SUMMARY

What is Fair Use, Copyright Law, and Creative Commons?


Fair use is a legal principle that is able to put limitations on copyrighted materials. If

under fair use, one can make copies without the copyright owner’s permission for things

like teaching or reporting news.

A copyright is an owner’s right to have complete control over a creation. This control

includes the right to profit from others using the work and the sale of the work.

Everything from pictures to videotapes can be copyrighted.

Creative Commons is a nonprofit organization that allows the sharing and use of

creations through free legal tools. It gives the owner the opportunity to give the public

permission to utilize their work. The creator can determine if they want “all rights

reserved” or “​some rights reserved​.” depending on what they want to do.

What is the four Factor Test?


The Four Factor Test is a four-question assessment that can help determine if
the use is fair.

1. What is the purpose and character of the use?


2. What is the nature of the work
3. What is the amount and substantiality of the portion used in relation to the work
as a whole?
4. What is the effect of the use on the market or potential market for the original
work?
What are the consequences when you violate copyright law?
According to the Purdue University Copyright Office, the consequences of violating the
copyright law are:

Infringer pays the actual dollar amount of damages and profits.

The law provides a range from $200 to $150,000 for each work infringed.

Infringer pays for all attorney fees and court costs.

The Court can issue an injunction to stop the infringing acts.

The Court can impound illegal works.

The infringer can go to jail.

How will you uphold the laws and guidelines?


I will uphold the laws and guidelines discussed above by paying close attention to what I am

using in my future classroom. I will be sure to only make copies of fair use items such as

worksheets and I will always cite other’s work. I will never record videos of movies or tv shows

to show my students.
