TechReviewer.com ("TechReviewer", "https://www.techreviewer.com/", "Site", "Our", "Us", or "We") are owned and operated by UserDynamics LLC ("UserDynamics").

This "Agreement" is defined by the Terms of Service and Data Privacy Policy. Please review this Agreement before using TechReviewer or any other services, features, products, domains, APIs, widgets, buttons, mobile applications, or content ("Service") provided by UserDynamics LLC. By using or accessing Our Service, you ("you") are agreeing to review, understand, comply with, and be legally bound by all of the conditions and terms provided in this Agreement. If, for any reason, you do not agree or comply with this Agreement or any other terms provided by UserDynamics, you must discontinue the use of, and aren't permitted to use, any Service provided by UserDynamics LLC (including but not limited to: TechReviewer).

Unless otherwise stated on Our Service, this Agreement applies to your use of all of the websites, services, and applications that UserDynamics operates. In addition to this Agreement, your use of Our Service may also be subject to specific terms applicable to a particular part of Our Service ("Additional Terms"). If there is any conflict between this Agreement and the Additional Terms, then the Additional Terms apply concerning the relevant part of Our Service. This Agreement, along with any Additional Terms, forms a binding legal agreement between you and UserDynamics concerning your use of Our Service. Collectively, this legal agreement is referred to as the "Agreement."

By using Our Service, you represent and warrant (i) that you are thirteen (13) years of age or older, (ii) if you are the age of majority in your jurisdiction or over, that you have read, understood, and agree to be bound by this Agreement, and (iii) if you are between thirteen (13) years of age and the age of majority in your jurisdiction, that your legal guardian has reviewed, understood, and agrees to this Agreement, and you have the express permission of that legal guardian to obtain an Account and to use Our Service.

No individual under the age of thirteen (13) may use any part of Our Service, provide any personal information to Us, or otherwise submit personal information through Our Site or Service (including but not limited to: a name, telephone number, email address, or address). You can only use Our Service if you can form a binding contract with Us and are not legally prohibited from using Our Service.

We reserve the right, at Our sole discretion, to change, remove, or add to this Agreement at any time. Any such revision or change to the Agreement will be effective seven (7) days following posting on Our Service. In that case, We will post an updated Agreement and indicate the date of revision. You are responsible for reviewing and following any such modifications. By using and continuing use of Our Service, you are accepting and agreeing to any such modifications.

The materials presented on the Services, including the Site, are designed for your individual, non-commercial utilization. All resources provided or present on the Services (including but not limited to text, photos, visuals, illustrations, audio snippets, video snippets, overall appearance, metadata, data compilations, all also termed as "Content") are protected by copyright laws, either owned or supervised by TechReviewer or the entity recognized as the source of the Content. TechReviewer also retains copyright over the organization, combination, and enhancement of such Content ("Arrangement"). All supplementary copyright details, data, or constraints in any Content accessed via the Service must be respected. Non-commercial utilization excludes using Content without prior written authorization from TechReviewer in relation to: creating any software, notably for training machine learning or AI systems; or offering archived or temporary data collections that include Content to another individual or organization.

Our Service or App may include features that advocate for various types of physical activity. Acknowledge the associated risks and consult with a medical professional before participating in any form of physical activity. Userdynamics is not liable for any damages or injuries you may be subjected to, receive, or cause resulting from your use of, correctly or otherwise, the features or Content on Our Apps or Services. In addition to those liabilities, We are also not liable for, but not limited to, any damage towards yourself, others, objects, devices, mobile phones, tablets, computers, or anything else.

All information provided by Our Service or App is approximate and is for educational/entertainment purposes only. Any information here is not intended to be health, medical, or safety advice specific to any individual's health, medical condition, or safety precautions. TechReviewer does not guarantee the accuracy, entirety, or applicability of any text, images, audio, or video Content. Anything provided by TechReviewer is to not be considered a treatment, diagnosis, strategy, or endorsement for a specific method in regard to your health and is not expected to provide exact medical advice. You agree to use all Content at your own risk.

Violating laws and rights
You may not (a) use any part of Our Service for any illegal purpose or in violation of any local, state, national, or international laws, (b) violate or encourage others to violate any right of or obligation to a third-party, including by infringing, misappropriating, or violating intellectual property, confidentiality, or privacy rights.

Solicitation
You may not use Our Service or any information provided through Our Service for the transmission of advertising or promotional materials, including junk mail, spam, chain letters, pyramid schemes, or any other form of unsolicited or unwelcome solicitation.

