PRESS NOTICE
CENTRAL WATER COMMISSION

1. The Executive Engineer, Snow Hydrology Division, Central Water Commission,


Block No. 29, SDA Complex, Kasumpti, Shimla invites on behalf of President of
India sealed tenders comprising of technical and financial bids in separate sealed
envelopes from experienced manufacturers, authorized dealers, suppliers, contractors
up to 1500 hrs on _____________for the supply, installation, Testing, Commission
and maintenance of real-time data acquisition network on turn key basis for
collection, transmission and processing of hydro meteorological data, Gauging
Equipment, Satellite communication links between the existing Digital direct
Readout Ground Station facilitied located at Jaipur (Rajasthan) and various location
in Satluj Basin and maintenance for four years after warranty period of two years.

2. Tender forms will be issued to parties only after their production of definite proof
from the appropriate authorities of having satisfactorily completed similar works
during the last five years which are working satisfactorily since last two years in
atleast two alluvial river basins.

3. Tender form along with Terms and Conditions can be purchased from the office of
Executive Engineer, Snow Hydrology Division, Central Water Commission, Block
No. 29, SDA Complex, Kasumpti, Shimla on all working days during office hours
(1000 to 1700 hours) on payment of Rs. 1500/- + 4% Sale Tax through A/C Payee
Demand Draft (Non-refundable) drawn on any schedule bank in favour of Executive
Engineer, Snow Hydrology Division, Central Water Commission, Shimla. Tender
forms requested by mail will be dispatched by Speed Post/Registered Post on
payment of extra amount of Rs. 250/-

4. A pre-bid conference will be held in the Committee Room of Member (River


Management),, Central Water Commission, at Room No. 212,(South Wing), Sewa
Bhawa, R.K. Puram, New-110066 at 1100 hrs on ___________. Potential bidders
may give the issues on which clarifications are required in writing latest by 1600 hrs
on _________in the office of the undersigned.

5. The Earnest Money deposit will be Rs. 20 Lakh (Rupees Twenty lakhs only). The

NOTICE INVITING TENDER

8. Item rate tender are invited on behalf of the President of India in two bid system-one
containing bid and the other containing financial bid from the approved and eligible
manufacturers, authorized dealers, suppliers, contractors having sufficient experience
of similar works for supply, installation, Testing, Commission and maintenance of
real-time data acquisition network on turn key basis for collection, transmission and
processing of hydro meteorological data, Gauging Equipment, Satellite telemetry and
associated systems including hardware software and peripherals,VSAT
communication links between the existing Digital direct Readout Ground Station
facilities located at Jaipur (Rajasthan) and various location in Satluj Basin and
maintenance for four years after warranty period of two years.

1. Only manufactures, authorised dealers, suppliers, contractors having sufficient


experience of similar works shall quote for the works. Similar works are defined as
those involving installation of equipments/sensors of the same type of technology in
the field integrated with data acquisition and satellite based transmission systems.
The definition also includes implementation of a VSAT network including operating a
network of 100 or more VSAT nodes for the last five years on a commercial basis.
While asking for tender forms intending tenderers shall produce proof from the
appropriate authorities having satisfactorily completed similar works during the last 5
years which are working satisfactorily in aleast two alluvial river basins for the two
years and could be inspected. The issue of tender forms is subject to the above
conditions. In case of consortium of manufacturers, authorized dealers, supplier,
contractors for the major components of the works, such as telemetry, VSAT, etc. the
qualifying criteria will be applicable to each partner separately for the specific portion
of the project which are to be the direct responsibility of the partner.

2. Agreement shall be drawn with the successful tenderers on prescribed Form No. 8
which is available as a Government of India Publication, tenderers shall quote his
rates as per various terms and conditions of the said form which will form part of the
agreement.
3. The time allowed for carrying out the works will be _____days from the _______day
after the date of written orders to commence the works.

