Files in Category:Pont du Bras de la Plaine
[edit]In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in France.

Looking at the source, this appeas to be a screenshot of a render of a 3d model from sketchfab. I don't see a valid free license at source, and this isn't claimed as own work, so this should probably be deleted as a derivative work of a non-free work. — Red-tailed hawk (nest) 04:30, 16 July 2023 (UTC)

Unfree sculptural work. Per w:ru:Памятник Героям-Североморцам, защитникам Заполярья, the work was erected in public in 1973, with the sculptors w:ru:Нерода, Георгий Васильевич (died 1983) and Нерода, Юрий Георгиевич as authors of the statue itself. Russia does not provide commercial freedom of panorama for copyrighted monuments and sculptures in public places. The nominated photos show the work in a non-de minimis or non-incidental manner.

Unfree sculpture, see Commons:Deletion requests/Files in Category:Monument to the Heroes of Severomorsk for authorship details. Note the file name was previously occupied by a photo that was deleted by a former admin in circa 2009 because of same, "no freedom of panorama in Russia" reason. Stamps of Germany are copyrighted until 70 years after the death of the designer. In this case the designer, Hans Detlefsen, died in 1992. So the image is copyrighted until at least 2063, if not later due to the URAA. Although I'll leave that up to the closing administrator. The same goes for the following files:
- File:Stamps of Germany (DDR) 1979, MiNr 2446.jpg
- File:Stamps of Germany (DDR) 1973, MiNr 1833.jpg
- File:Stamps of Germany (DDR) 1973, MiNr 1832.jpg

- Question Can your reference a matching discussion? COM:CHAR is not applicable here, because the stamp is unquestionably PD in the source country. We also keep murals of copyrighted artwork when the source country has freedom of panorama. PaterMcFly (talk) 12:28, 26 July 2023 (UTC)
- There's been plenty of DRs for similar images over the years where the files were deleted. Otherwise I wouldn't have nominated these ones for deletion. If you want some examples there's Commons:Deletion requests/Files in Category:Disney characters on stamps and Commons:Deletion requests/Azerbaijan World Chess Championship set. There's also this under "Disney characters" where someone asked about the copyright status stamps containing images of Disney character and I suggested deleting them, which no one objected to at the time.
- I don't really feel like getting down in the weeds about the law or whatever, but at least IMO the difference between stamps and murals of supposedly otherwise copyrighted artwork (I say supposedly because there's zero evidence that copyrighted artwork is covered by FOP. See COM:POSTER as one example) covered by freedom of panorama is that the whole point in FOP is that the work is created under a free license to begin with, which the artist knows about and consents to when creating the work. That doesn't apply to stamps of otherwise copyrighted characters though. Disney didn't create Mickey Mouse under the guise that the character would be become public domain if it was put on a stamp and there's zero evidence that them allowing it to be placed on one modifies the copyright status of the character. In fact, there's no reason it would. Just like if I were to write a book about Disney characters and release it under a PD license that wouldn't mean the original characters are no in the public domain. That's not how copyright works. --Adamant1 (talk) 01:12, 27 July 2023 (UTC)
- which the artist knows: Not necessarily. If I draw Mickey Mouse on a public wall in Germany, I might have infringet on Disneys copyright, but to my understanding, a photograph of it is still covered by FOP and hence free to use. IIRC, Mickey will enter PD next year anyway. PaterMcFly (talk) 06:29, 27 July 2023 (UTC)
- Technically currect, but totally pointless in this case since it doesn't matter what license the person who took the photograph releases it under if what's depicated in the image is based on a copyrighted work. And maybe Mickey will be PD next year, but then there's reason the image can't just be undeleted if or when that happens either. In the meantime these are exactly the type of things the precautionary principle exists for and I don't really see any reason not to just delete the files until the character is actually in the public domain. --Adamant1 (talk) 15:56, 27 July 2023 (UTC)
- I don't understand your logic here. If stamps of Azerbaijan are by definition PD then a picture of them is very similar to a picture of a painting of a wall. FOP just means that the copyright of the artwork is irrelevant for the picture to be distributable by the photographer for any purpose. PaterMcFly (talk) 06:34, 28 July 2023 (UTC)
- If stamps of Azerbaijan are by definition PD then a picture of them is very similar to a picture of a painting of a wall. Not really. That's why specific laws exist for freedom of panorama in the first place. Otherwise laws having to do with images taken in public places would just be under the existing ones covering public domain in general. Freedom of panorama is the legal right in some countries to publish pictures of artworks, sculptures, paintings, buildings or monuments that are in public spaces, even when they are still under copyright. Where as public domain has to do with creative materials that are not protected by copyright. In this case we know Micky Mouse is copyrighted and there's zero evidence the copyright is null and void just because Albania decided to print a stock image of the character on a stamp. Otherwise be my guest and provide a source to where Disney allowed Micky Mouse to be printed on these stamps and/or otherwise granted reuse rights of the character. --Adamant1 (talk) 06:55, 28 July 2023 (UTC)

In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Kazakhstan.

