EXTRA-JUDICIAL SETTLEMENT OF

ESTATE WITH SALE


KNOW ALL MEN BY THESE PRESENTS:

This EXTRA-JUDICIAL SETTLEMENT ESTATE WITH SALE is made


and entered into by and among:

FLORMA B. ALTIZO, widow, of legal age, Filipino, and a resident of


Sasa, Davao City, Philippines;

FLORDECITA ALTIZO PUNAYAN, married to ROLYN C. PUNAYAN,


both of legal age, Filipinos, and residents of Mawab, Davao de Oro,
Philippines;

ROMULO B. ALTIZO, who died single on February 03, 2022,


without any issue and/or surviving heirs;

VENERANDO B. ALTIZO, married to MELITA M. ALTIZO, both of


legal age, Filipinos, and residents of Poblacion, Boston, Davao Oriental,
Philippines;

ANTONINO B. ALTIZO, who died on April 20, 2022, without any


issue and left no will, and was survived by the following heirs namely:
JURIBEL L. ALTIZO and GRACE T. ALTIZO, both of legal age,
widow/single respectively, Filipinos, and residents of Carmen, Boston,
Davao Oriental and Samal, Davao del Norte.

All hereinafter referred to as Heir-Vendors; and

ANGELIE M. ALTIZO, living together with STEPHEN JIM T. ADALIM,


both of legal age, Filipinos, and residents of Poblacion, Boston, Davao
Oriental, Philippines, hereinafter referred to as the Vendee.

W I T N E S S E T H, THAT:

WHEREAS, MERCURIO BOTON ALTIZO, died in Boston, Davao


Oriental, on December 27, 1991, without leaving any will and left no
known debts or obligations;

WHEREAS, the above-named persons are the surviving children of


the aforementioned deceased person referred to as heir-vendors;

WHEREAS, during the lifetime of MERCURIO B. ALTIZO, he


owned a parcel of land covered by Transfer Certificate of Title No.
T-27619 situated in Boston, Davao Oriental, containing an area of Six
Hundred Seventy Five (675) square meters, more or less, which is
hereunder particularly described as follows:

Cadastral Case No. N-21, L.R.C. Cadastral Record No. N-153),
situated in the Bo. of Boston, Mun. of Cateel, Province of Davao.
Bounded on the NE., by San Nicolas Street (Provincial Road); on the
SE., by Lot No. 3404; on the SW., by Lot 3343; and on the NW., by
Lot 3406. Beginning at a point marked “1” on plan, being S. 27 deg.
47’W., 20.10 m. from B.L.L.M. No. 3; T H E N C E……..

S. 5 deg. 59’E., 23.25 m. to point 2;


N. 78 deg. 03’W., 24.73 m. to point 3;
N. 25 deg. 37’W., 24.42 m. to point 4;
N. 79 deg. 07’E., 32.92 m. to the point of
beginning.

Containing an area of SIX HUNDRED SEVENTY FIVE (675),


SQUARE METERS, more or less. All points referred to are
indicated on the plan. Bearings True. Dates of survey, November
16, 1940 – December 31, 1941 and September 1, 1946 – November
5, 1954.

Pursuant to Rule 74 Section 1 of New Rules of Court the above-


mentioned heirs have hereby agreed to settle, partition, and divide
equally among themselves the afore-mentioned parcel of land.

For and in consideration of the sum of ONE HUNDRED FIVE


THOUSAND PESOS (P105,000.00) ONLY, Philippine Currency,
which the Heir-Vendors have received from the Vendee, to their
complete and mutual satisfaction, the Heir-Vendors hereby SELL,
CEDE, TRANSFER, CONVEY and DELIVER, possession, control and
ownership unto the Vendee a portion of ONE HUNDRED THIRTY
FIVE (135), square meters, more or less, and all other
improvements existing and found therein, or their heirs, assigns and
successors-in-interest, free from all liens and encumbrances.

IN WITNESS WHEREOF, the parties have hereunto set their hands
