Let’s Analyze

Activity 1. Read the following news article and answer the questions at the end of
the story.

News article

Riam Dean, 22, was working at Abercrombie & Fitch (A&F) and claimed she was
removed from the shop floor when management became aware of her disability.
Riam was born without her left forearm and wears a prosthetic limb.

Riam told A&F about her disability after she got the job and they agreed that she
could wear a white cardigan to cover her prosthesis. However, she was later told
that the she couldn’t work on the shop floor wearing the cardigan and that she
should work in the stockroom until the winter uniform arrives. They claimed it didn’t
fit their ‘looks policy’.

Riam said: "I had been bullied out of my job. It was the lowest point I had ever
been in my life."

"I knew then that I was being treated different and unfairly because of my
disability. Her words pierced right through the armor of 20 years of building up
personal confidence about me as a person, and that I am much more than a girl
with only one arm… "

"I am born with a character trait I am unable to change, thus to be singled out for a
minor aesthetic 'flaw' made me question my worth as a human being.

"Abercrombie taught me that beauty lies in perfection, but I would tell them that
beauty lies in diversity, for I would rather live with my imperfection than to exude
such ugliness in their blatant display of eugenics in policies and practices."

1. Identify the negative and discriminatory behavior in the article and indicate what
type of discrimination is taking place in the scenario.

Riam claimed that she was removed from the shop floor when management became
aware of her disability. Riam was born without her left forearm and wears a
prosthetic limb other than that Riam also experienced bullying and unfair treatment
due to her disability. This fall on Disability Discrimination of R.A No. 7277 as actions
were made due to its disability and later knew that the said company is aware of the
said disability and agreed to a specific deal on wearing a clothing to cover
prosthetics

2. Discuss the short and long term consequence of this discrimination. Include the
government legislation that protect the rights of the person being discriminated.

This discrimination humanely affect the victim’s morale as she was left personally
diminished and humiliated. This will not only end on facing some regulatory bodies
that implies the done act and to be fined. This actions can also lead to a downgrade
of the firm as this displays an inhumane act to the victim. The Disability
Discrimination of R.A No. 7277, as amended, shield staff and work seekers from
discrimination on the basis disabilities. This legislation extends to eligible workers
and job seeker with disabilities to ensure that no one is denied their rights to provide
equality.

3. As an HR practitioner, how would you address this issue?

In this issue the key to this is awareness. Mentioned above that upon hiring Ms.
Riam they are firmly aware of her disability and formally asked for mere adjustments
for her which wants to wear a cardigan to simply cover her prosthetic arm.
Addressing this issue to prevent the firm to face this serious instances
accommodating staffs with disabilities by providing adjustments to address the
needs of an employee. Since what really matters is the skills needed to provide the
needed work. Showing support is probably the single most thing I can do for
employees who have a disability. Demonstrating that you appreciate their needs by
making reasonable adjustments is the first step towards showing your support.
A disciplinary actions will also help to address the internal discriminating and bullying
issues of the firm and making them aware of their own words and actions. Ensuring
also a anti-discrimination policy to let them know the any discriminatory practices will
be-condoned.
