Terms of use

General

These terms of use apply to the use of the login service via the website www.car.info (the “Service” and the “Website”) and is applicable between Car Info Nordic AB (“Car Info”) and you (the “User”).

The Service is a solution that enables the User to access facts about car makes, car models and specific vehicles and to access images of vehicles that other users upload to the Website.

If the User is a business entity and intends to use the Service for the conduct of its business (e.g., but not limited to, car dealers, car insurance providers, vehicle maintenance companies etc., but not, e.g., a business that uses the Service to acquire company cars), these terms of use shall not apply but instead special terms for the Service shall be entered into between Car Info and such business entity. Should a business entity nevertheless use the Service, Car Info is entitled to charge compensation as set forth herein. Furthermore, the provisions regarding liability for Car Info and the provisions regarding rights clearance and dispute resolution shall apply.

Use of the Service

The User confirms its identity in the Service through a username and password. The User can also confirm its identity by connecting to the Service via a Facebook or Google account. If the User confirms its identity through a username and password, the User commits to select a username and a password difficult to reveal, not to reveal the information to anyone and to preserve the information in a way that prevents unauthorized access. In a situation where the User does not follow what is stated in this section, Car Info cannot be held responsible for unauthorized use.

Some of the information that the User will get access to through the Service may be classified as personal data. The User commits to not distribute, disclose, or otherwise use such personal data for purposes other than private non-commercial purposes.

Prices

As a consumer, you can use the Website free of charge.

In turn, the User is not entitled to receive compensation for information, images, etc. that the User provides to Car Info for uploading to the Website or in the Service.

By accepting these terms of use, the User confirms that the Service is only used for private and non-commercial purposes. Should the Service be used for commercial purposes, Car Info is entitled to charge the User a penalty of SEK 10,000 for each month the Service is used or a higher penalty if such damage can be shown.

Changes in the Service

Car Info reserves the right to make updates and changes to the Service at any given time. The User is also aware that Car info from time to time will carry out Website maintenance and that Car Info does not in any way guarantee that there is a minimum time during which the Website will be available to the User.

Intellectual Property Rights

All intellectual property rights connected to the Service and the Website, including but not limited to copyright in software and source code, shall be the exclusive property of Car Info and shall remain with Car Info. The User does not receive any license or other permission to use such rights by using the Service.

Car Info reserves the right to on the Website and in the Service use the images and other data that the User uploads to the Website and in the Service for marketing purposes and for other purposes. The right to use such information applies during the validity of these terms of use and thereafter without limitation in time, whereby the User gives Car Info an unlimited (both in terms of time and territory) free license to use, for the Service and the Website, the images and data regarding vehicles provided by the User. The license also entails a right to adapt and process the information/data to enable publication and use thereof on the Website and in the Service.

Rights Clearance

The User shall be responsible for obtaining any permissions necessary to upload the material (photographs etc.) on the Website or in the Service (if provided by anyone other than the User), to share the material with Car Info, and for sharing / distributing the information via the Website or in the Service. Should any necessary permissions not be obtained, the User is obliged to compensate Car Info for any damage suffered as a result thereof.

Personal Data

Car Info Nordic AB, Reg. No. 556953-9413, with address Lärkgatan 5, 262 32 Ängelholm and e-mail address [email protected], is the data controller for the processing of the User’s personal data. Car Info processes the User’s personal data in order to identify the User, communicate with the User, administer the User’s personal data to fulfil these terms of use and in other way administer the Service. The User’s personal data can also be processed for direct marketing by Car Info and its collaborative partners, as well as for statistics.

Availability and Liability

The Service is provided to the User without any commitment regarding support and Car Info makes no warranties of any kind, including but not limited to with respect to the Service, its design, functionality, or availability, whether expressed or implied or otherwise. This entails that Car Info has no responsibility towards the User or anyone else in the event that the Service cannot be accessed by the User at a certain time (regardless of whether this is due to maintenance, updates, technical problems, or any other circumstances).

Car Info also makes no guarantee regarding accuracy of the information published on the Website or provided via the Service. If the User acts based on information obtained via the Website or the Service (e.g., but not limited to, the acquisition of a car whose mileage turned out to be incorrect), Car Info cannot be held responsible for any damage suffered by the User as a result thereof.

Furthermore, Car Info does not by providing the Service become a party to any agreements or arrangements entered into by the User as a result of using the Service and can therefore, under no circumstances, be held liable by the User for any actions taken as a result of using the Service or otherwise for consequential damages or costs, direct or indirect, neither predictable nor unpredictable and regardless of the reason for the claim.

Termination

Car Info shall have the right to immediately terminate these terms of use in relation to the User (i) if the User violates the terms herein, (ii) in the event of a claim from a third party is directed against Car Info due to the User’s use of, or Car Info’s provision of, the Service or (iii) if Car Info otherwise for commercial or other reasons (e.g. as a result of a change in law or regulations, judgment or authority decision) decides to no longer provide the Service.

Upon the termination of these terms of use, the User shall immediately cease to use the Service. Car Info is also entitled to immediately close the User’s access to the Website and to the Service in the event of termination.

Amendments

Car Info reserves the right to unilaterally change these terms of use. Car Info will inform the User about the new terms of use through an opportunity for the User to approve the new terms and conditions when logging in to the Service. If the User does not accept a change of terms, both the User and Car Info reserves the right to terminate these terms of use immediately and at the same time terminate the use of the Service.

Disputes

These terms of use shall be governed by the substantive laws of Sweden. Any disputes arising out of or in connection with these terms of use shall be settled by the district court of Helsingborg, Sweden, in first instance.
