- Contravenes WP:NFCC#1. A free equivalent of this image is available from the pre-1978 theatrical trailer and available at the Commons (see File:Charlton Heston in Ben Hur trailer.jpg). - This page is for images which are claimed to be free but which might not be free. In this case, you are requesting deletion of an image which isn't claimed to be free, so WP:FFD is a better place if you don't wish to fight with an editor who's removing tags. In this case, though, I wondering if this simply isn't the same photo as the one on Commons with just a few simple modifications in an image editor. --Stefan2 (talk) 09:45, 8 February 2013 (UTC)[reply]

- File:El Chapo-Guzman-1.jpeg (delete | talk | history | logs).
- The file information page tells that the photo was taken by an employee of the US government as part of the employee's official services as an employee of the US government. However, the source tells that the person is a fugitive and that the US government doesn't seem to know where the man is, except that his latest known address was in Mexico. If the US government doesn't know where the man is, then I don't see how the US government can take photos of him. The government probably got the photo from somewhere else. - Keep. The information page doesn't say any of the sort. What it says is "This work is in the public domain in the United States because it is a work of the United States Federal Government under the terms of Title 17, Chapter 1, Section 105 of the US Code." The requirement is that it be a work of the US Government, and shooting photos is not the ONLY work of the US Government, as the nominator's claim obviously assumes. The photo is on that government website --and it is there as PD-- because it is the result of work performed by the US Federal Government. As such, the copyright status indicated, PD, is correct and the image should stay. No offense, but the nominator appears to have a very blindsided view of what "work by" really means. If "work by" only means "shooting a picture", then the nominator hasn't made his case and needs to include a reference to such legal definition in his nomination/allegation. - I was speaking in the metaphorical sense of the website being a later day version of a wild west wanted poster; if as is likely the US government took the image from another source, put it on something they created, then that does not make the picture a PD one. The undisputed fact here is that the photo is from the DEA website, an agency of the US Dept of Justice, a federal government organization whose entire website contents are PD. Their exception to this, it states HERE, are four works that are in effect copyrighted. However, none of those four works are this photo. As such the photo is PD. - There is only one thing which is relevant here: Either it was taken by a US government employee as part of his employment, or it wasn't taken by a US government employee as part of his employment. - Delete The use by the US Government on a poster does not automatically turn a non-PD picture into a PD one. So unless it can be shown that the US government created the picture (as opposed to re-used an existing one created by a non-US government source) then it is incorrectly licensed and should be deleted as replaceable by a free one. However, for you statement to be true, you first have to assume as fact that the photo was non-PD when the Feds first used it to begin with. Question: Where is your proof to the fact that when the Feds first used the photo it was already non-PD? Yours is an example of circular reasoning - a fallacy. As such the argument you are presenting is, well, purely argumentative in nature and fails to prove or disprove anything.
