20 Plaintiff Levi Strauss & Co. (“LS&Co.”) complains against Defendant Yves Saint Laurent
23 1. Plaintiff LS&Co.’s first, second, and third claims arise under the Trademark Act
24 of 1946 (the Lanham Act), as amended by the Trademark Dilution Revision Act of 2006 (15 U.S.C.
25 §§ 1051, et seq.). This Court has jurisdiction over such claims pursuant to 28 U.S.C. §§ 1338(a)
26 and 1338(b) (trademark and unfair competition), 28 U.S.C. § 1331 (federal question), and 15 U.S.C.
27 § 1121 (Lanham Act). This Court has supplemental jurisdiction over the remaining state law claims
1 2. Venue is proper in this Court under 28 U.S.C. § 1391(b) because YSL transacts
2 affairs in this district and because a substantial part of the events giving rise to the claims asserted
3 arose in this district.
4 3. Intra-district assignment to any division of the Northern District is proper under
5 Local Rule 3-2(c) and the Assignment Plan of this Court as an “Intellectual Property Action.”
6 PARTIES
7 4. LS&Co. is a Delaware corporation with its principal place of business at Levi’s Plaza,
8 1155 Battery Street, San Francisco, California 94111. Operating since approximately the 1850s,
9 LS&Co. is one of the oldest and best known apparel companies in the world. It manufactures,
10 markets, and sells a variety of apparel, including its traditional LEVI’S® brand products.
11 5. LS&Co. is informed and believes that defendant Yves Saint Laurent America, Inc. is
12 a New York corporation headquartered at 3 East 57th Street, New York, New York 10022.
13 6. LS&Co. is informed and believes that YSL manufactures, distributes, and/or sells, or
14 has manufactured, distributed, and/or sold pants under the brand name Yves Saint Laurent which are
15 offered for sale and sold throughout the United States, including in this judicial district. LS&Co. is
16 further informed and believes that YSL has authorized, directed, and/or actively participated in the
17 wrongful conduct alleged herein.
18 FACTS AND ALLEGATIONS COMMON TO ALL CLAIMS
19 LS&Co.’s Tab Trademark
20 7. LS&Co. marks its LEVI’S® brand products with trademarks that are famous around
21 the world. For many years prior to the events giving rise to this Complaint and continuing to the
22 present, LS&Co. annually has spent great amounts of time, money, and effort advertising and
23 promoting the products on which its trademarks are used and has sold hundreds of millions of these
24 products all over the world, including throughout the United States and in California. Through these
25 investments and large sales, LS&Co. has created considerable goodwill and a reputation for quality
26 products. LS&Co. continuously has used these trademarks, some for well over a century, to
27 distinguish its products.

1 8. Most of LS&Co.’s trademarks are federally registered; all are in full force and effect,
2 valid and protectable, and exclusively owned by LS&Co. LS&Co. continuously has used each of its
3 trademarks, from the registration date or earlier, until the present and during all time periods relevant
4 to LS&Co.’s claims.
5 9. Among its marks, LS&Co. owns the famous Tab Device Trademark (the “Tab
6 trademark”), which consists of a textile marker or other material sewn into one of the regular
7 structural seams of the garment. LS&Co. uses the Tab trademark on LEVI’S® jeans, pants,
8 jackets, shirts, and a variety of other clothing products.
9 10. LS&Co. began to display the Tab trademark on the rear pocket of its pants in 1936
10 when its then National Sales Manager, Leo Christopher Lucier, proposed placing a folded cloth
11 ribbon in the structural seams of the rear pocket. The purpose of this “tab” was to provide “sight
12 identification” of LS&Co.’s products. Given the distinctiveness of the Tab trademark, Mr. Lucier
13 asserted that “no other maker of overalls can have any other purpose in putting a colored tab on an
14 outside patch pocket, unless for the express and sole purpose of copying our mark, and confusing
15 the customer.”
16 11. LS&Co. owns, among others, the following United States and California Registrations
17 for its Tab trademark, attached as Exhibit A. The United States Registrations have become incontest-
18 able under the provisions of 15 U.S.C. § 1065.
19 a. U.S. Registration No. 516,561 (first used as early as September 1, 1936;
20 registered October 18, 1949);
21 b. U.S. Registration No. 1,157,769 (first used as early as September 1,
22 1936; registered June 16, 1981);
23 c. U.S. Registration No. 2,791,156 (first used as early as September 1,
24 1936; registered December 9, 2003);
25 d. U.S. Registration No. 356,701 (first used as early as September 1, 1936;
26 registered May 10, 1938);
27 e. U.S. Registration No. 577,490 (first used as early as September 1, 1936;
28 registered July 21, 1953);
1 f. U.S. Registration No. 774,625 (first used as early as May 22, 1963;
2 registered August 4, 1964);
3 g. U.S. Registration No. 775,412 (first used as early as October 9, 1957;
4 registered August 18, 1964);
5 h. U.S. Registration No. 2,726,253 (first used as early as March 7, 1969;
6 registered June 17, 2003); and
7 i. California Registration No. 052312 (first used as early as March 7,
8 1969; registered June 12, 1974).
9 12. The Tab trademark is valid and protectable, and exclusively owned by LS&Co. The
10 Tab trademark is famous and recognized around the world and throughout the United States by con-
11 sumers as signifying authentic, high quality LEVI’S® garments. The Tab trademark became famous
12 prior to YSL’s conduct that is the subject of this Complaint.
13 13. Examples of LS&Co.’s use of its Tab trademark on LEVI’S® garments are attached
14 as Exhibit B.
15 YSL’s Infringement of LS&Co.’s Trademarks
16 14. Beginning at some time in the past and continuing until the present, YSL has
17 manufactured, promoted, and sold garments that infringe and dilute LS&Co.’s trademarks.
18 15. In particular, LS&Co. is informed and believes that YSL has manufactured, sourced,
19 marketed, and/or sold pants bearing pocket tab devices that are highly similar to LS&Co.’s Tab
20 trademark (hereinafter “YSL Tab”) and are likely to confuse consumers about the source of YSL’s
21 products and/or a relationship between YSL and LS&Co. Images of some of YSL’s products
22 bearing the YSL Tab are attached to this Complaint as Exhibit C, and a table showing the parties’
23 respective marks in use follows:

1 16. LS&Co. is informed and believes that YSL has manufactured, marketed, and
2 sold products bearing the YSL Tab, and has obtained and continues to profit from these sales.
3 17. YSL’s actions have caused and will cause LS&Co. irreparable harm for which money
4 damages and other remedies are inadequate. Unless YSL is restrained by this Court, it will continue
5 and/or expand its illegal activities and otherwise continue to cause great and irreparable damage and
6 injury to LS&Co. by, among other things:
7 a. Depriving LS&Co. of its statutory rights to use and control use of
8 its trademarks;
9 b. Creating a likelihood of confusion, mistake, and deception among
10 consumers and the trade as to the source of the infringing products;
11 c. Causing the public falsely to associate LS&Co. with YSL and/or
12 its products, or vice versa;
13 d. Causing incalculable and irreparable damage to LS&Co.’s goodwill
14 and diluting the capacity of its Tab trademark to differentiate LEVI’S®
15 products from others;
16 e. Causing LS&Co. to lose sales of its genuine clothing products; and
17 f. Causing others to believe that the distinctive features of the Tab
18 trademark may be misappropriated for their use.
19 18. Accordingly, in addition to other relief sought, LS&Co. is entitled to injunctive relief
20 against YSL, its affiliates, licensees, subsidiaries, and all persons acting in concert with it.
21 FIRST CLAIM
FEDERAL TRADEMARK INFRINGEMENT
22 (15 U.S.C. §§ 1114-1117; Lanham Act § 32)
23 19. LS&Co. realleges and incorporates by reference each of the allegations contained in
24 paragraphs 1 through 18 of this Complaint.
25 20. Without LS&Co.’s consent, YSL has used, in connection with the sale, offering for
26 sale, distribution, or advertising of its products, designs that infringe upon LS&Co.’s registered Tab
27 trademark.

1 21. These acts of trademark infringement have been committed with the intent to cause
2 confusion, mistake, or deception, and are in violation of 15 U.S.C. § 1114.
3 22. As a direct and proximate result of YSL’s infringing activities, LS&Co. is entitled to
4 recover YSL’s unlawful profits and LS&Co.’s substantial damages under 15 U.S.C. 1117(a).
5 23. YSL’s infringement of LS&Co.’s Tab trademark is an exceptional case and was
6 intentional, entitling LS&Co. to treble the amount of its damages and YSL’s profits, and to an award
7 of attorneys’ fees under 15 U.S.C. §§ 1117(a).
8 24. LS&Co. is entitled to injunctive relief pursuant to 15 U.S.C. 1116(a).
9 SECOND CLAIM
FEDERAL UNFAIR COMPETITION

12 25. LS&Co. realleges and incorporates by reference each of the allegations contained
13 in paragraphs 1 through 24 of this Complaint.
14 26. YSL’s use of the YSL Tab tends falsely to describe its products within the meaning of
15 15 U.S.C. § 1125(a)(1). YSL’s conduct is likely to cause confusion, mistake, or deception by or in
16 the public as to the affiliation, connection, association, origin, sponsorship, or approval of YSL’s
17 products, to the detriment of LS&Co. and in violation of 15 U.S.C. § 1125(a)(1).
18 27. As a direct and proximate result of YSL’s infringing activities, LS&Co. is entitled to
19 recover YSL’s unlawful profits and LS&Co.’s substantial damages under 15 U.S.C. § 1117(a).
20 28. YSL’s infringement of LS&Co.’s Tab trademark is an exceptional case and was
21 intentional, entitling LS&Co. to treble the amount of its damages and YSL’s profits, and to an award
22 of attorneys’ fees under 15 U.S.C. § 1117(a).
23 29. LS&Co. is entitled to injunctive relief pursuant to 15 U.S.C. § 1116(a).
24 THIRD CLAIM
FEDERAL DILUTION OF FAMOUS MARKS

