Sanjiv Bhatt (Template:Lang-hi) is an Indian Police Service officer in Gujarat. He is known for his role in filing an affidavit in Supreme Court of India against the Chief Minister Narendra Modi about his alleged role in the 2002 Gujarat riots.[1]
2002 Gujarat riots
Sanjiv Bhatt filed an affidavit with the Supreme Court in April 2011 claiming that in the course of performing his duties he had seen intelligence information relating to the events leading up to and during the Gujarat riots of 2002. He alleged that certain high-ranking officials had abused their position.[citation needed] Soon after, Bhatt was arrested and a few days later was bailed.[2]
Subsequently, Bhatt provided details to the National Commission for Minorities and to the Special Investigation Team that had been appointed by the Supreme Court to examine the events. He also shared the information with the special commission set up by the state government of Gujarat for the same purpose, and which is known as the Nanavati-Mehta Commission. His information included documents that allegedly provided evidence of police inaction and administrative failures orchestrated by the then Chief Minister, Narendra Modi. In addition, Bhatt produced details relating to the murder of Haren Pandya and which also implicated the Modi government.
He is gaining on legal grounds too as many fabricated cases against him are being quashed.[3][4]
Nanavati-Mehta Commission
The Nanavati-Mehta Commission called Bhatt as a witness during its investigation of the events. They heard Bhatt repeat the allegations that he had previously made in his affidavit, that Modi had asked officials to be "indifferent" towards rioters during the violence that had ensued in 2002 following the Godhra train burning.[5] Bhatt had written to the Director General of Police, and also the Additional Director General of Police who had responsibility for the State Intelligence Bureau, for documents and information prior to attending the Commission hearing but was denied the information.[6] Hand by hand describing Modi as “dramatis personae” of Gujarat carnage, in a letter to the Nanavati commission in last week of December, 2011, Bhatt had sought directions to the DGP, ADGP state intelligence bureau and the chairman of Special Investigation Team (SIT) that he be provided with access to certain records of post-Godhra riot period and the statements made by him before SIT. He said that those documents are needed for filing a comprehensive affidavit. Bhatt also alleged that some of the most important documents which could make clear the roles of Modi and others have not been brought before the Commission.[7] He has also produced a copy of fax message purportedly sent by him on February 27, 2002 immediately after the meeting held by chief minister Narendra Modi at his residence. The message said to have alerted police about an anticipated communal violence in the state soon after the Godhra train carnage. Bhatt has annexed the fax message in a letter to the SC-appointed SIT, headed by Dr RK Raghavan, and state-appointed Nanavati Commission, reiterating his demand for access to the state IB records of 2002.[8][9]
As Nanavati Panel declined to direct Government authorities to produce relevant documents of Godhra riots, Bhatt has written a letter to the panel insisting that a judicial inquiry commission enjoys the powers of a civil court and can call for production of any document or requisition any public record as per Section 4 of the Commissions of Inquiry Act, 1952.[10][11] He has once again asked the probe panel for SIB records so that he can file a comprehensive affidavit on Ms. Mallikha Sarabhai claim of misuse of Government fund to derail a PIL by her against Modi.[12] Bhatt has once again written to the Nanavati Mehta panel seeking state intelligence and police records, documents and log books pertaining to Godhra riots as he thought the remaining records too may be destroyed by the Government.It is to be noted that Bhatt has been requesting for such crucial and incriminating records for the past eight months and the probe panel is not giving responding due to one or other inexplicable reasons known to them only.[13][14][15]
In his interview to India’s leading and reputed magazine "Frontline" he said that he doesn’t believe neither SIT chairman Raghavan or his team[16] He also claimed before the panel that Modi was wantonly giving misleading answers and unfortunately the investigation officer didn’t contradict him with all evidences that were available at his disposal.[17] Bhatt has suggested that the Nanavati panel should submit its final report to the state governor. Even he went on to add the first report which was earlier submitted to the state government should be recalled and handed over to Gujarat governor, as role of Gujarat chief minister is covered by the terms of reference of the enquiry.he said that in consonance with principle of natural justice that no person shall be a judge in his own cause, the yet-to-be submitted second report of the Commission may also be presented to the Governor and not the Chief Minister." [18][19][20]
