NOTICE TO THE PUBLIC

Recognizing the socio-economic impact of the Enhanced Community


Quarantine (ECQ) due to COVID-19, the government has directed the different
national government agencies to implement social amelioration measures to
help ease the struggle of Filipino families by providing necessary assistance to
affected sectors, including the construction sector.

The DWSD and DOLE, in coordination with the DoF, DBM and DTI, have
implemented policies and programs for the social amelioration of affected
workers, which include moratorium on lease rentals, advancing a pro-rated
13th month pay, reprieve in utility bills, and assistance to micro, small and
medium-scale enterprises. In addition, the DSWD is further directed to
institute measures to expedite the distribution of food assistance to affected
residents of the entire Luzon.

On the other hand, the DOH is directed to provide the public of any and all
information on steps and measures to be undertaken relative to the COVID-19
situation.

In line with this, Joint Memorandum Circular No. 1, s. 2020 was issued by the
following agencies: DILG, DBM, DOLE, DSWD, DA, DTI, and DOF, to
prescribe Special Guidelines on the Provision of Social Amelioration Measures
to the most affected residents of the areas under Enhanced Community
Quarantine. The full copy of the JMC can be accessed thru this link.

The following are the assistance programs applicable/relevant for affected


stakeholders in the construction sector, in reference with aforementioned JMC
No. 1, s. 2020. Please refer to the list below of programs by which construction
companies/contractors can avail, to assist their business and their employees,
especially construction workers, mitigate the effects of ECQ:

A. For Informal Economy Workers (e.g. Construction workers)

As mentioned in Section 5.7.8 of JMC No. 1, s. 2020, informal economy
workers are among the priority/intended beneficiaries of government’s
amelioration/assistance programs. Stakeholders in the constrcution sector
include: directly hired or occasional workers (Sec. 5.7.8.1), subcontracted
workers (Sec. 5.7.8.2), employees affected by “no work, no pay policy” (Sec.
5.7.8.10), and stranded workers (Sec. 5.7.8.11), among others.

The following are the programs that can be availed by employers for their
affected construction employees:

1. COVID-19 Adjustment Measures Program (CAMP) - 1 DOLE’s


safety net program for affected workers in the formal sector to mitigate
the adverse economic impacts of reduction of income brought about by
the COVID-19 pandemic. The program components include a one-time
financial assistance of Five Thousand Pesos (PhP 5,000.00) and
employment facilitation. (Sec. 5.8)
a) A one-time financial assistance equivalent to Five Thousand
Pesos (PhP 5,000.00) shall be provided to affected formal sector
workers in lump sum, non-conditional, regardless of employment
status. (7.4.1)
b) Procedural Guidelines (7.4.2.)
i. Eligibility - Applicant must be a private establishment that has
implemented FWAs or temporary closure due to the COVID19
pandemic. (7.4.2.1)
ii. Documentary Requirements - Affected establishment must
submit: (a) Establishment Report on the COVID-19 pursuant to
Labor Advisory No. 09, Series of 2020; and (b) Company
Payroll for the month prior the implementation of FWAs or
temporary closure. (7.4.2.2.)
iii. Application Procedures - Applications with complete
documentary requirements shall be submitted online to the
appropriate DOLE Regional Office or any of its Provincial/Field
Offices. Applications shall be evaluated by the concerned
DOLE Regional Office within three (3) working days from
receipt thereof. (7.4.2.3.)
a) A Notice of Approval, for an approved application; or,
a Notice of Denial for a denied application shall be
issued to the applicant by the concerned DOLE
Regional Office within three (3) working days through
electronic mail from the date thereof. (7.4.2.3.1.)
b) The concerned DOLE Regional Office shall issue the
financial support directly to the beneficiary’s payroll
account through bank transfer at the soonest possible

time upon receipt of complete documentary
requirements. For cash payroll, financial support shall
be received through money remittance. Upon receipt
of financial support, a Notice of Completion shall be
issued to the affected establishment within three (3)
working days through electronic mail. (7.4.2.3.2.)

Companies who have already submitted requirements to DOLE may wait for
the updated list of approved companies from its website. For CAMP-related
inqueries, you may visit DOLE’s website for their updated directory through
this link.

2. Small Business Wage Subsidy (SBWS) Program - The Department


of Finance (DOF) will provide a monthly cash assistance from P5,000
to P8,000 based on the monthly regional minimum wage for two
months to qualified employees.
a) ELIGIBILITY
i. Who are eligible?
1. Small business who are:
- compliant with BIR and SSS regulations
- not listed in BIR’s Large Taxpayers Service
- temporary closed / suspended operations or required to
operate only with skeletal workforce
2. Worker who are:
- employee of an eligible small business (regular,
probationary, regular seasonal, project based, fixed term)
and certified by the employer
-an active employee of the small business until March 1,
2020 and did not receive wage for two weeks or more due
to closure of the company
- employees who already received DOLE CAMP
assistance may still avail but is qualified only for the first
month
ii. Who are not eligible for SBWS?
1. work from home employees or part of skeleton workforce
2. employees on leave (with or without pay) during ECQ
3. employees receiving SSS unemployment benefits due to
COVID-19
4. with unsettled or in-process SSS final claims (i.e.
retirement, death, etc)
b) APPLICATION PROCESS
i. The employer shall visit BIR webpage and click the SBWS icon
to verify if the small business is eligible.
ii. Enter the 9-digit employer Tax Identification Number (TIN) in
the search field. (refer to the Certificate of Registration)
iii. If qualified, a green prompt notification will appear on screen
and copy the passcode provided. (If not qualified, a red prompt