4. The site for the work is available.

5. Receipt of applications for issue of tender forms will be stopped by 1200 hrs on

Tender documents consisting of specifications, the schedule of requirements of the


various items of work to b done and the set of conditions of contract to be complied
with by the contractor whose tender may be accepted and other necessary documents
can be seen in the office of Executive Engineer, Snow Hydrology Division, Central
Water Commission, Shimla, Telefex 0177-2623026 between hours of 10.00 AM to
5.00 PM everyday except on 2nd Saturday of the month,Sunday and Public Holidays.
Tender document, excluding standard from will be issued from his office, during the
hours specified above, on the payment of ________ Sales tax through A/c payee by
demand draft in favour of Executive Engineer, Snow Hydrology Division, Central
Water Commission, Shimla payable at Shimla. Tender form requested by mail be
dispatched by speed post/registed post on payment of an extra amount of Rs.______.

6. The tenderer must produce an Income Tax clearance certificate in the revised forms as
modified under Ministry of Finance O.M. No. 67/30/69/ITAL dated 2.7.1970 as
amended from time to time before tender papers can be sold to him.
7. Tenders, in two bid system, one sealed cover containing technical bid with earnest
money and the other sealed cover containing financial bid and both the covers placed
in another sealed envelope, with the name of work and due date of opening written
on the envelopes, will be received by the Executive Engineer, Snow Hydrology
Division, Central Water Commission , Shimla upto 1500 hrs on ____ and technical
bid will be opened by him or his authorised representative in his office on the same
date at 1600 hours. Financial bids shall be opened only of the bidders whose technical
bids are found acceptable. The date and time shall be fixed subsequently and
intimated to the technically qualified bidders in advance.
8. The tender technical bid shall be accompanied by earniest money, (unless exempted)
of of Rs. ______lakhs as Demand Draft on a Schedule Bank issued in favour of
Executive Engineer, Snow Hydrology Division, Central Water Commission, Shimla.
A contractor exempted from depositing earnest money in individual cases, shall attach
with the tender an attested copy of the letter exempting him from depositing earnest
money and shall produce the original when called upon to do so. If the technical bid
of the tender does not contain specified earnest money the tender will be summarily
rejected and their financial bid shall not be opened.
9. The description of the work is given in Technical Specification.

Detailed informations pertaining to the works will be open for inspection by the
tenderers at the office of the above mentioned officer. S

Tenderers are advised to inspect and examine the locations where the telemetry
system is to be installed and their surroundings and satisfy themselves before
submitting their tenders as to the nature of the ground and sub soil (so far as is
practicable), the form and nature of the site, the means of access to the site, the
accommodation they may require and in general shall themselves obtain all necessary
information as to risks, contingencies and other circumstances which may influence
or effect their tender. A tenderer shall be deemed to have full knowledge of the site
whether he inspects or not and no extra charges consequent on any misunderstanding
or otherwise shall allowed. The tenderer shall be responsible for arranging and
maintaining at his own cost all materials, tools and plants, water, electricity access,
facilities for workers and all other services required for executing the work unless
otherwise specifically provided for in the contract documents. Submission of a tender
by a tenderer implies that he has read this notice and all other contract documents and
has made himself aware of the scope and specifications of the work to be done and
other factors having a baring on the execution of the work.

10. The competent authority on behalf of President of India does not bind itself to accept
the lowest or any other tender, and reserve its right to reject any or all of the tenders
received without the assignment of any reason.

The competent authority has also reserve its right to allow to the Central Government
Public Sector Enterprises a purchase preference with reference to the lowest valid
price bid as per Govt. of India rules prevalent on the date of opening of bid.

All tenders, in which any of the prescribed conditions are not fulfilled or are
incomplete in any respect are liable to be rejected.

11. Canvassing whether directly or indirectly, in connection with tenders is strictly


prohibited and the tenders submitted by the contractors who resort to canvassing will
be liable to rejection.

12. The competent authority on behalf of President of India reserves to himself the right
of accepting the whole or any part of the tender and the tenderer shall be bound to
perform the same at the rate quoted.

13. The contractor shall not be permitted to tender for works in the Central Water
Commission Circle (responsible for award and execution of contracts) in which his
near relative is posted as Divisional Accountant or as an officer in any capacity
between the grades of Superintending Engineer and Assistant Engineer (both
inclusive). He shall also intimate the names of persons who are working with him in
any capacity or are subsequently employed by him and who are near relatives to any
gazetted officer in the Central Water Commission or in the Ministry of Water
Resources. Any breach of this condition by the contractor would render him liable to
be removed from the approved list of contractors of this Department.

