1. SHIPPING TERMS –CFR FO CQD

Discharge Rate: CQD

100% detention to apply (equivalent to vessel demurrage rate in USD per Day) in case if
vessel:

a) Miss her seniority/berthing due to non-readiness of cargo and/or cargo documents


(including switching of BL) by any of the receivers.
b) Space constraints/hook idiling/delay in placement of trucks/trailers, etc.

Detention to be agreed/reimbursed (against raised invoice) within 30 days after


completion of discharge.

1.1. Buyer to discharge cargo basis all cranes working at a time at discharge port,
without any hook idiling.

1.2.In the event that the Buyer fails to load the cargo within the allowed laytime, the
Buyer shall pay the Seller for demurrage at the rate to be informed by Seller to Buyer
at the time of Vessel nomination. In the event that the Buyer discharges the shipment
at the rate in excess of the guaranteed discharge rate, the Seller shall pay the Buyer
for despatch which shall be at the half rate of demurrage. The agreed despatch/
demurrage money shall be settled within thirty (30) days from the date of completion
of loading of the cargo at load port and finalization of clean laytime calculations,
basis SOF (Statement of Facts).The laytime to be shared by the Buyer with Seller for
review and confirmation.

The rate of demurrage shall be confirmed by the Buyer to the Seller at the time of
vessel nomination and must be as per the prevailing market conditions.

1.3. Discharge port agent will be nominated by the Seller and appointed by owners.

1.4.The following terms regarding laytime calculation shall be applicable:

1.4.1. Notice of Readiness shall be tendered on arrival ATDN SSHINC wwww , whether in
port or not, whether in berth or not, whether customs cleared or not, whether in
free pratique or not.

1.4.2. The time allowable for loading shall be calculated on the basis of the Bill of Lading
quantity.

1.4.3. Laytime shall commence twelve (12) running hours (Turn Time) after the Notice of
Readiness (NOR) has been tendered. UU basis. Laytime shall cease to count upon
completion of loading operation at the load port,. Vessel to load from one berth only
Time to continue to count in case of any vessel shifting and/or waiting for shifting to
another berth.

1.4.4. Time and cost of first shifting at Dischage port from anchorage to berth will
be on buyers account. Any additoinal shifitng will be on Buyers Account and all
such time to count.
1.5. The following shall not count as lay time at discharge port (once on demurrage
always on demurrage to apply)

A. Time shifting from anchorage to loading berth (First Shifting), commencing when
anchor is lifted and ceasing when all fast at designated berth. Shifting time to
count from Pilot on Board time.

B. Time lost due to delays caused by vessel or its crew members, whether such
situation existed at the time of tendering NOR.

C. Time lost for initial and final draft surveys, and vessel draft checks requested by
vessel, if any.

D. Time lost due to severe/bad weather causing unsafe equipment operating


conditions as determined by the loading Port duly mentioned in SOF.

E. Time lost if vessel has to stop loading due to vessel problems.

F. First opening and last closing of hatches.

G. Time lost due to vessel’s non-compliance with regulatory requirements

H. Any force majeure event declared as per Contract,

1.7 Stevedore Damage: If Any, to be settled directly between vessel owner/stevedores/


Buyer without any seller interfrence .
