TERMS OF AGREEMENT

RENTAL CHARGES PAID TO HUA HIN PROPERTY SEARCH LTD.

15%
10% of all rental income for the duration of the contract (and subject to the rental client
having paid) shall be paid to Hua Hin Property Search Ltd.
A minimum charge of 4,500 baht applies to this contract.

Short term rentals: Payments taken for rent on your property by our company will be
transferred at the end of the term with any utility payments made by rental client.
For long term rentals : First months rent paid when client moves into property then any
further payments transferred at 3 month intervals unless otherwise agreed at the time of this
agreement.

Please ensure you have supplied your correct Thai bank account details.

OUR SERVICE

Our company agrees to help find suitable tenants for your property. HHPS will feature your
property within our shop/s and website and periodically within local media and using our
internet paid adverts. Our company will contact you directly and request permission to view
your property unless otherwise agreed. We will also not finalize any agreement with a rental
client without your permission and full agreement. (we provide with this agreement a copy of
our standard client rental agreement for your information)
You can at any time ask for a copy of the agreement signed by a rental client that is staying
at your property.
Damages caused by our clients will be borne by our company to the maximum value of the
security deposit taken.
Hua Hin Property Search Ltd. is not responsible for damage caused by Fire or Water or any
theft from outside parties. We recommend you take out a separate insurance policy to cover
theft or damage caused to your property. Accidents to tenants whilst staying at your property
are also not the responsibility of Hua Hin Property Search Ltd. (This is stated within the
rental clients agreement that they sign before taking possession of your property).

Property Owners Responsibility

It is the property owners responsibility to ensure their property is kept in a good state of
repair and suitable for the purpose of rental and the property complies to the law respecting
health, safety and housing regulations. It is the property owners responsibility to ensure our
company is kept aware of any other key holders and any changes of contact address or
telephone numbers. Damages caused whilst the property is vacant or in the care of a non-
contract signing rental client to Hua Hin Property Search Ltd. are the property owners
responsibility. Laundry costs and cleaning costs are the property owners. (Although we can
sometimes provide such services they do not apply to this agreement and shall be part of
another contract if required).

Here is a summary of how rental contracts work for your information. 

For reservation/deposits
paid by rental clients.. we hold this payment on behalf of tenant until they arrive.
We do this because there has been times when a customer has arrived and a property is
not ready/available and we have had to return the reservation fee. Obviously once a
customer arrives and checks in any rental money already paid belongs to the property
owner. If clients do not arrive or cancel their booking after reservation payment made the
reservation payment is shared with the property owner in accordance with the contract
signed.

Damages deposits are always held by Hua Hin Property Search and returned to the rental
client on check out (after we have inspected and if no damage)

For rental income

For rental periods over 3 months.


Any rental money already taken is passed to the owner when the tenant arrives less
commission. We then pass the further payments less commission inline with the payments
we receive. Note: We deduct our 15% commission from all payments of rent for the
contract taken. 
2 month rentals can be paid in two installments however we prefer to transfer one single
payment upon the rental client checking-out.

For periods of one month or less we pay rental to the owner at the end of the rental period
once we have collected that periods electricity cost from rental client. 
We do this to save transferring income twice. 

Minimum charge from Hua Hin Property Search.


There is a minimum commission charge of 4,500 baht on rental contracts taken. So if 15%
of the total rental amount commission is less than 4,500 baht then this amount is still
charged to the property owner by Hua Hin Property Search.

Check out 
Cleaning is not charged to customer as extra. If property owners would like us to charge
extra for cleaning on checkout they need to add to the total price when we considering the
rental cost to charge. We will always check with property owners before agreeing final
price with clients unless otherwise agreed.. As part of the rental income this is also subject
to 15% collection/commission charge.

Utility payments
We suggest owners do not charge for water for rentals of less than 3 months. Over 3
months can be charged at cost. This should be made clear when you fill in the contract
details.
We suggest owners always charge electric (at cost).
Hua Hin Property Search reads electric meters upon arrival of customers and collects
appropriate costs on behalf of the property owner. Final payments will be made on check-
out of rental client.
