No. SRO A-20/2022.—The following draft of an amendment to the Tamil Nadu Factories Rules, 1950 which is proposed
to be made in exercise of the powers conferred by section 19 and section 112 of the Factories Act, 1948 (Central Act LXIII
of 1948) is hereby published for information of all persons likely to be affected thereby as required by section 115 of the
said Act.
2. Notice is hereby given that the draft amendment will be taken into consideration after the expiry of forty five days
from the date of publication of this notification in the Tamil Nadu Government Gazette and that any objections or suggestions
which may be received from any person with respect thereto before the aforesaid period of expiry, will be considered by
the Government of Tamil Nadu. Objection and suggestion, if any, should be addressed in duplicate to the Additional Chief
Secretary to Government, Labour Welfare and Skill Development Department, Chennai-600 009, through the Director of
Industrial Safety and Health (FAC), 47/1-Thiru.Vi.Ka. Industrial Estate, Guindy, Chennai-32.

APPENDIX.
NOTIFICATION-I
No. SRO A-21/2022.—In exercise of the powers conferred by sub-section (1) of section 303 read with section 77-A of
the Tamil Nadu District Municipalities Act, 1920 (Tamil Nadu Act V of 1920), the Governor of Tamil Nadu hereby makes the
following Rules:-
Rules.
1. Short title.- These rules shall be called the Tamil Nadu Town Panchayats Engineering Service Rules, 2022.
2. Constitution.- The service shall consist of the following categories of posts, namely:-
3. Appointment.- Appointment to the categories specified in column (1) of the table below shall be made by the methods
specified in the corresponding entries in column (2) thereof:-

The Table.
4. Appointing Authority.- Appointing Authority for the posts included in categories 1 and 2 shall be the Government and in
respect of categories 3 and 4 shall be the Commissioner of Town Panchayats.
5. Reservation of appointment.- The principle of reservation of appointments as provided in section 27 of the Tamil Nadu
Government Servants (Conditions of Service) Act, 2016 (Tamil Nadu Act 14 of 2016), shall apply in the case of direct recruitment.
6. Unit of operation of rules.- Unit of operation of rules for the purposes of appointment to the service, discharge for want
of vacancy, re-appointment, appointment as full member of the service, seniority, promotion and transfer, State shall be the
unit for all categories.
7. Qualifications.- (1) Age.-No person shall be eligible for appointment to the posts in the service by direct recruitment, if he
has completed or will complete thirty years of age on the first day of July of the year in which the selection for appointment
is made:
Provided that a candidate belonging to Backward Classes, Backward Classes (Muslims), Most Backward Classes
and Denotified Communities shall be appointed to the posts in the service by direct recruitment if he has not completed
thirty-three years of age:
Provided further that a candidate belonging to Scheduled Castes and Scheduled Tribes shall be appointed to the posts
in the service by direct recruitment if he has not completed thirty-five years of age.
(2) Other qualifications.- No person shall be eligible for appointment to the category specified in column (1) of the table
below by the method specified in the corresponding entries in column (2) unless he possesses the qualifications specified in
the corresponding entries in column (3) thereof:-

The Table.
8. Preparation of annual list of approved candidates.- (1) For the purpose of drawing up of the annual list of approved
candidates for appointment to the posts in the service by promotion or by recruitment by transfer, the crucial date on which
the candidates should have acquired the prescribed qualification shall be the 5th March of every year.
(2) (a) The Commissioner of Town Panchayats shall prepare the panel of names of the eligible persons from the feeder
categories.
(b) In respect of the posts in categories 1 and 2 he shall prepare and send the annual list of approved candidates to
the Government for approval.
9. Procedure for direct recruitment.- (1) Direct recruitment to category 4 shall be made by calling for names of eligible
candidates from the employment exchanges besides inviting applications by giving advertisements in two prominent dailies(one
in vernacular language).
(2) The candidates to be appointed shall be selected on the basis of merit by the appointing authority or by an officer
designated by the appointing authority or by a Committee of Officers not exceeding three duly constituted by the appointing
authority, subject to the rule of reservation of posts wherever applicable after subjecting the candidates to an oral interview
and, if necessary, a short written test which can be evaluated in a short time.
10. Probation.- (1) Every person appointed by direct recruitment shall, from the date on which he joins duty, be on probation
for a total period of two years on duty within a continuous period of three years.
(2) Every person appointed by recruitment by transfer shall, from the date on which he joins duty, be on probation
for a total period of one year on duty within a continuous period of two years.

11. Tests.- (1) Every person appointed as Assistant Engineer by direct recruitment or by recruitment by transfer shall, within
the period of his probation, pass the Account Test for Public Works Department Officers Part I and II.
(2) If he fails to pass the said tests within the period of probation, his probation shall be extended upto a maximum
period of five years and his second and subsequent increments shall be stopped without cumulative effect till he passes the
said tests. If he passes the said tests within the above stipulated period, he shall be eligible for sanction of the second and
subsequent increments on normal dates.
(3) (a) If a person appointed by recruitment by transfer does not pass the said tests within the maximum period of five
years, he shall be reverted.
(b) If a person appointed by direct recruitment does not pass the said tests within the maximum period of five years,
his probation shall be terminated.
12. Promotion.- Promotion shall be made on grounds of merit and ability, seniority being considered only where merit and
ability are appoximately equal.
13. Transfers and postings.- (1) The Government shall be the authority competent to transfer the members of service in
categories 1 and 2.
(2) The Commissioner of Town Panchayats shall be the authority competent to transfer the members of the service in
categories 3 and 4.

of the service from one district to other district. The Collector of the concerned revenue district shall be the authority competent
to transfer the Overseer/Draughtsman/Work Inspectors from one Town Panchayats to another Town Panchayats within a District.
No. SRO A-23/2022.—In exercise of the powers conferred under clause (iv) of sub-section (2) of Section 110 read with
sub-section (3) of Section 105 of the Juvenile Justice (Care and Protection of Children) Act, 2015 (Central Act 2 of 2016),
the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Juvenile Justice Fund Rules, 2017.
Amendments
1. in rule 4, after clause (XIX), the following clause shall be added namely:-
"(XX) To provide financial assistance to the orphaned/abandoned girl children discharged from the Government Children Home
on completion of 18 years of age for the various assistance / services".
2. In rule 6, sub-rule (1) in clause (ii), for the expression "Deputy Secretary to Government, Finance Department", the
expression "Joint Secretary or Deputy Secretary to Government, Finance Department" shall be substituted.