Arrest and reactions
Bhatt was arrested on September 30, 2011 on allegations of forcing a constable, K D Pant, to file a false affidavit against Narendra Modi.[21][22] Noted advocate and Bhatt’s lawyer I.H.Syed alleged that Bhatt’s arrest was at the backdrop of his affidavit on Shri. Haren Pandya’s mysterious murder in Gujarat HC. He said that Bhatt is an important witness in the Haren Pandya murder case and knows a lot about what really happened”.[23] He was subsequently released on bail on October 17, 2011.[24][25] His family alleged harassment while he was in jail. His wife Shweta Bhatt wrote two letters to Indian Home Ministry requesting protection to him. As a response to letters dashed off to Central Govt, it has intervened and requested the Gujarat Govt to provide adequate security to Bhatt and his family. The Ministry of Home affairs was also about to assess the threat perception to Bhatt interpedently whose outcome in unknown yet.[26][27][28] Bhatt’s arrest evoked a sharp response from various quarters among people of India. Protests were held at Ahmedabad, Delhi & Bangalore[29][30][31] and Mahesh Bhatt a well known film producer described Bhatt as “real time hero.[32] At the time of his arrest Gujarat IPS officers association backed Bhatt by passing a resolution in favor of him. Former Gujarat DGP R.N.Bhattacharya described Bhatt as an upright and reliable officer.[33] Reputed social activist Shri. Anna Hazare too flayed his arrest by saying “What Narendra Modi done was wrong”.[34][35][36]
After his bail Ram vilas Paswan of Lok Janshakthi party met Bhatt at his residence to express his solidarity. After that meeting, he said that "Those who believe in democracy and those who want the rule of law to prevail will be proud of Bhatt’.He also alleged that Bhatt was being victimized on direct orders of Modi only, as he exposed his role in Gujarat riots 2002.[37] People organized candle march at Ahmedabad to support Bhatt).[38] At the time of arrest R.B.Sreekumar, Ex DGP of Gujarat police and his former boss alleged that Bhatt was treated like terrorist and even he was not allowed to meet him in jail.[39][40] During the bail plea hearing that followed his arrest,Bhatt ruled out any compromise with the Gujarat government after a local court proposed that if he went on police remand for about three hours his bail plea could be heard today itself.[41][42][43] Meanwhile eminent SC lawyer and former law minister of India Shri. Shanti Bhushan expressed his willingness to defend Bhatt in SC as he was opposed to communalism.[44] It should be noted that Bhatt had refused to receive “Maulana Mohammad Ali Jauhar award” at Islamic cultural centre as another recipient was Jagdish tytler who is allegedly carried out Anti sikh riots of 1984 in some parts of India which reflected Bhatt's secular and non communal mindset.[45] After released from bail he described Modi as common criminal and he should be treated like one.[46]
Supreme court
The Supreme Court of India has requested the Amicus curiae Raju Ramachandran, friend of SC on 5 May 2011 to present an independent assessment along with the final report of SIT which had recorded Bhatt’s statements related the Gujarat riots.[47][48] The SIT had rejected Bhatt’s statements by describing him as unreliable witness whereas the Amicus curiae felt Bhatt’s statement are trustworthy and can’t be neglected for the reasons mentioned by SIT.[49][50] The main bone of contention was about the presence of Sanjiv Bhatt in a meeting with Narendra Modi, CM of Gujarat on 27 Feb,2002 in which he allegedly said “The Hindus should be allowed to vent their anger.The amicus of SC listed few reasons to believe that Bhatt was present in that meeting.”.[51][52] Mean while a former journalist of BBC Shubhranshu Choudhary filed an affidavit in SC which substantiated claims of Bhatt on his presence in the 27 February 2002 meeting held by Gujarat CM,Narendra Modi.[53][54] In addition to that India’s reputed news paper “The Hindu” presented another angle of Bhatt claims which explored Bhatt’s email exchanges with Shubhranshu Choudhary and the call records of Bhatt with Choudhary on the same day.[55][56] In addition to that Bhatt’s claim of his presence in Modi’s meeting held on 27 February 2002 was backed by his driver Tara chand Yadav.[57][58] Bhatt filed a PIL (Public interest Litigation) in SC for an independent agency to investigate Gujarat riots or to transfer the case outside Gujarat.[59] Bhatt also complained that his mails have been hacked and filed a complaint in the “economic offences wing” against Gujarat administrative machinery for the same.[60] He also filed a case on alleged leakage of emails from SIT to Gujarat government and various people which is pending before the SC.[61][62]
Bhatt vs SIT
