Chapter 3 : The Malaysian Constitution

What is Constitution? The Constitution contains the principles which determine how a state is established and ruled in the dictation of the laws, customs, or common orders adopted. It is related to matters on how general decisions are made and how authority is distributed among government institutions, either at the central level or at the local authority. It is the highest source of laws in a country. It exists to coordinate the governance of a country. History of Malaysian Constitution It was first introduced as Constitution of the Federation of Malaya on Merdeka Day. It was then changed to Constitution of Malaya on 16th September 1963. A constitutional conference was held in London from 18 January to 6 February 1956 attended by a delegation from the Federation of Malaya, consisting of four representatives of the Rulers, the Chief Minister of the Federation Tunku Abdul Rahman and three other ministers, and also by the British High Commissioner in Malaya and his advisers. The conference proposed the appointment of an independent commission to devise a constitution for a fully self-governing and independent Federation of Malaya. This proposal was accepted by Queen Elizabeth II and the Malay Rulers. Role of Constitution Creating a fair government - Leaned on the interracial tolerance in several issues, such as the Malay special rights, the Malay language, the religion of Islam. Prevent abuse of power and restrict the movements of both government and populace - Create distribution of power and would prevent power domination by any party. Role of Constitution A tool for resolution of problems - The prime source of reference in the formulation of Federal and State legislations. Any conflicting issue in the enactment of laws is referred to the Constitution. Guarantees the continuity of a nation - It preserve the identity of the Malaysian nation as through the countrys administration and legislative processes can be implemented. The Main Features of The Malaysian Constitution Malaysia is a federation Malaysia is a constitutional monarchy Malaysia is practicing parliamentary democracy Religious freedom with Islam as the official religion Doctrine of separation of power National language, citizenship and the special rights of the Malays and the native tribes of Sabah and Sarawak Main provision in the Constitution Malay language Special status of the Malay Kings Religion of Islam Citizenship Basic Rights Forms of Constitution Written constitution - The written constitution is a form constitution compiled and arranged in a document. The unwritten constitution encompasses all principles of the constitution that are not collected in a document. * Malaysia practices a written Constitution system meaning a Parliament empowered by the Constitution. Supremacy of the Constitution Constitution as the highest order, Constitutional amendments, and the relationship between State Constitution and the Federal Constituion RUKUN NEGARA National Principles is the Malaysian declaration of the five principles: National Flag of Malaysia The flag of Malaysia, also known as the Jalur Gemilang (Malay for "Stripes of Glory, comprises a field of 14 alternating red and white stripes along the fly and a blue canton bearing a crescent and a 14-point known as the Bintang Persekutuan (Federal Star). The 14 stripes, of equal width, represent the equal status in the federation of the 13 member states and the federal government, while the 14 points of the star represent the unity between these entities. The crescent represents Islam, the country's official religion; the blue canton symbolises the unity of the Malaysian people; the yellow of the star and crescent is the royal colour of Malay Ruler Vision 2020 In 1991, Vision 2020 was introduced with the objectives of turning Malaysia into a fully developed country in its own mold by the year 2020. V2020 outline the roadmap towards achieving a fully developed status by aiming for economic growth at the rate of 7 per cent per annum until the year 2020. The key in achieving the V2020 is by overcoming the 9 key areas. 1Malaysia 1Malaysia is a concept to foster unity in Malaysians of all races based on several important values which should become the practices of every Malaysian. The concept is based on the principle of People First, Performance Now fulfils the aspirations of Malaysians in line with the provisions in the Federal Constitution and the Rukun Negara 1Malaysia 1Malaysia emphasized the attitude of acceptance among the people of various races where any one race, accepts the uniqueness of other races as they are, so that the community can live together in mutual respect as citizens of one nation. In order to achieve racial unity, the people of all races and religions must think beyond racial boundaries. Conclusion Malaysian government has taken several initiatives to raise countrys unity and development. All ethics group has its role and function in the development of the country. Thus, all groups must work together, appreciate and respect the roles of each group.