27 30. LS&Co. realleges and incorporates by reference each of the allegations contained in
28 paragraphs 1 through 29 of this Complaint.
1 31. LS&Co.’s Tab trademark is distinctive and famous within the meaning of the
2 Trademark Dilution Revision Act of 2006, 15 U.S.C. § 1125(c), and was distinctive and famous
3 prior to Barbour’s conduct as alleged in this Complaint.
4 32. YSL’s conduct is likely to cause dilution of LS&Co.’s Tab trademark by diminishing
5 its distinctiveness in violation of the Trademark Dilution Revision Act of 2006, 15 U.S.C. § 1125(c).
6 33. LS&Co. is entitled to injunctive relief pursuant to 15 U.S.C. §§ 1116(a) and 1125(c).
7 FOURTH CLAIM
CALIFORNIA TRADEMARK INFRINGEMENT AND DILUTION
8 (Cal. Bus. & Prof. Code §§ 14245, 14247, 14250)
9 34. LS&Co. realleges and incorporates by reference each of the allegations contained
10 in paragraphs 1 through 33 of this Complaint.
11 35. YSL’s infringement of LS&Co.’s Tab trademark is likely to cause consumer
12 confusion and dilution of LS&Co.’s marks in violation of California Business & Professions Code
13 sections 14245 and 14247.
14 36. YSL infringed and diluted LS&Co.’s Tab trademark with knowledge and intent
15 to cause confusion, mistake, or deception.
16 37. YSL’s conduct is aggravated by that kind of willfulness, wantonness, malice,
17 and conscious indifference to the rights and welfare of LS&Co. for which California law allows
18 the imposition of exemplary damages.
19 38. Pursuant to California Business & Professions Code sections 14247 and 14250,
20 LS&Co. is entitled to injunctive relief and damages in the amount of three times YSL’s profits and
21 three times all damages suffered by LS&Co. by reason of YSL’s manufacture, use, display, or sale of
22 infringing goods.
23 FIFTH CLAIM
CALIFORNIA UNFAIR COMPETITION

25 39. LS&Co. realleges and incorporates by reference each of the allegations contained
26 in paragraphs 1 through 38 of this Complaint.

1 40. YSL’s conduct as alleged in this Complaint constitutes “unlawful, unfair or fraudulent
2 business act[s] or practice[s] and unfair, deceptive, untrue or misleading advertising” within the
3 meaning of California Business & Professions Code section 17200.
4 41. As a consequence of YSL’s actions, LS&Co. is entitled to injunctive relief preventing
5 the conduct alleged in this Complaint.
6 PRAYER FOR JUDGMENT
7 WHEREFORE, LS&Co. prays that this Court grant it the following relief:
8 1. Adjudge that LS&Co.’s Tab trademark has been infringed by YSL in violation
9 of LS&Co.’s rights under common law, 15 U.S.C. § 1114, and/or California law;
10 2. Adjudge that YSL has competed unfairly with LS&Co. in violation of LS&Co.’s
11 rights under common law, 15 U.S.C. § 1125(a), and/or California law;
12 3. Adjudge that YSL’s activities are likely to dilute LS&Co.’s famous Tab trademark in
13 violation of LS&Co.’s rights under common law, 15 U.S.C. § 1125(c), and/or California law;
14 4. Adjudge that YSL and its agents, employees, attorneys, successors, assigns, affiliates,
15 and joint venturers, and any person(s) in active concert or participation with it, and/or any person(s)
16 acting for, with, by, through, or under it, be enjoined and restrained at first during the pendency of
17 this action and thereafter permanently from:
18 a. Manufacturing, producing, sourcing, importing, selling, offering for
19 sale, distributing, advertising, or promoting any goods that display any
20 words or symbols that so resemble LS&Co.’s Tab trademark as to be
21 likely to cause confusion, mistake or deception, on or in connection with
22 any product that is not authorized by or for LS&Co., including, without
23 limitation, any product that bears the YSL Tab which is the subject of
24 this Complaint and for which YSL is responsible, or any other
25 approximation of LS&Co.’s trademarks;
26 b. Using any word, term, name, symbol, device, or combination thereof
27 that causes or is likely to cause confusion, mistake, or deception as to
28 the affiliation or association of YSL or its products with LS&Co. or as
1 10. Adjudge that the amounts awarded to LS&Co. pursuant to 15 U.S.C. § 1117 shall be
2 trebled;
3 11. Order an accounting of and impose a constructive trust on all of YSL’s funds and
4 assets that arise out of its infringing activities;
5 12. Adjudge that LS&Co. be awarded its costs and disbursements incurred in connection
6 with this action, including LS&Co.’s reasonable attorneys’ fees and investigative expenses; and
7 13. Adjudge that all such other relief be awarded to LS&Co. as this Court deems just and
8 proper.