notification will appear on screen and send your query
at [email protected].)
iv. Go to the SSS portal www.sss.gov.phand log-in to your
My.SSS account.
v. Click the “Small Business Wage Subsidy” tab. Enter the
passcode and employer TIN to see the list of employees.
vi. Select the list of employees who are eligible (if not CAMP
beneficiaries)
vii. Enter the TIN of each of the qualified employees.
viii. Read carefully the SBWS Employer’s Undertaking and click
the “I Agree” tab.
ix. After filling up the application, the employer must submit the
following supporting documents to any SSS branch or email
to [email protected]:
- Certification Attesting to the Work and Pay Status of
Employee
- Notice submitted to DOLE for the flexible work arrangement
adopted per Labor Advisory 9-2020
- Establishment Report on CO14D per Labor Advisory 12-2020
(Non-submission of proof of work and pay arrangement shall
not toll the processing of application for the wage subsidy).
x. The SSS system will validate the information provided and will
confirm the qualification of employees.
xi. An email notification will be sent by SSS to the eligible
employees that their employer confirmed their qualification for
the SBWS program.
xii. SSS will notify the employer of the successfully confirmed
employees for SBWS Module
c) DISBURSEMENT
i. First tranche is from May 1 to 15, 2020
ii. Second tranche is from May 16 to 31, 2020.
iii. The schedule may change depending on the timing of the
ECQ.
iv. This will be disbursed through:
-SSS UMID card enrolled as ATM;
-PESOnet participating banks;
-Union Bank Quick Card;
-Electronic wallets such as PayMaya; or
-Cash pick-up through remittance partner agents.
d) APPLICATION PERIOD
i. Employers may apply from April 16 to 30, 2020.
e) CONDITIONS FOR EMPLOYERS AND EMPLOYEES
i. Employees who will receive the subsidy cannot be relieved
from work.
ii. Employees cannot resign during the ECQ period.

B. For Affected Business Owners

Affected employers/ businesses may also opt to avail following


assistance/services:

1. Micro, Small and Medium Enterprises - Any business activity or


enterprise engaged in industry, agribusiness and/or services, whether
single proprietorship, cooperative, partnership or corporation whose total
assets, inclusive of those arising from loans but exclusive of the land on
which the particular business entity’s office, plant and equipment are
situated, must have value falling under the following categories: a) Micro :
Not more than PhP 3,000,000 b) Small : PhP 3,000,001 - PhP 15,000,000
c) Medium : PhP 15,000,001 - PhP 100,000,000

2. COVID 19 Pondo Para sa Pagbabago at Pag-Asenso Enterprise


Rehabilitation Fund (P3 - ERF) - A One Billion Peso
(PhP1,000,000,000.00) special financing program by the Small Business
Corporation (SBCorp) of the Department of Trade in Industry (DTI) for
MSMEs affected by COVID-19. (Sec. 5.14)

3. Pondo sa Pagbabago at Pag-Asenso (P3) - A financing program


established by SB Corporation for micro enterprises with an asset not
exceeding Three Million Pesos (PhP 3,000,000.00) at not more than 2.5
percent per month all-in interest rate and service charges. (Sec. 5.15)

4. Moratorium on loan payment for SB Corporation borrowers - Refers to
payment moratorium which can be granted to borrowers affected by
COVID-19 under regular and P3 loan programs of SB Corporation. (Sec.
5.16)

5. Landbank I-RESCUE Lending Program - The I-RESCUE Lending


Program is LANDBANK’s support program for the SMEs, cooperatives,
and microfinance institutions (MFIs) which are affected by the economic
impact of the CoVid-19 pandemic to the country. The program will provide
interim measures to help SMEs, co-ops and MFIs through provision of
additional funds and by loan restructuring under more flexible terms and
conditions. I-RESCUE supports RA 11469, also known as the “Bayanihan
to Heal as One Act.”
a) Availability Period: up to December 31, 2020
b) Program Fund: Php10 Billion Initial Internal Fund
c) Types of Credit Assistance:
i. Rehabilitation Credit Programs for SMEs

DETAILS:
- Emergency fund for working capital
- Credit Facility Term Loan
- Loanable Amount Up to 85% of actual need provided the total
loan exposure (including the existing loans) shall be within
repayment capacity of the borrower as per LANDBANK
computation
- Loan Tenor Up to five (5) years with maximum two (2) years
grace period on the principal payment depending on cash flow
- Documentary Requirements Pre-Processing:
1. Accomplished Loan Application Form (with pictures, if
applicable)
2. Securities and Exchange Commission (SEC) /Department of
Trade and Industry (DTI) – certified or Corporate Secretary-
certified true copy of the SEC / DTI Certificate of Registration,
Articles of Incorporation and By-Laws
3. Corporate Secretary-certified true copy of the duly notarized
certificate confirming the resolution of the Board of Directors
and/or committees or bodies authorizing the application for
LANDBANK loans and specifying the authorized signatories
4. Valid certificates/permits/licenses/clearances from concerned
government agencies
5. Audited F/S for the last three (3) years plus the current year F/S
6. List of key officers of the firm
7. Client Information and Signature Specimen Card and at least
one valid/government ID such as but not limited to unexpired
passport, Social Security System, Government Service Insurance

System or driver’s license
8. Tax Identification Number Note: Applicable only if the
above-listed documents are not on-file.

ii. Rehabilitation through Loan Restructuring

DETAILS:
- Loan Purpose Restructuring of existing loan account via
additional loan, extended repayment period, or other means (or
combination of means) to enable existing borrowers to rehabilitate
and restore operational cash flow
- Loan Tenor: Up to maximum of ten (10) years with up to three (3)
years grace period on principal and one (1) year grace period on
interest depending on cash flow
Rehabilitation through Loan Restructuring Note: The deferred
interest shall be non-interest bearing and shall be amortized
equally either monthly or quarterly within three (3) years inclusive
of one (1) year grace period.
