Background

1. The Applicant filed an RTI application dt.29.11.08 with the CPIO, DoP,
Bijnour. He requested for reasons for his promotion being denied to him after
his service of 26 years. The CPIO replied on 1.1.09 stating that the DPC
meeting for the BCR was held after the Applicant retired from service. . Not
satisfied with the reply, the Applicant filed an appeal dt.28.1.09 with the
Appellate Authority stating that he received the information late. The
Appellate Authority replied on 6.3.09 stating that information was sent to the
Appellant a second time on 14.1.09 and that there was no delay in furnishing
the information. Aggrieved with this reply, the Applicant filed a second
appeal dt.30.5.09 before CIC complaining about the delay in furnishing the
information.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the


hearing for August 13, 2009.

3. Mr.Rameshwar Dayal, SPOs; Mr.Wardev Singh, PRI(P); Mr.Krishan Chandra,


ASP; Mr.Anil Kr. Singh, represented the Public Authority.

4. The Applicant was not present during the hearing.

Decision

5. The Respondent submitted that the DPC meeting for BCR was held after the
Appellant’s retirement and therefore his name could not be included in the
promotee’s list. He stated that although the CPIO sent the information well
within the stipulated period, he received a letter from the Appellant dated
9.1.09 stating that he did not receive the reply to his RTI request and that the
CPIO sent the information once again by registered post on 14.1.09. He
added that there is no provision in the RTI Act which indicates that RTI replies
should be sent by Registered/Speed Post and that his office sends the
information by ordinary post since the CPIO has not received any
instructions about mode of dispatching RTI information. He also added that it
is not clear who is to be held responsible if RTI information is lost in
transmission when sent by ordinary post. He also added that the RTI register
maintained by his office has a record of the date of receipt of RTI request
and the date on which the CPIO had dispatched the information by ordinary
post, the first time.

6. The Commission holds that complete information has been provided to the
Appellant and directs the CPIO to send a copy of the relevant page from the
RTI register indicating the date of dispatch of information the first time, to the
Appellant, by 15 September, 2009 and accordingly disposes off the appeal.