Disruption
You may not use Our Service in any manner that could disable, overburden, damage, or impair the Services, or interfere with any other party's use and enjoyment of the Service; including by (a) uploading or otherwise disseminating any virus, adware, spyware, worm or other malicious code, or (b) interfering with or disrupting any network, equipment, or server connected to or used to provide any part of the Service, or violating any regulation, policy, or procedure of any network, equipment, or server.

Harming Others
You may not post or transmit any Content on or through Our Service that is harmful, offensive, obscene, abusive, invasive of privacy, defamatory, hateful or otherwise discriminatory, false or misleading, or incites an illegal act;

You may not intimidate or harass anyone, including Us, through/from Our Service; and, You may not post or transmit any personally identifiable information about persons under 13 years of age on or through Our Service.

Impersonation or unauthorized access
You may not impersonate another person or entity, or misrepresent your affiliation with a person or entity when using Our Service; You may not use or attempt to use another's account or personal information; and, You may not attempt to gain unauthorized access to Our Service, or the computer systems or networks connected to Our Service, through hacking password mining or any other means.

Engaging in unauthorized use of the Services could lead to civil, criminal, or administrative repercussions, fines, or sanctions for both the user and any accomplices.

By using Our Service, you agree to NOT:

(1) Transmit, upload, post, or otherwise share information or images that are obscene, vulgar, indecent, pornographic, or contain sexual content, animal cruelty, gore, graphic images for sadistic pleasure, or glorification of violence.

(2) Stalk, discredit, vilify, ridicule, harass, mock, threaten, intimidate or abuse anyone.

(3) Transfer, upload, or use (or attempt to transfer, upload, or use) files that contain viruses, worms, Trojan horses, time bombs, cancelbots, corrupted files or data, or any other similar programs or software that may damage, overburden, or impair the operation of Our Service or other users' computers.

(4) Share illustrated, digitally altered, or any form of pornography depicting people of any age.

(5) Share, distribute, or upload content that violates another person's personal, intellectual, or contractual property or other rights, including copyrighted property.

(6) Attempt to obtain, distribute, share passwords or other private information from anyone using Our Service, including Us.

(7) Misuse or abuse support services, feedback, or reporting buttons to make false reports to Us.

(8) Organize, engage in, encourage, join, follow, or participate in any attack or any form of harassment or hate speech towards individuals or groups inside or outside of Our Service.

(9) Abuse any features within Our Service.

(10) Attempt to obtain passwords or other personal information from Us.

(11) Engage in any unlawful activity of any kind on Our Service or in relation to using Our Service.

(12) Assist, attempt, or encourage any violations of this Agreement, rules, or any other policy related to using Our Service.

(13) Use Our Service if you are a convicted sex offender.

(14) Share, distribute, or post anything (including but not limited to: permalinks or links) that direct outside of Our Service to anything harmful, illegal, virus-containing, or otherwise damaging to Our Service or other users.

(15) Employ automated tools, devices, or methods such as robots, spiders, scripts, or software intended to extract, gather, or collect the Content, data, or information from the Services.

(16) Store or preserve the Content, with the sole exception being a public search engine's use of spiders for indexing purposes.

(17) Engage in activities that place an excessive or undue strain on our system or infrastructure.

(18) Utilize Our Content or Service for crafting any software, including training machine learning or AI systems.

These prohibited uses are not meant to describe or mention every example completely, and We reserve the right to determine what conduct is considered to be a violation of the terms, rules, or guidelines, or an improper use of Our Service. If you do not follow the rules and guidelines (listed or not), We have the right to terminate your Account (if applicable) at Our own discretion.

You are solely responsible for your interactions with other users of the Site. We reserve the right, but have no obligation, to monitor or resolve disputes of any kind between you and other users.

You are solely responsible for any information, material, or other content posted on Our Service or otherwise provided to Us (including but not limited to: comments, file uploads, text, messages, feedback, suggestions, etc.). You agree that you and any such content derived from you shall not violate this Agreement and the rights of any third-party, including but not limited to: personality rights, privacy rights, contract rights, trademarks, or copyrights.

We have the right to use, modify, remove, publish, distribute, publicly display, create derivative works of, and transmit anything that you submit, send, store, upload, receive content to or through Our Service, including but not limited to: chat messages, profile icons, usernames, names, feedback, submissions, text, ideas, files (documents, photos, graphics, etc.), and content. You grant Us a nonexclusive, perpetual, world-wide, royalty free sublicense to such submissions.

You may use Our Service only for non-commercial personal use. You agree not to copy, modify, broadcast, display, distribute, reproduce, sell, republish, save, or post anything within, displayed on, or originating from Our Service unless it legally originated from you. You also agree to not use any data gathering methods, including but not limited to, data mining, robots, scripts, or scraping.

