COMMITTEE REPORT
Re: 1) Proposed Resolution Adopting Republic Act No. 9484 otherwise

known as “An Act to regulate the practice of dentistry, dental hygienene
and dental Technology in the Philippines; and;
2) Proposed Ordinance prohibiting the illegal practice of dentistry

within the city of Masbate and prescribing penalties for violation thereof.
The matter was referred to the said Committee during the instance of the
23rd Regular Session dated December 03, 2019 hence, the Committee
Hearing by the Committee on Health and Sanitation on January 17, 2020 @
Legislative Bldg., City Hall Compound, City of Masbate. Present during the
hearing were members of the Committees, Dentistry Practitioners in the
City and the Secretariat.
FINDINGS/ COMMENTS:
The State recognizes the importance of dentists, dental hygienists

and dental technologists in nation-building. operating dental practices
without certification, registration and professional identification card and
without validly-issued permit is a blatant violation of Section 33 of RA
9484;
The City Government of Masbate recognizes that the improper
sanitation practice may lead to infections such as Hepatitis C, Acquired
Immuno Deficiency Syndrome (AIDS) and other infection-related diseases;
In view of the foregoing, the City Government of Masbate through

the 7 City Council deemed it necessary to adopt RA 9484 and further
support the Philippine Dental Association (PDA)’s campaign against fake
and illegal practices of dentists since their concern is the sanitation of the
dental practice and apparatuses and safety of the patients. Further, to have
a permanent measure to regulate the practice of dentistry in the City, hence
this proposed ordinance.
Below are the suggestions/comments during the deliberation, to wit:

Dr. Magbalon, the President of the Philippine Dental Association-Masbate Chapter
complimented the 7th City Council for legislating measures to prevent illegal practice of Dentistry in the City
to the detriment of the Masbatenos.
On Section 3 (c), Definition of Terms, it was suggested to add the Department of Health
Memorandum Order allowing dental technologist to render technical services such as mechanical
construction of artificial denture and other oral devices by experience, as determined by the Department.
On Section 4, Prohibited Acts, it was suggested to add a provision stating therein that dental
technologists may render technical services but limited only to the mechanical construction of artificial
denture and other oral devices by experience, as determined by the Department subject to the direct
supervision of a licensed dentist.
On Section 5 Penalties, it was suggested to increase the penalty prescribed for 1 st Offense to
Php 2,500; 2 Offense to Php 3,500; and for the 3 rd Offense to Php 5,000 or an imprisonment or both, at the

discretion of the court. Likewise, it was suggested to also add a colatilla emphasizing that the penalty
imposed by the proposed ordinance is in addition to the penalty imposed by the national law.
RECOMMENDATION:
After thorough deliberation and careful study of the proposed ordinance and resolution, Committee
hereby recommends that all suggestions made be considered for the refinement of this proposed
ordinance.
Likewise, I move for the passage of a favourable resolution Adopting Republic Act No. 9484
otherwise known as “An Act to regulate the practice of dentistry, dental hygienene and dental Technology
in the Philippines.
Moreover, I move for the elevation of the proposed ordinance prohibiting the illegal practice of
dentistry within the city of Masbate and prescribing penalties for violation thereof to the Second Level of
Discussion next regular session.
Further, I move for the ADOPTION of this Committee Report.
