1) Evander Chatto was charged with estafa but reached a compromise agreement with the complainant Globe Telecom to settle the case out of court. 2) Under the agreement, Chatto claims someone else illegally used his identity and agrees to pay Globe in installments. He also agrees to testify against the real perpetrator. 3) If Chatto violates the agreement, Globe can demand payment in full or reinstate the case. Both parties request the case be provisionally dismissed.

COMPROMISE AGREEMENT

UNDERSIGNED PARTIES AGREED AS FOLLOWS:

1. Without going into the merits of the case and for the purpose of
buying peace, the accused offers to settle the case amicably which the
private complainant accepts subject to the following mutually acceptable
terms:

a. The accused henceforth asks the complainant, Globe Telecom,


without prejudice to his plight that somebody in the name of ‘Gerwin’ made
an illegal transaction using his identity and promises thereof to pay Globe
Telecom in installment of the claims which is internal between the parties;

b. The accused undertakes to be a witness against ‘Gerwin’ or


whatever name he is using to do what is right and appropriate in the interest
of justice;

2. In the event that the accused violates any of the terms of this
compromise agreement, the unpaid balance shall become due and
demandable and the private complainant can move for the issuance of a writ
of execution to enforce the terms of this compromise agreement or
reinstatement of the above-entitled case;

3. Both parties hereby request the Honorable Public Prosecutor to


file the necessary motion for the provisional dismissal of the case, pursuant
to Rule 117 of the Revised Rules of Criminal Procedure. Toward this end, the
accused gives his consent to the provisional dismissal of this case;

IN WITNESS WHEREOF, the parties hereto have mutually and voluntarily agreed to the
above stipulations and submit the same for the consideration and approval of the Honorable
Court.

AFFIDAVIT OF DESISTANCE

I, Manolito G. Zapanta c/o Globe Telecom Inc., I.T. Park, Brgy. Apas, Cebu
City, under oath, say:

1. That after considering the compromise settlement entered


into by the parties, the instant case does not warrant any further
proceedings. Hence, I am no longer interested in carrying out any
legal action against the accused;

2. That I execute this affidavit of desistance, freely and


voluntarily, to express my conformity for its provisional dismissal and
to refrain further with this case;

3. That I have fully read and understood the foregoing


statement and the same are true and correct;
