visited for purposes of field based investigation on July 7-8,
2011;

3. The pertinent data gathered through this field investigation initially


indicate that the exploration project of Humprey R. Benitez does not overlap or
falls within an ancestral domain nor affect an IP community and/or no pending
ancestral domain claim was noted;

4. The National Commission on Indigenous Peoples (NCIP) through the


Regional Director for Regions VI & VII will issue a Certificate of Non-Overlap (CNO)
in lieu of Certificate of Pre-Condition in accordance with Section 21 of
Administrative Order No. 01 Series of 2006 or “The New Guidelines for Free Prior
Informed Consent;

5. Humprey R. Benitez through me agrees to and shall undertake the


conduct of another Field Based Investigation and the ensuing Free Prior Informed
Consent (FPIC) activity in the event an overlap in whole or in part of any ancestral
domain/land is later discovered in the areas concerned; and

6. I am executing this Affidavit of Undertaking as a requirement for the


issuance of Certificate of Non-Overlap (CNO);
