RESIDENTS at a Scots holiday park have been ordered to leave their lodges after the company went bust.

Heritage Park Estates (HPE) operates Bendochy Park in Blairgowrie, Perthshire, and has now been put in liquidation.

The firm has been at the centre of a long-running dispute with residents and the local council over its lodges.

The holiday park is located on the former Bendochy poultry farm site, which sits off the A823 heading towards Coupar Angus.

Back in March 2022, bosses were given permission by Perth and Kinross Council to add more lodges to the site.

According to The Courier, the firm was allowed to add a total of 43 lodges and 10 glamping pods.

The local authority said this was on the condition that they would be “used for holiday accommodation only”.

However, it was later found that the owners of the site marketed the lodges as permanent rather than holiday accommodation.

Back in August, the Advertising Standards Agency (ASA) ruled that they had misled locals in the matter.

It led to residents of the holiday park being handed enforcement notices by the council which state they need to leave by December 2026.

But occupants in five of the new homes have appealed the notices and have promised to fight to stay.

According to The Courier, Scottish Tory MSP has also offered his support in the long-running dispute.

But HPE has now appointed liquidators Thomson Cooper after a winding-up order was passed at a recent meeting.

According to The Courier, chair of HPE, Isaac McKenzie, said in a resolution documented at the meeting: “It has been proved to the satisfaction of this meeting that the company cannot, by reason of its liabilities, continue its business and that it is advisable to wind-up same, and accordingly that the company be wound up voluntarily.

“Richard Gardiner, of Thomson Cooper, (is) appointed liquidator of the company for the purposes of the winding-up.”

A spokesperson for Perth and Kinross Council said: “The Council has been made aware that Bendochy Park has been sold to Perthshire Lodge Company Ltd.

What is liquidation?

WHEN you liquidate a company, its assets are used to pay off its debts. Any money left goes to shareholders. You’ll need a validation order to access your company bank account.

If that money has not been shared between the shareholders by the time the company is removed from the register, it will go to the state.

You’ll need to restore your company to claim back money after it’s been removed from the register.

The company will stop doing business and employing people. The company will not exist once it’s been removed (‘struck off’) from the companies register at Companies House.

There are 3 types of liquidation:

  • creditors’ voluntary liquidation - your company cannot pay its debts and you involve your creditors when you liquidate it
  • compulsory liquidation - your company cannot pay its debts and you apply to the courts to liquidate it
  • members’ voluntary liquidation - your company can pay its debts but you want to close it

Your company may be forced into liquidation if it cannot pay its debts.

"The Council’s Trading Standards, Environmental Health and Development Management Teams hope to work with the new owners to resolve the current issues on the site.

“The Council does not have the power to prevent further development on the site provided it is carried out lawfully.

"However, Enforcement Notices have been served on a number of properties requiring that they are not used as permanent residences and this will assist in highlighting to other prospective occupants of the situation.

"Reflective of the sensitivity of the situation a longer compliance period than would normally be the case – until the end of December 2026 – is in place to help support existing residents.

“We will continue to work with all relevant departments and agencies going forward.”

The directors of Bednochy and Heritage Park Estates did not respond for comment when approached by The Courier.
