Internship Partnership: Memorandum of Understanding (Mou) : Purpose
This agreement is between President College, Kuala Lumpur, (hereinafter referred to as ‘PCKL’)
and Hotel Club Dolphin, Kuala Lumpur, (here in after referred to as the ‘PARTNER’).
PURPOSE
The purpose of this agreement is to make clear on the roles and responsibilities of each party
involved in the Internship Partnership, namely PCKL (as an academic institution) and the
PARTNER (as a practical training sponsor). This partnership is very crucial to all PCKL’s
Diploma in Hotel Management Students, as any practical educational experiences that is gained
through internship will definitely help to enhance their overall learning process. On that note,
PCKL believes that the sponsoring PARTNER do own all the appropriate resources needed for
such learning to take place and therefore intends to make them available for it's student's
educational purpose.
Therefore, for the purpose of this partnership, all parties involved mutually agrees to the
following:
1. The term of this agreement will commence with the date of the final signature and end
by mutual agreement of the parties. Either party may terminate this MoU by giving the
other prior written notice of termination of not less than thirty (30) days, or at any time by
mutual consent.
2. The sponsoring Partner and PCKL shall cooperate in the selection of students for the
practical educational and training (‘Internship’) with the Partner . The parties shall
periodically confer, as needed, about the Internship during its term.
3. Prior to the beginning date, the Partner shall provide PCKL with a memorandum
describing the job and working arrangements including, among other things, the
Partner's expectations, the intern’s/student’s responsibilities and any compensation or
work-related benefits presented to the student.
4. Neither party shall not discriminate against any person by reason of race, color, gender,
age, religion, disability, sexual orientation, national or ethnic origin in connection with any
aspect of its performance hereunder.
5. It is mutually agreed that there is no financial obligation on the part of either party to the
other and the Partner's acceptance of a student for Internship does not obligate it to
compensate PCKL or vice versa. All agreement for financial compensation to the student
(if any) shall be made separately from this MoU.
6. In order to transmit knowledge gained through the Internship; a basic objective of any
academic institution, both parties, their students and employees, shall have the right to
publish scholarly articles and papers arising out of the Internship experience with the

Partner; however, each party and their students and employees agree to submit such
articles and papers to the other not less than sixty (60) days prior to publication for the
purposes of identifying (with reason and in good faith) inaccurate, improper and/or
proprietary information contained therein. If no written objection is received within thirty
(30) days, any objections are waived and it may be assumed that the articles and papers
may be published forthwith.
7. When circumstances warrant withdrawal or removal of a student from the Internship,
both parties will first need to confer to determine appropriate action deemed to be in the
best interests of the student and the parties. Either party reserves the right to
withdraw/remove a student from an Internship for good cause, unrestrictedly including if
the Partner is unable to meet the conditions of this MOU or the student violates any
substantive policy, rule or regulation of the Partner duly communicated to the student.
8. Neither party shall use the other’s name in any publications or advertising without the
other’s prior written approval.
9. Each party shall be responsible for its own negligent acts or omissions and those of its
employees in accordance with prevailing law.
10. It shall be assumed that the student will provide his or her own medical, dental,
hospitalization and liability insurance. The Partner may provide such coverage, in which
case it shall be clearly communicated to the student and PCKL.
11. It is mutually agreed that the Partner will not offer boarding to the student throughout
his/her internship period, unless the Partner wish to do so.
B) PCKL’s Responsibilities
1. PCKL will designate a faculty member to liaison with the Partner to assist on the
following subjects; developing the student assignments, training activities and
evaluations.
2. At the Partner ’s request, PCKL may permit a needed number of faculty member(s) to
participate as resource persons for Partner 's activities related to the Internship on a
limited and discretionary basis.
3. PCKL is responsible for the education, academic evaluation and monitoring of the
student’s learning experiences.
4. PCKL and its student agree to hold all work-related information, including restriction,
letters, memoranda, information from the Partner ’s files, and all other materials, plans,
and conversations specifically concerning the work comprising the services requested by
PCKL and the Interns under this MOU (“Confidential Information”) as strictly confidential
while this MOU is in effect and for a period of twelve months after the termination hereof.
However, these confidentiality obligations shall not apply to any confidential information;
which was in the public domain prior to the disclosure or which subsequently comes into
the public domain through no fault of recipient; information that recipient can
demonstrate was already known or independently developed by recipient; information