Bhatt leveled many allegations on SIT which was constituted by SC of India to enquire into complaints of petitioner Ms. Zakia Jafri, whose husband Eshan Jafri, was killed in 2002 riots. In his affidavit filed in SC, he questioned SIT impartiality.[63] following which there was a call from social activists for R.K.Raghavan to quit as SIT chief.[64][65] Sanjiv alleged that SIT is reluctant to examine key witnesses[66][67] and biased.[68][69] In August 2011, Sanjiv Bhatt made a startling revelation about SIT that emails were leaked to the defense lawyers of rioters from SIT itself which was constituted to investigate and prosecute the rioters[70][71] and approached the SC for the same.In December 2011, he had written a letter to SIT to record his testimony before a magistrate under Section 164 of the CrPC since he feared “distortion” of his earlier recorded statements on the riots.[72] Bhatt requested for enhanced security with nodal officer and a bullet proof car following the brutal murder of a witness of naroda patiya massacre despite protection from SIT. But that call too didn’t receive any response from SIT.[73] In his letter on first week of January, 2012, Bhatt had requested SIT chief to ensure a noticeably fair probe into Ms.Zakia’s complaint.[74] In latest interesting development the SIT which once neglected Bhatt, has demanded the original copy of the fax message,[75][76][77] which according to Bhatt an indomitable evidence to substantiate his presence in Modi's meeting of 27Feb 2002.Bhatt, in his reply to the SIB original submittal request, wrote to SIT chief R K Raghavan yesterday that the notice was "outrageously shocking" as he had already submitted them to SIT member A K Malhotra in 2009 and later to Shukla in 2011.[78] Bhatt has insisted that SIT should prosecute Modi for his complicity in riots. In his letter to SIT chief R.K.Raghavan in this regard he suggested that Modi would be liable to be charged under sections 109, 112, 115, 117, 118 and 119 of the Indian Penal Code (IPC),1860.[79]
Bhatt has produced evidence of police inaction to SIT chairman along with a letter which had details of deployment of police, SRP and RAF in the state, areas under curfew, types of crimes committed during the riots, etc. In that letter he also alleged delayed deployment of army. He insisted that those documents were intended for the sole purpose of ensuring that crucial evidence is not disregarded or concealed by the SIT with a view to screen powerful and influential offenders from legal punishment".[80] It is pathetic to know despite series of letters from Bhatt on Modi’s role in Godhra riots the SC mandated SIT yet to verify of Bhatt’s explosive claim that he was present in the meeting of CM Modi on 27 Feb, 2002. Till date it hasn’t questioned any one from State intelligence Bureau(SIB) to cross check and confirm Bhatt’s claim.[81] Bhatt in a letter written to SIT alleged that the probe team didn’t exhume the bodies from well of Naroday Patiya despite strong evidences catered by him to support his claim. He also complained that Ahmedabad police commissioner P.C.Pande was alerted on the same. Bhatt many times requested the SIT to register his statements in front of magistrate but not heeded at all by the SIT.[82][83][84] Sanjiv Bhatt accused SIT of destroying evidence in collusion with Gujarat Govt.[85][86][87][88][89] In his speech at the conference organized by Harmony foundation to mark the tenth years of Godhra riots in 27 February 2012,Bhatt has stated that there is enough evidence available with SIT as well as Nanavati panel to nail Modi. Once again taking a dig at the integrity of SIT he charged the SIT for incomplete filing of report that raised doubts about SIT’s willingness to deliver justice to riot victims.[90] Bhatt has contradicted Modi’s statement that Modi was unaware of what was happening in Gulbarg society. With reference to the leaked version of Modi’s statement before SIT, Bhatt said that he had two meetings with Modi and informed him about happenings of Gulbarg society including the grave threat to Ehsan Jafri.In a letter wriiten to SIT chairman Raghavan in this regard,Bhatt said “The devious fraudulence and chicanery resorted to in the answering of questions put to him by the SIT as well as the inadequacy of the questioning itself become evident”.[91]
Murder of Haren Pandya
Haren Pandya was minister of state of Gujarat at the time of Gujarat riots and murdered in 2003.[92] It is alleged that Bhatt and Pandya knew what transpired in the meeting of 27 Feb,2002 held at CM Narendra Modi’s home. Amidst of lot of controversies and theories surrounding his death,[93][94] Bhatt claimed he was killed by Tulisram Prajapati who was killed in a fake encounter later by Gujarat police.[95] Bhatt has also revealed that Amit Shah who was then home minister of Gujarat requested him to destroy evidence pertaining to Haren Pandya’s murder[96][97] .He also filed an affidavit in Gujarat HC in which he hinted possible involvement of Gujarat CM Modi and his home minister Amit Shah.[98] Bhatt recently claimed that a letter written by Agsar Ali of India (who was acquitted in Haren Pandya’s murder case) to President of India is the key as the letter names Tulisram Prajapati as killer of Pandya.[99] Relying on the intelligence inputs from Bhatt the widow of Shri. Haren Pandya, Ms. Jagruti Pandya moved the Gujarat HC for a fresh probe and the HC directed the CBI and the Gujarat government to file response by 6 Feb, 2012 which is the next hearing date for the case.[100]
