Deed of Heirship and Sale - Estinopo
This DEED is entered into and executed by, TEODORO BANQUERIGO, of legal age,
Filipino, married to Rosita Salamanca, and resident of barangay San Antonio, Sibulan, Negros
Oriental, hereinafter called the HEIR-VENDOR, in favor of,
FRANCISCO MORTE ALAP-AP, also of legal age, Filipino, married to Angelina Robiso,
and a resident of barangay San Antonio, Sibulan, Negros Oriental, hereinafter referred to as the
VENDEE;
WITNESSETH:
That Fortunata Calugcugan died intestate sometime in 1975, leaving without any
testamentary will nor debts not settled until the present and upon her death she was survived by
her legitimate and only compulsory heirs, namely: TEOFILO, CECILIA, AREOPAFITO,
MAGNO, LEONORA, FELOMINA, and PERFECTO, all surnamed BANQUERIGO;
That the HEIRS of the late Fortunata Calugcugan had agreed verbally to partition the
aforementioned Lot No. 4069-B into several sublots and after the said partition they have
personally occupied and took possession of their respective shares;
That invoking the provisions of Section 1, Rule 74 of the Rules of Court, the heir-vendor
herein, Teodoro Banquerigo, does hereby settle and adjudicate unto himself that undivided
portion of the aforementioned Lot No. 4069-B, consisting of SIX HUNDRED SEVENTY FIVE
(675) square meters, more or less;

That the vendor herein declare that this land is not tenanted nor worked upon by an
agricultural lessee and that due notice has been given to all persons affected by this transaction
in compliance with the provisions of the New Civil Code of the Philippines, pertaining to the
rights of the redemptioner and preemptioner, but nobody opted to exercise the said rights and the
sale of these parcels land is in consonance with the provisions of the Comprehensive Agrarian
Reform Law because this parcel of land is within the retention limits of the vendor, further, the
vendor warrants her ownership over the said parcel of land and will defend the rights of the
herein vendee against any adverse claim whatsoever.

BEFORE ME, this ____day of February 2011, at Tayasan, Negros Oriental, personally
appeared the Vendee and the heir-vendor herein, who exhibited their respective Com. Tax
Certificates, as printed below their names shown above, both known to me to be the same
persons who executed the foregoing deed, consisting of two (2) pages, including this page of
acknowledgement and that all pages were duly signed by the parties herein, together with their
two instrumental witnesses and that they acknowledged to me that the same is their free act and
voluntary deed.