received in good faith by recipient from a third party; and information that is required to
be disclosed by operation of law.
5. PCKL shall require its students to abide by all reasonable Partner's policies, rules and
regulations during their Internship of which the student(s) and PCKL are given prior
notice by the Partner as per agreed in this MoU.
C) Partner’s Responsibilities
1. The Partner agrees to designate one or more Partners’ employees, with appropriate
qualifications, to collaborate in developing assignments and training activities and to
instruct, evaluate and supervise student’s performance throughout his/her Internship.
2. The Partner will be responsible for the direct supervision and control of the student's
activities while at the Partner or where performed at its direction.
3. The Partner agrees to provide learning experiences mutually developed and/or agreed
upon by the parties consistent with this MoU, and agrees to arrange Internship
schedules which does not conflict with PCKL’s published academic schedule.
4. The Partner agrees to provide job orientation and sufficient resources to enable the
student to function effectively to meet the Internship objectives.
5. The Partner agrees to provide all applicable policies, rules and regulations which the
student is expected to follow during his/her Internship period with the Partner , prior to
the starting date to PCKL. This includes, among other things, such policies and
procedures as are in effect and reasonably necessary to protect confidential and/or
proprietary information, if such data and information may be involved in the Internship.
6. When necessary or desirable, the Partner agrees to permit: (i) inspection of its facilities
by PCKL and PCKL’s accrediting agencies, upon reasonable request; and (ii) provide
adequate time for PCKL’s faculty member in-charge to meet with the student during the
Internship.
7. The Partner shall submit reports to PCKL on each student’s progress and performance
during the Internship on a mutually agreeable schedule. Notwithstanding the foregoing, if
the Partner has any material concerns regarding a student's performance or if specific
circumstances arise which lead the Partner to conclude that a student should be
withdrawn from his/her Internship before the end of its term, the Partner will confer
immediately with PCKL’s faculty member in-charge to resolve such concerns.
D) Student’s Responsibilities
1. This MoU shall be governed by the Malaysian Law and any action concerning this MoU
shall be brought into a court of competent jurisdiction in the State of Kuala Lumpur.
2. The parties agree that this MoU shall be binding upon their respective successors or
transferees of any nature.
3. Nothing in this MoU shall be construed to make either party the legal agent or
representative of the other, nor shall either party have the right or authority to assume,
create or incur any liability or any obligation of any kind, either expressed or implied, in
the name of or on behalf of the other party.
4. Neither party shall assign this MoU, directly or indirectly, in whole or in part, without prior
written consent of the other.
5. The parties may modify this MoU by written agreement at any point of time.

ATTACHMENT ‘A’:
INTERNSHIP ACKNOWLEDGEMENT OF RISK AND RELEASE
3. I understand and acknowledge that PCKL does not control the management of the
Partner or the manner in which the Partner conducts its operations, including without limitation,
working environments and conditions, and the assignment of duties and responsibilities. I
further acknowledge that the Partner , and not PCKL, has overall control of and supervisory
responsibility for the Internship and my Internship experience.
5. I am fully aware and acknowledge that there are certain known, as well as unknown,
risks and hazards associated with participation in an internship experience, which may not be
avoidable, including, without limitation, risks and hazards related to: travel to and from the
internship location; exposure to communicable disease; exposure to toxic or otherwise
dangerous chemicals and substances; serving individuals whose behavior may be
unpredictable, and pose a danger to myself and others; and working in unfamiliar surroundings,
and locations where security is uncertain. I understand and acknowledge that such risks and
hazards may lead to, among other consequences, damage to or loss of property and personal
injury, including death. I expressly agree that by electing to participate in the Internship I
voluntarily assume full responsibility for any and all such risks of damage to or loss of property
owned or possessed by me and injuries that may be sustained by me, including death, in the
course of my participation in the Internship.
6. I acknowledge and agree that it is my responsibility to read and follow the Partner’s
safety and security rules, policies and procedures, and to follow such safety and security
instructions that may be given to me by my Partner supervisors. I understand and acknowledge
I am not required and shall not be forced to undertake any duties or participate in any activities
in the course of the Internship which I believe may put my health or safety at risk, and I agree to
immediately notify the Partner ’s supervisor(s) and PCKL’s faculty member in-charge of any
conditions and/or circumstances which I believe may pose or have posed a threat to my health
or safety.
8. I acknowledge and agree that if I use my personal vehicle for my internship duties and
responsibilities or otherwise for the benefit of the Partner , such use shall be entirely at my own
risk, and PCKL shall not be responsible for nor incur any liability for any damage or loss of
property or personal injury that may result, including death.
10. I warrant that I am at least eighteen (18) years of age and I am competent to contract in
my own name. If I am under the age of eighteen (18) my parent or legal guardian must sign
below. I acknowledge that I have fully read the provisions of this Internship Acknowledgement of
Risk and Release prior to signing below, and I understand their meaning and impact. I warrant

that no oral representations, statements or inducements, apart from the foregoing written
agreement have been made.