14. No Engineer of Gazetted rank or other Gazetted officer employed in Engineering or


Administrative duties in an Engineering Department of the Government of India is
allowed to work as a contractor for a period of two years after his retirement from
Government service, without the previous permission of the Government of India in
writing. This contract is liable to b cancelled if either the contractor or any of his
employees is found any time to be such a person who had not obtained the permission
of the Government of India as aforesaid before submission of the tender or
engagement in the contractor’s service.
15. The tender for the works shall remain open for acceptance for a period of ninety days
from the date of opening of tenders. If any tenderer withdraws his tender before the
said period or makes any modifications in then terms and conditions of the tender
which are not acceptable to the department, then the Government shall, without
prejudice to any other right or remedy, be at liberty to forfeit 50% of the said earnest
money as aforesaid.

16. This Notice inviting Tender shall form a part of the contract document. The
successful tenderer/contractor, on acceptance of his tender by the Accepting
Authority, shall within 15 days from the stipulated date of start of the work sign the
contract consisting of:
a) The notice inviting tender, all the documents including conditions of contract,
technical specifications, forms the tender as issued at the time of invitation of
tender and acceptance thereof together with any correspondence leading thereto.
b) Standard C.P.W.D Form-8.

17. A pre-bid conference will be held in the Committee Room of Member (River
Management), Central Water Commission at Room No. 212 (South Wing), Sewa
Bhawan, Rama Krishna Puram, New Delhi –110066 at 1100 hours on 17th June, 2004.
Potential bidders may give the issues on which clarifications are required in writing
latest by 1600 hours on 14.06.2004 in the office of the undersigned.

In this conference, the clarifications, if any required by any prospective bidders on the
bidding documents would be discussed. If, for any reason, whether at its own
initiative or in response to a clarification requested by the prospective bidders, the
purchaser modifies the bidding documents by an amendment, the same will be sent to
all prospective bidders who have received the bidding document.

TENDER

I/We have read and examined the notice inviting tender, Schedule A, B, C, D, E & F.
Specifications applicable, Drawings & Designs, General Rules and Directions,
Conditions of Contract, clauses of contract, Special conditions, Schedule of Rate & other
documents and Rules referred to in the conditions of contract and all other contents in the
tender document for the work.

I/We hereby tender for the execution of the work specified for the President of India
within the time specified in Schedule ‘F’, viz., schedule of quantities and in accordance
in all respects with the specifications, designs, drawings and instructions with such
materials as are provided for, by and in respects in accordance with, such conditions so
far as applicable.

I/We agree to keep the tender open for ninety(90) days from the date of submission
thereof and not to make any modifications in its terms and conditions.

A sum of Rs. 20.00 lakhs is hereby forwarded as Demand Draft of a Scheduled Bank as
earnest money. If I/We, fail to commence the work specified I/We agree that the said
President of India or his successors in office shall without prejudice to any other right or
remedy, be at liberty to forfeit the said earnest money absolutely; otherwise the said
earnest money shall be retained by him towards security deposit to execute all the works
referred to in the tender documents upon the terms and conditions contained or referred to
therin and to carry out such deviations as may be ordered, upto maximum of the
percentage mentioned in Schedule ‘F’.

I/We have already furnished security to the President of India in lieu of earnest money
and have deposited with the Chairman, Central Water Commission, New Delhi a lump
sum security of Rs. _______________ as earnest money in individual cases & I/We,
therefore claim exemption in terms of the Bond executed by me/us and bearing no.

I/We agree that should I/we fail to commence the work specified in the above
memorandum, an amount equal to the amount of the earnest money mentioned in the
form of invitation of tender shall be absolutely forefeited to the President of India and the
same may at the option of the competent authority on behalf of the President of India be
recovered without prejudice to any other right or remedy available in law out of the
deposit in so far as the same may extend in terms of the said bond and in the event of
deficiency out of any other money due to me/us under this contract or otherwise.