Other news and Updates on Bhatt
In January 2012, the Gujarat High court stayed all proceedings against Bhatt in connection with the complaint by Ghatlodia police for furnishing false information and evading summons which is being considered as a big relief to him in his legal battle.[101][102][103]
Bhatt has complained to the Gujarat Govt that DGP Chitranjan Singh and other senior cops are trying to dispossess him of his service weapon and jeopardize his security with ulterior motive. This was in response to a letter by Chitaranjan Singh to Bhatt to hand over his revolver which he had at the time of his suspension.He also reminded the DGP about the state Government’s assurance to the SC on his and his family security.He also expressed his displeasure over the present security being provided to him. Bhatt also reiterated his earlier demand of bullet proof car.[104][105][106][107]
Bhatt’s allegation on inaction of police officers upon instruction from CM.Narendra Modi was also supported by Mr.K.S.Subramanian who was a member of fact finding team led by former SC Justice Mr.V.R.Krishna Iyer.His conclusion was the outcome of his interaction with former Gujarat police chief Chakravarthy and Mr.P.C.Pande who was then Ahmedabad police commissioner.[108][109] He has written his twenty fifth letter to Nanavati commission on 14 February 2012 for insisting his security.[110] Bhatt has slammed the State Govt for not providing enough security to him. He said that if the state is not performing its duties, then it is our responsibility to put things on the record. We need to remind the state of its duties. Regarding the alleged clean chit given by the SIT to Narendra Modi he said that “the people of the country know whether a clean chit should be given or not, what role was played by whom. This has not been hidden from anyone and the deal is how to get all the facts on record and wait for what the court decides, but the truth is not hidden from anyone, neither in Gujarat nor the entire country.[111][112][113]
A former judge who was a member of fact finding committee revealed that Haren Pandya told about the meeting held by the CM Narendra Modi. Also they were told by Haren Pandya that Modi instructed the police officers to give a free hand to the rioters which was also said on record by Bhatt in his affidavit to SC.[114] Bhatt has written a letter to Gujarat HC advocate Somnath Vatsa on 23 February 2012, to provide documentary evidence related to Godhra riots. In that letter he had directed Vatsa to approach Raghavan to obtain relevant data on Godhra riots or to obtain a judicial order from a competent court which may direct Raghavan to provide the same.[115] Bhatt withdrew petition from SC seeking stay on criminal proceedings against him in a 1990 incident of alleged police atrocity that resulted in the death of one person. Earlier he had approached the SC against Gujarat HC order which refused to stay in the case.[116] In his interview to India’s leading and reputed magazine "Frontline" Bhatt said that the fake encounters of the Gujarat state exposed the mask of Mr.Modi.Bhatt also termed the praising Modi by corporate houses as unfortunate.[117] While addressing a gathering at a 'Citizen's convention' at Mehndi Navaz Jung hall in Juhapura Bhatt said that a state of anarchy prevails in the state and there is a tremendous need to raise our voices against the injustice.[118]
In February 2012, Bhatt averred that Godhra riots was a preplanned one by politicians with help of some criminal elements and it could have been avoided had some politicians took initiatives[119]
The high court of Gujarat has quashed against Bhatt in which the complainant ACP N.C. Patel alleged Bhatt has furnished false information in a case related to K.D.Panth and avoided repeated summons. While passing order to quash the case Justice M R Shah observed that the registration of complaint was abuse of the process of law by the government.[120][121]
Bhatt has reiterated that Modi is a common criminal in a TV live interview.[122] Bhatt has smelt a hidden agenda behind his transfer from Intelligence bureau days before gruesome Akshardam attack. Responding to a question over his silence since 2002 over riots, he said that he was maintaining, recording and documenting all the information procured by him and his team during that time. He also lamented that the Gujarat state has moved from being the ‘Gujarat of Gandhi’ to the ‘Gujarat of Godse.[123] In another such function held at St Xaviers college of South Mumbai Bhatt criticized Modi by saying the democracy is being killed in the state under his rule. He also described the battle to get justice for riot victims as the fight for soul of India. Taking potshots at Modi,Bhatt said “Whenever anyone questions about riots, Modi says fingers are being pointed at Gujarat whereas the questions are not raised at Gujarat but at Modi, his politics and his political party.