Victims' Counsel Role

 

A Victims’ Counsel assists eligible victims through most criminal and civil legal matters relating to a reported sexual assault, whether restricted or unrestricted; Victims’ Counsel are NOT mandatory reporters. 

Victims’ Counsel ensure that Victim’s Rights, as defined by Congress, are maintained throughout the court-martial process as well as protecting victims’ privacy rights throughout the investigation and court-marital process.

Victims’ Counsel chain of command runs through the Air Force Legal Operations Agency, which allows the Victims’ Counsel to provide independent legal representation to and advocacy on behalf of sexual assault victim without any risk of influence from either the victim's or the offender's chain of command. 

Qualifying victims of sexual assault may request a Victims’ Counsel at any point of the process either directly or through the SARC, FAP, AFOSI, or the legal office.

Key Victim's Rights

(1) The right to be reasonably protected from the accused.
(2) The right to reasonable, accurate, and timely notice of any related
proceeding, and to be included at those hearings (unless an exception is
met).
(3) The right to be heard at a public hearing concerning the continuation
of confinement prior to trial of the accused; sentencing hearing relating
to the offense; and a public proceeding of the service clemency and parole
board relating to the offense.
(4) The right to receive restitution as provided in law.
(5) The right to proceedings free from unreasonable delay.
(6) The right to be treated with fairness and treaded with respect for the
dignity and privacy of the victim of a sexual assault.