A synth and OR related map that does not adequately represent what the Iran–Saudi Arabia proxy conflict is about. WikiCleanerMan (talk) 19:36, 10 August 2021 (UTC)
- What is wrong with this map? How can it be put right? Andy Dingley (talk) 22:23, 2 November 2021 (UTC)
- There is no putting it right. The map alleges some countries are involved directly in this conflict like Germany, the UK, and the many African countries in blue. They are not. The only map that is right is the one already used on the article in the infobox. --WikiCleanerMan (talk) 13:44, 3 November 2021 (UTC)
- So the UK is supplying munitions to Saudi Arabia, is withholding £400 million that the UK agrees they owe to Iran, and UK citizens are being imprisoned in Iran as pawns in this, but you say that's "not involved"? Also, maybe try reading the infobox you cite (UK is third on the list) and also the titles for the images (they're not images of the same subject). Andy Dingley (talk) 14:11, 3 November 2021 (UTC)
- I checked the sources on the UK. That's synth and OR. None of the sources actually tie into the proxy conflict. --WikiCleanerMan (talk) 18:00, 3 November 2021 (UTC)

This file was initially tagged by 70.68.168.129 as Copyvio (Copyvio) and the most recent rationale was: Per https://www2.gov.bc.ca/gov/content/governments/celebrating-british-columbia/symbols-of-bc#flag, this flag is protected via Crown copyright.. Perhaps, but the source gives the flag's publication date as 1960, and COM:CANADA indicates that crown copyright lasts only 50 years post-publication (i.e. 2010). This may cause potential URAA issues, but that's a DR issue rather than a speedy deletion issue. — Red-tailed hawk (nest) 17:42, 16 July 2023 (UTC)
- I'm also going to note that source information has been radically changed over time; there may well be a past version of this that is re-created only by looking at the statutory text description of the flag, which would be perfectly acceptable. — Red-tailed hawk (nest) 17:48, 16 July 2023 (UTC)

- You think a photo of Boris Johnson standing by himself and a photo of him shaking Bolsonaro's hand are not educationally distinct? As for the painting, let's have a ruling from the closing admin on whether it's de minimis. -- Ikan Kekek (talk) 21:13, 16 July 2023 (UTC)
- They are not "Educationally distinct." The example photo is different. However, what additional educational value to Commons exists in this (now cropped) file of Mr. Johnson?
- When comparing both photos- he is facing the same direction, toward the same wall, in the same room, on the same day, at the same hour. We have hundreds of photos of Mr. Johnson. One more photo of "mediocre quality" is "not realistically useful for an educational purpose" per (Commons:Project scope#Examples).

Unfortunately there is no applicable FOP exception in Morocco.

- Per ar:رياض_الصالحين, the book is from ~1200 AD, and its text is unambiguously free of copyright (and is on Wikisource as ar:s:رياض_الصالحين). But that still leaves the copyright status of this decorative cover in question. Omphalographer (talk) 18:34, 17 August 2024 (UTC)

Most likely a copyright violation. No metadata. Low resolution but otherwise it is a good quality photo, not everyone could take it. Date says "3 September 2010, 17:43:43" but description says 2002, most likely it was taken at the Ferrari Maserati Festival At Brands Hatch (compare it with this photo). This photo can be found in many websites, but since it was uploaded on Commons in 2013 it's diffult to find the source, it may not be online anymore. If this is deleted File:Jjcaleericclapton.jpg should also be deleted as a derivative work. Unclear free license status. This is an import from English Wikipedia, first uploaded there in 2006, and claimed to be sourced from http://www.facstaff.bucknell.edu/marsh/lewisburg_tour/thumbnails/prison_jpg.jpg. Through extensive research over Wayback Machine, I found this page that uses the said photo (full resolution photo is here). But the said page (as well as the main page) do not contain any statement of either copyright statement or free license declaration. Further research on Wayback Machine, visiting the home site of the Bucknell University faculty (which hosted the Lewisburg Tour webpages) redirects me to this site, which has a copyright statement ("© Bucknell University All Rights Reserved"). Therefore, the commercial CC license claim on this file is dubious at the very least. JWilz12345 (Talk|Contrib's.) 02:56, 16 July 2023 (UTC)

