    JUDICIAL AFFIDAVIT OF JOECARLO DALISAY

    I, JOECARLO DALISAY, of legal age, single, and living at Brgy.


    Poblacion, Tanauan, Leyte, witness of the accused (Alvino) in this
    instant case, state under oath as follows:

    PRELIMINARY STATEMENT
    The person examining me is Atty. ABCD with address at Real St.,
    Tacloban City. The examination is being held at the same address. I am
    answering her questions fully conscious that I do so under oath and
    may face criminal liability for false testimony and perjury.
    This affidavit/testimony of JOECARLO DALISAY is being
    offered to prove (1) Accused’s location at the time of the
    commencement of the crime, which is respectfully requested to be
    correspondingly marked as EXHIBITS ________ in this case; and (2)
    All other related matters, facts and circumstances relevant and
    material to this case.

    Q1. Do you swear to tell the truth and nothing but the truth?
    A1. I do, Ma’am.

    Q2. Are you aware that you may face criminal liability for false
    testimony or perjury if you will not tell the truth?
    A2. Yes, Ma’am.
    Q3. In which language would you prefer your affidavit to be made?

    A3. In English, Ma’am.

    Q4. Please state your name, age, address and occupation.


    A4. I am Joecarlo Dalisay, 25 years old, residing at Brgy. Poblacion,
    Tanauan, Leyte, a sales man in Pepsi, Tanauan Leyte.

    Q4. Do you know the accused in this instant case, Alvino?


    A4. Yes, Ma’am. He is my childhood playmate and teammate in
    basketball.

    Q5. You said, Alvino is your teammate. Do you have any future
    games or did you join any Liga?
    A5. Yes, we have several games in the upcoming weeks. The Liga
    started on August 5, 2019. Our first game was on August 8,
    2019.

    Q6. What happened on August 8, 2019?


    A6. It was our first game against the Elite Basketball. At about
    3pm, Alvino picked me up at our house. We both arrived at the
    Tanauan Gym at about 3:15. When we arrived at the Gym, the
    first game was not yet done. So, we decided to warm up and at
    the same time watch the game together with our teammates.

    Q7. What happened next?


    A7. Our game with Elite Basketball started on 4:45pm. Alvino is one
    of the biggest team members, so he is one of the first five of the
    game.

    Q8. Was Alvino there the whole time?


    A8. Yes ma’am.

    Q9. Was he playing the whole time of your game?


    A9. No ma’am. He had to rest for a few minutes. But most of the
    time, our coach lets him play because he is our big man.

    Q10. Do you know what time your game ended?


    A10. Our game ended at about 8pm on August 8, 2019.

    Q11. After your game, where else did you go?


    A11. We ate dinner at a Barbecue stand near the plaza.

    Q12. Who else were there?


    A12. We were all there, ma’am. Because we won our first game, it
    was our coach’s treat to us.
    Q13. After you ate dinner, did you go somewhere else?
    A13. We decided to go home because we were all tired from the
    game and it was already late. Alvino dropped me at our house
    at about 9:45 in the evening.

    Affiant further sayeth naught.