[124] In one more convention to mark the 10th anniversary of Godhra riots in which 200 riot victims and scores of human right activists including Shri.J.S.Verma (Former CJI of SC cum NHRC chairman) and political leaders participated Bhatt said that he is unable to see any justice for the victims of riots. He also added that “It is a matter of shame for the Gujarat police and the administration and the State is rushing towards fascism and any form of dissent is being crushed...the people in Gujarat have built a wall of silence where nobody speaks because they are too scared of the consequences”.[125] Bhatt was issued summon by National Commission of Minorities along with other retired and serving police officers of Gujarat to testify the role of Modi to bring out the truth of 27 February 2002 meeting which held at Mr.Modi’s home. The summon was issued to Bhatt on the basis of a complaint filed by Ms. Niyazbibi Malek a riot victim in National Commission of Minorities.[126][127][128] Giving due respect to the summon issues by NCM Bhatt deposed and his statement was recorded. Without elaborating much on his appearance Bhatt said “I have told the commission certain things and also moved an application for access to certain documents related to the happenings and police responses in 2002 from the state government".[129][130][131][132][133]
Bhatt got relief from Gujarat HC in a 1990 atrocity case in March 2012. Bhatt moved to the HC after a local court in Jamnagar rejected his plea for condonation of delay in filliping the revision petition. While ruling this verdict Justice Anant.S.Dave said the lower court must hear and decide the revision petition filed by Bhatt within six weeks.[134][135] In the same case the SC also ruled in favor of Bhatt. The apex court bench ruled that it oppose the hearing of the petition as the copy of Gujarat HC on same case was not available.[136][137] Bhatt has criticized the Nanavati panel for exonerating Modi in Godhra riots. He described this move of Nanavati panel as “Clear overreach”. In his submission before the probe panel, he said, "It has come to my knowledge that the Commission, during the submission of its interim report, had by way of a clear overreach of the mandate, as provided under the original terms of reference, went on to exonerate the Chief Minister." He also added that it is respectfully stated that this opinion of the Commission, way back in 2009, on an application submitted in the year 2007, was not only unwarranted but patently premature and in disregard of the material already having come on record of the Commission.[138][139] Bhatt insisted the Nanavati panel to examine Modi on the basis of allegations made by Amarsinh Chaudhary, a former Gujarat Chief Minister.
He has sent a letter to the panel along with the affidavit copy of Amarsinh Chaudharay stating that the affidavit(of former CM) clearly delineates the deliberate inaction on the part of Chief Minister Narendra Modi during the Gujarat Carnage of 2002 in general and the Gulbarg society massacre in particular. He claimed that Chaudharay made serious allegations against Modi in his affidavit and he had also a meeting with Modi along with leader of opposition Naresh Rawal on 28 February 2008 in which he said to have appraised Modi of grave threat to Ehsan Jafri and got no positive response from the former.[140][141][142][143][144][145] Bhatt got a relief from the honorable SC of India in a case that alleges Bhatt coerced a constable Mr.K.D.Pant to testify against Mr.Modi. It is to be noted that he was released on bail in lower court too earlier.[146][147][148][149][150][151][152][153][154][155][156][157][158][159]
Ajay Devgan has said that Bhatt is doing a great job.[160] Bhatt has contacted Pratiba Patil, the Indian President, and sought a probe against Gujarat CM Narendra Modi. He has requested the centre to appoint two member commission to enquire the role and conduct of Mr.Modi, his officials and police officers in the gruesome massacre of Godhra. He also demanded an investigation into the government’s measures on the rehabilitation for victims.[161][162][163][164][165][166][167] One mysterious case of custodial torture was registered against Bhatt in a 21 year old incident in which the intention of the complainant and his two decade long silence were suspicious.[168][169][170][171] However, in the first week of May 2012, the Gujarat HC stayed the proceedings against Bhatt in that particular case.The complainant alleged that Bhatt was beaten him in his custody that led to one of his kidneys failure. Bhatt defended his position by arguing that when the complainant was produced before the court on January 25, 1990 after his arrest, he did not make any such complaint about mistreatment, and was released on bail. Also Bhatt pointed that he complainant did not act for more than 21 years after filing his complaint in January 1991.[172][173][174][175]The first ever official report on the Gulbarg society massacre by SC appointed SIT and the independent assessment on the same by senior eminent lawyer cum amicus curiae Raju Ramachandran was made available to public on 15 May 2012.
