 Those who are suf fering from restriction of dif ferent abilities,
as a result of a mental, physical, or sensory impairment, to
perform an activity in the manner or within the range
considered normal for a human being
PRIVILEGES OF

20% DISCOUNT

 PWDs are entitled to 20% discount on the f f:


 Services in hotels, lodging establishments, restaurants, and
recreation centers

 Admission fees in theatres, cinema houses, concert halls, circuses,


carnivals, and other similar places of culture

 Cost of medicines of drugstores

 Cost of medical and dental services in all government facilities


20% DISCOUNT

 Cost of medical and dental services in all private hospital and


medical facilities, including diagnostic and laboratory fees, and
professional fees of attending doctors

 Fare for land, domestic air, and sea travel


20% DISCOUNT

 The discount can be used upon presentation of any of the f f:

 Identification card issued by the city or municipal mayor or the


barangay captain of the place where the PWD resides

 Passport of the PWD concerned

 Transportation discount fare Identification card issued by the


National Council for the Welfare of Disabled Persons
EXPRESS LANES

 All commercial and government establishments are required


to have an express lane for PWDs

 In the absence of such, priority should be given to the PWDs


RIGHT TO BARRIER FREE ENVIRONMENT

 BP Blg. 344 “Accessibility Law”


 No license or permit for the construction, repair, or renovation of
public and private buildings shall be granted or issued unless there is
an installation of architectural or structural facilities that shall
enhance the mobility of disabled persons

 In the case of parking place, sufficient and suitable space shall be


reserved for PWDs

 Prominent display of posters and stickers shall be used to generate


public awareness

 A penalty of not less than one month but not more than one
year

 A fine of P2,000 to P5,000 pesos

 In the case of corporations, partnerships, etc., the president,


manager or administrator, or the person in charge of
construction, repair or renovation of the building shall be
responsible
FREE USE OF GOVERNMENT
RECREATIONAL OR SPORTS CENTER

 These centers may be used by marginalized PWDs for their


social, sports, or recreational activites
FREE POSTAL CHARGES

 PWDs are entitled to free postal charges to the f f. items:


 Articles and literatures sent by mail within the Philippines and
abroad for the exclusive use of the PWD

 Aids and orthopedic devices for the disabled sent by abroad by mail
for repair
FREE POSTAL CHARGES

 This is only available to marginalized PWDs who are Filipino


citizens and:
 Certified to be a PWD by the Social Welfare and Development Office
of the municipality, city government, or representative of the DSWD
of the municipality/city government where the PWD is a resident of

 Holders of accreditation certificate issued by the Postmaster General


or representative of the Philippine Postal Corporation

 The envelope/wrapper of the mail must have the name and


address of the sender on the upper left corner, and the phrase
“Free Matter for Disabled Person” on the upper left

BANK
Facts:
 Far East Bank entered into employment contracts with deaf-
mutes, who were hired as money sorters under uniform
“Employment Contracts for Handicapped
Workers.” Subsequently, they are dismissed. The
complainants here complain that they were regular employees
and that they have been illegally dismissed.
 Private respondent, on the other hand, submits that
petitioners were hired only as “special workers and should not
in any way be considered as part of the regular complement
of the Bank.”
Issue:
Whether or not petitioners are regular employees

Held:
The Magna Carta for Disabled Persons mandates that a
qualified disabled employee should be given the same terms of
employment as a qualified able-bodied person. This being so,
petitioners are thus covered by Art. 280 of the Labor Code which
defines regular employment to be that the employee has been
engaged to perform activities usually necessary or desirable in
the usual business or trade of the employer. Therefore, the
petitioners should be deemed regular employees entitled to
security of tenure.

RIGHT TO HEALTH
SERVICES

With regard to health services, the National


Government is mandated to:
a. Provide an integrated health service for
persons with disability;
b. Institute a national health program; and
c. Establish medical rehabilitation centers in
government provincial hospitals, formulate
and implement a program to enable
marginalized persons with disability to
avail of free rehabilitation services in the
government hospitals.
