ENTITLED

BARANGAY ORDINANCE PROVIDING FOR FEES ON AMBULANT VENDORS, PEDDLERS, STREET


VENDORS, & MARKET MERCHANDISERS WITHOUT STALLS

Upon the initiative of Punong Barangay Antonio De Los Santos and on his motion, duly seconded by all
present Kagawad Members, the Sangguniang Barangay, after due deliberation, agreed that:

Barangay Ordinance Number 12-2020

Whereas, it has been the declared policy of the state to pursue an all-out war against poverty and improve
the quality of life of every Filipino including vendors and their consumers

Whereas, the Presidential Executive Order No. 452 (24, October, 1997) and its implementing rules and
regulations provide for guidelines to ensure the security of registered vendors in their workplaces, indicating
that inter alia, vendors shall not be arbitrarily deprived of their livelihood by being unjustly ejected from their
workplaces nor have their stall demolished.

Whereas, within all the benefits given to them, they are required to pay for a certain barangay fee which
are to be collected and forwarded to barangay treasury.

NOW, THEREFORE,

Section 1: Short Title: Vendor Registration And Security Ordinance

Section 2: Definition: For the purpose of this Ordinance, unless otherwise indicated, the following terms
shall be constructed to mean as follows:

Ambulant Vendors or Peddlers: refer to vendors who are plying their trades within the vicinity in search for
buyers

Market refers to a public place, whether privately or publicly owned where the act of buying and selling
takes place

Registered Vendors are vendors who currently undergo legal transactions and paid a certain fee to the
Barangay

Illegal vendors are vendors who sell their products without paying for a certain brgy transaction fee.

Section 3: Creation and Composition: Vendor registration and Security Council composed of the
following:

Chairperson: Punong Barangay


Members:

All Barangay kagawads

BPAT

Section 4: Functions: The Vendor registration and Security Council shall perform the following functions

1. Formulate policies and inspection activities that will accord protections and security to registered
vendors and peddlers.
2. Enforce security avoiding theft, and robbery which hinders vendors from selling their items within
the vicinity of the barangay roads
3. Conduct regular surveys on vacant areas for vending
4. Monitor and ensure that order and discipline is maintained within the vicinity of the targeted areas.

Section 5. Fees and registrations: Vendors are subjected to fees amounting to as low as 50 pesos per
day to as high as 150 pesos per day depending on the marketable products and items.

Section 6. Receipts and Proof of payments. Upon paying for a certain amount of fee, vendors are to be
given with legal Barangay receipts which they can show to checkers as proof of their legality.

Section 7: Responsibilities of Vendors: Registered street vendors and peddlers without stalls must
observe all Barangay Laws, Ordinances, rules and regulations with respect to health and sanitation, public
safety, environment, transport and traffic management.

a. They are also required to keep their workplaces clean through proper waste segregation and
disposal methods.
b. Ensure unobstructed flow of vehicles and pedestrian traffics.
c. Provide for calibrated weighing scales, including compliance to price control and price tag laws

Section 8: Violations: Failure to comply to rules, regulations, and other responsibilities will result to
following fees and penalties.

First offense: P500.00

Second Offense: P1000.00

Third Offense: P2500.00

Fourth Offense: P3500.00 / 5 hour detention in Brgy Tanod OUTPOST JAIL / Banned from selling
within the vicinities of the Barangay.

SECTION 9. REPEALING CLAUSE. - All provisions of local ordinances, orders, and resolutions
inconsistent herewith are hereby repealed and/or modified accordingly.

SECTION 10. SEPARABILITY CLAUSE. - If for any reason any part of this ordinance shall be held
unconstitutional or invalid, other parts hereof which are not affected therby shall continue to be in full force
and effect.

ENACTED by the Sanggunian Barangay of Laslasong West, in its regular session held on 2nd day of
February 2019.