Even though the report of SIT neglected the importance of Bhatt, the Amicus pointed that Bhatt is indispensable evidence and his statements should be given much consideration. He contended that it does not appear very likely that a serving police officer like Bhatt would make such a serious allegation against Shri Modi, the Chief Minister of the State, without some basis. The Amicus also strongly disagreed with the SIT on the presence of Bhatt on the controversial meeting held at CM’S home held at 27 February 2002. He was also critical of SIT decision to disbelieve Bhatt based on those persons who were found unreliable by the same SIT. In this regard he averred that although the SIT, as the investigating agency, has taken a view, the question whether Shri Bhatt was present at the meeting on 27.02.2002 and whether Shri Modi had indeed made such a statement (as spoken to by Shri Bhatt) can only be decided by a court of law. It would not be correct to disbelieve the version of Shri Bhatt, at this prima facie stage, on the various grounds set out by the SIT or because other participants in the meeting have denied (either categorically, or to the best of their memory) his presence and the alleged statement made by Shri Modi. If Shri Bhatt stands the test of cross-examination, then regardless of the fact that other witnesses have not supported his statement, a court of law may return a finding that Shri Bhatt indeed was present at the meeting on 27.02.2002, and that Shri Modi did make a statement as is being alleged by Shri Bhatt.[176][177][178][179][180][181][182][183]
After the official release of the Amicus curiae’s report Bhatt’s reputation was catapulted to a new high and the leading newspaper of India, the times of India described Bhatt as pivot in the case.(against Modi). To a question posed by the journalist of the same newspaper he said “There is no doubt in my mind that the SIT has been trying to disregard and suppress evidence that could be detrimental to Narendra Modi and certain other powerful accused persons. This was brought out in my affidavit before the Supreme Court on April 14, 2011. The SIT, as expected, submitted the proposed 'Closure Report' to the Supreme Court on April 24, 2011. The Supreme Court, on May 5, 2011, thought it fit, inter alia, to direct the learned amicus curiae to examine and analyze the said report and submit his comments thereon. The very fact that the Supreme Court was constrained to take the unusual step of issuing the above directions to amicus curiae speaks volumes about the credibility of the investigation and the so-called 'Closure Report' filed by the SIT. On the perceived pressure from every sphere for his powerful testimony against Modi,Bhatt said “ I do not feel any pressure at all. In fact, I feel more responsible and resolute to discharge the duty cast upon me as an officer of Indian police service, to the best of my ability and expose the subversion that led to the despicable events of 2002, in order to ensure that the guilty are brought to book and the Gujarat carnage of 2002 is never repeated anywhere in this country [184]After the official release of SIT’s report on Gulbarg massacre Bhatt has lashed out the SIT for it’s efforts to shield Mr.Modi who is accused No 1 in the charge sheet filed by Ms.Zakia Jafri.[185][186][187] Besides his deposition before NCM, Bhatt has filed an affidavit in National Commission of Minorities (NCM).In his affidavit Bhatt has asked the rights panel to initiate action against the Special Investigation Team (SIT) headed by R K Raghavan for incorrectly recording his statements or tweaking them to give a clean chit to Chief Minister Narendra Modi. He also charged The SIT by saying it has committed offences
under Section 218 (public servant framing incorrect record or writing with intent to save person from punishment or property from forfeiture) and 219 (public servant in judicial proceeding corruptly making report, etc.,contrary to law) of the Indian penal Code.
He also alleged that certain very crucial portions of his statement, including the timings of extremely consequential meetings with the chief minister Mr.Narendra Modi on February 27 & February 28, 2002, have either been incorrectly recorded or deliberately tweaked by the SIT, possibly with the ulterior motive and intent of shielding certain powerful persons including the chief minister from legal punishment.[188][189]