- +1, and also more an image of an engineering work, not architecture. PaterMcFly (talk) 17:20, 17 July 2023 (UTC)
- Oppose This aspect of copyright law is clearly about works of art. If a bridge is primarily a work of art, why not a house, a car, or a tractor, which all have creative designers who care about their appearances? But with works of engineering, such as bridges, the design is driven almost entirely by the engineering options, and not by art. There is far less room for artistic creativity than with buildings and vehicles. So I would suggest that deletion requests like this ought to be driven only by copyright holders defending their copyrights, and not by a general approach which errs massively on the side of caution. Moonraker (talk) 03:08, 20 July 2023 (UTC)
- +1 as above, first deletion request! --Хрюша ?? 10:02, 21 July 2023 (UTC)
- Delete, French bridges are subject to their designers' copyright. Engineers can have copyrights over the works they designed courtesy of the very restrictive and suffocating French copyright law that does not suit to Wikimedia. - Unfortunately, I can't find anything on the age of the church. The diocesis, whose cathedral it is, was errected in 1968, but the curch could still be older than that. Many of those where built by Missionaries at the beginning of the last century. PaterMcFly (talk) 17:33, 17 July 2023 (UTC)
- A1Cafel, would you consider restricting your deletion requests of photos of buildings to photos of buildings whose age can be established by you? Otherwise, in your zeal to delete things, you risk needless deletion that injures the free exchange of information. -- Ikan Kekek (talk) 18:35, 17 July 2023 (UTC)
- I saw it was established in 1968, and I thought that was the year of construction. I will restrict to those buildings who looks not so modern, and no exact year of establishment. --A1Cafel (talk) 03:00, 18 July 2023 (UTC)
- I don't think the establishment of a diocese determines when a church was built. That may have been when it became a cathedral, but it doesn't seem conclusive as to the date the building was erected. -- Ikan Kekek (talk) 04:29, 18 July 2023 (UTC)
- Just reading the details at Commons:Copyright rules by territory/Tanzania, works of applied art (and in my understanding, that includes buildings) are protected only for 25 years after creation. - @PaterMcFly not all countries consider architecture as an applied art. In the copyright laws of France, Saudi Arabia, and the Philippines, architecture is listed separately from applied arts in sections or articles about covered works. It appears Tanzania is a no exception: Section 5(2)(g) vs. Section 5(2)(i). The applied art concept seems to be a U.S. concept, but Tanzania is a former British colony. Where I'm from the national sports federation are not owned by the state so they wouldn't be able to be licensed to the equivalent of {{PD-RU-exempt}}. What about in Russia? Are these logos/flags really covered by {{PD-RU-exempt}}?

- I'm inclined towards Delete for these as these don't appear to be government organizations, but I'll defer to those who actually know more about Russia than my limited knowledge. Abzeronow (talk) 16:59, 17 November 2023 (UTC)

Needlessly minor crop of File:Linz-Kleinmünchen - Alleitenweg 11-17 (Ostfassade) b.JPG. Commons isn't a personal host and one image of this building from the same angle is enough. Especially since there's already 3 more that are extremely similar images to these ones, if not essentially the same. Adamant1 (talk) 09:30, 16 July 2023 (UTC)
Oppose. Equalized version. --Geiserich77 (talk) 11:30, 17 July 2023 (UTC)
- Equalized version. Meaning what exactly and how does it relate to why I filed this deletion request? The last time I checked the reason for the DR has nothing to do with it has nothing to do with the image equalized or not, whatever that means. --Adamant1 (talk) 11:34, 17 July 2023 (UTC)
- I think Geiserich77 means they tried to apply perspective correction to the photo. However, it looks like they did too much, and the building now looks distorted (it appears to be wider at the top than at the bottom). —holly {chat} 18:06, 13 November 2023 (UTC)
- Oh, that makes sense. --Adamant1 (talk) 23:49, 13 November 2023 (UTC)

Kept: no valid reason for deletion. —holly {chat} 17:52, 18 November 2023 (UTC)
apparently the author is an unknown ognization, not this user themself 不慎言行非法师魔女 (talk) 04:02, 16 July 2023 (UTC)
- @不慎言行非法师魔女: Why do you say that? OK, most people don't save photos as PNG files, so I suspect this is probably a copyright violation, but I would like to see some evidence. —holly {chat} 18:03, 13 November 2023 (UTC)