Use for non-commercial purposes excludes utilizing the Content or Service to: create any software, including for training machine learning or AI systems; or share cached or stored data collections that include our Content with another individual or organization.

Our Service contains features and applications that are available to various mobile devices. The normal rates and fees for your carrier or internet service provider still apply. We are not responsible for any extra fees attributed to the use of Our Service.

TechReviewer, TechReviewer.com, and other UserDynamics logos, graphics, stickers, page headers, Site graphics, scripts, applications, features, designs, and Service names are trademarks, trade dress, or copyright of UserDynamics.

We are not responsible for any links, affiliated content, or embedded content distributed on Our Service that direct to anywhere outside of Our Service. You are responsible for taking the necessary precautions for anything directing outside of Our Service. We disclaim any responsibility for any harm resulting from your use of anything outside of Our Service.

Third-party services and content are not vetted, endorsed, or controlled by Us. By using any third-party services, you understand that you use them at your own risk, and We are not responsible or liable to anyone for third-party services. Your use is entirely between you and the respective Third-party and will be governed by the third-party's terms and policies, and you will review any third party's data retention, collection, use policies, and practices before visiting them or using their services. If you have concerns or questions about how a third-party service operates, or need support, please contact the third-party directly.

The section headings contained in this Agreement are for reference purposes only and shall not affect the meaning or interpretation of this Agreement.

If any part of the Agreement is held to be invalid or unenforceable by any law or regulation or final determination of a competent court or tribunal, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

Either party's failure to insist on or enforce strict performance of any part of the Agreement will not be construed as a waiver of any provision or right.

The parties agree that no joint venture, partnership, employment, or agency relationship exists between you and UserDynamics as a result of the Agreement or from your use of anything on Our Service.

UserDynamics is committed to responsibly handling the information and data We collect through Our Service in compliance with Our Data Privacy Policy, which is incorporated by reference into this Agreement. Please review Our Data Privacy Policy so you are aware of how We collect and use your personal information.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL USERDYNAMICS BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE OR INCOME, LOST PROFITS, LOSS OF DATA, PAIN AND SUFFERING, EMOTIONAL DISTRESS, COST OF SUBSTITUTE GOODS OR SERVICES, OR SIMILAR DAMAGES SUFFERED OR INCURRED BY YOU OR ANY THIRD-PARTY THAT ARISE IN CONNECTION WITH THE SERVICES (OR THE TERMINATION THEREOF FOR ANY REASON), EVEN IF USERDYNAMICS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, USERDYNAMICS IS NOT RESPONSIBLE OR LIABLE WHATSOEVER IN ANY MANNER FOR ANY CONTENT POSTED ON OR AVAILABLE THROUGH OUR SERVICES (INCLUDING CLAIMS OF INFRINGEMENT RELATING TO THAT CONTENT), FOR YOUR USE OF OUR SERVICE, OR FOR THE CONDUCT OF THIRD PARTIES ON OR THROUGH OUR SERVICE. IN NO EVENT SHALL USERDYNAMICS AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST THREE MONTHS.

Certain jurisdictions do not permit the exclusion of certain warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. IN THESE JURISDICTIONS, THE FOREGOING EXCLUSIONS AND LIMITATIONS WILL BE ENFORCED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of Our Service will be governed by the laws of the State of Washington, U.S.A., excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts located in the State of Washington closest to Vancouver, Washington, U.S.A.

To the extent authorized by law, you agree to indemnify and hold harmless UserDynamics, its employees, officers, directors, affiliates, and agents from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys fees, resulting directly or indirectly from or arising out of (a) your violation of the Agreement, (b) your use of any of Our Service, or (c) the content you make available on any of Our Service.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, USERDYNAMICS OFFERS THE SERVICE (INCLUDING ALL CONTENT AVAILABLE ON OR THROUGH THE SERVICE) AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE SERVICE, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. USERDYNAMICS DOES NOT WARRANT THAT THE FUNCTIONS OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT CONTENT MADE AVAILABLE ON OR THROUGH THE SERVICE WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY SERVERS USED BY USERDYNAMICS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. USERDYNAMICS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF THE CONTENT AVAILABLE THROUGH THE SERVICE IN TERMS OF ACCURACY, RELIABILITY, OR OTHERWISE. YOU UNDERSTAND THAT YOU DOWNLOAD, OR OTHERWISE OBTAIN CONTENT, FROM OUR SERVICE AT YOUR OWN DISCRETION AND RISK. USERDYNAMICS RESERVES THE RIGHT TO MODIFY ANY AND ALL CONTENT CONTAINED IN OUR SERVICE OR APP AT ANY TIME WITHOUT NOTICE.
