CONDITIONS OF SALE:
By accessing and using the VIK, LLC website, digitawine.com, you agree to the following terms of service. Use of digitawine.com constitutes your agreement to comply with the terms set forth below.

SALE OF WINE:
Title to and ownership of alcoholic beverages passes from Seller to Buyer in the State of California, and Buyer takes all responsibility for the product being transported from the state of sale to the Buyer's selected destination. Buyer may make independent delivery arrangements. Sales tax will be applied based on California state sales tax. Seller makes no representation as to the legal rights of anyone to deliver or import any alcoholic beverages or other goods into any state. Buyer warrants he or she is solely responsible for the transport of the purchased products and for determining the legality and the tax/duty consequences of bringing the products to the Buyer’s chosen destination.

By placing an order, Buyer authorizes Seller to act on Buyer's behalf in arranging for transportation of the product at Buyer's direction. Alternatively, buyer may make independent shipping arrangements. Terms may be updated as necessary without notice. Your continued use of digitawine.com implies your recognition and acceptance of the most current terms.

Sale of wine to anyone under the age of 21 is strictly prohibited. VIK, LLC will only sell wine to persons aged 21 or older. By entering digitawine.com you affirm you are over the age of 21. VIK, LLC will make every effort to ensure that alcoholic beverages are not delivered to anyone under the age of 21. Use of digitawine.com constitutes your promise that the recipient of all wine deliveries will be over the age of 21 and able to prove their age upon delivery. We will prosecute misrepresentation of age to the full extent allowed by law. Resale of wine obtained on digitawine.com is prohibited. 

VIK LLC reserves the right to hold shipment of your wine during extreme weather conditions.

VIK LLC cannot be responsible for damage to wine (including leakage or damaged corks) delivered to you against our express protestations in regards to weather conditions. Please be aware of the scheduled deliver information, as the date, and location of your delivery cannot be changed once it leaves our warehouse. It is your responsibility to be present when your order arrives.

VIK LLC cannot be responsible for wine damaged by a shipper or inappropriate storage/handling on the part of the shipper. We reserve the right to refuse sales if we deem it to be inappropriate and/or unsafe.


REGISTRATION:
The registration of the customer to the site is a mandatory condition to purchase. To register, the customer must fill in their basic information including: full name, billing address, delivery address, email, telephone number. This data will be considered confidential. The registration of the customer on the site implies knowledge and acceptance of the terms and conditions included here. Once a transaction is completed, the user may request the suspension of any promotional communication sent to their email.

PASSWORD:
Once registered, the client must enter their password to make a purchase, which will allow personalized, confidential and secure access. The administration of their password is their responsibility. Giving the login information to third parties or the use of login information by such third parties shall not imply any
liability for digitawine.com. The user will have the ability to change the password subject to the procedure established in the respective site.


PAYMENT AND CONSENT:
Customer may use all forms of payment indicated on the website. Customer will be subject to the existing contract between the client and the issuing bank. VIK, LLC assumes no responsibility for any aspects of these contracts. For legal purposes, the offering company is an independent third party in this customer and issuing bank relationship.
Any offer acceptance will be subject to the condition precedent that VIK, LLC confirms or validates the transaction. Consequently, for any operation carried out on this site, confirmation and / or validation or verification by VIK, LLC will be a requirement for the formation of consent. To validate the transaction, the site must verify: A) That it has, at the time of acceptance of the offer, the products in stock. B) Validate and accept the means of payment offered by the user. C) Confirm that the data registered by the customer on the site matches that provided when making their offer acceptance. D) Confirm that the place or address indicated by the client is accessible by regular delivery means. In order to inform the user or consumer about this validation, the site will send a written confirmation to the same email address that the user has registered accepting the offer. The VIK, LLC team reserves the right to communicate their inability to fulfill an order after the aforementioned confirmation. Any inability to fulfill an order will entitle the customer to a refund for the portion of the order that can’t be fulfilled.
