ORDER: During the Budget Speech delivered by the Honble Finance Minister on 17.2.2009 in the Tamil Nadu Legislative Assembly, it was announced that this Government will establish a separate welfare board for small traders like hawkers, those selling goods either on pavements or by carrying them in baskets or in carts and petty shopkeepers. 2. In this connection, the Commissioner of Labour, in his letter second read above, has stated that employment in street vending and employment in shops & establishments are listed in item Nos.46 & 50 in the Schedule to the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 (Tamil Nadu Act 33 of 1982). Therefore, a Welfare Board for Petty Shops and Street Vending Workers could be formed under section 6 of the Act. This Board may be

named as Tamil Nadu Petty Shops and Street Vending Workers Welfare Board. He has further stated that the proposed Petty Shops and Street Vending Workers Welfare Board could be managed and administered by the existing Secretary and staff already created to manage the affairs of the Tamil Nadu Manual Workers Welfare Board. After estimating the funds required for extending financial assistance to the members of the Board under the Schemes, the Government would be moved to allocate appropriate grant for the purpose, as in the case of other unorganised workers welfare boards. He has further stated that a separate proposal for appointment of Chairman and other Member of the Board along with a draft social security and welfare scheme for Petty Shops and Street Vending Workers will be sent to the Government shortly. 3. In his letter fourth read above, the Commissioner of Labour has stated that a separate welfare board may be formed in the name of Tamil Nadu Shops and Establishments and Street Vending Workers Welfare Board and under the proposed scheme workers engaged in shops and establishments employing four or less workers and the workers engaged in street vending only would be covered. He has recommended for formation of Tamil Nadu Shops and Establishments and Street Vending Workers Welfare Board. 4. After careful examination, the Government direct that the Tamil Nadu Street Vending and Shops and Establishments Workers Welfare Board be established separately and be notified in the Tamil Nadu Government Gazette under sub-section (1) of section 6 of the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 (Tamil Nadu Act 33 of 1982) as appended to this order. 5. Orders regarding nomination of members and notifying the Welfare Schemes to the above Board will be issued separately. 6. The appended Notification will be published in the Tamil Nadu Government Gazette in English. 7. The Secretary to Government, Tamil Development, Religious Endowments and Information (Translations) Department, Secretariat, Chennai-600009 is requested to send the Tamil translation of the Notification to the Works Manager, Government Central Press, Chennai600 079. 8. The Works Manager, Government Central Press, Chennai-79 is requested to send 30 copies of the Notification to the Government for

reference and record. He is also requested to send directly 30 copies of the Notification to the Commissioner of Labour, Chennai-600 006.
