JUDICIAL AFFIDAVIT
I, NICOLE G. CRUZ, 11 years old, Filipino and a resident of

San Vicente, Panabo City, Philippines, assisted by counsel after
having been duly sworn to in accordance with law, hereby depose
and states:
PRELIMINARY STATEMENT:
The person conducting this direct examination consisting of

Question and Answer is Atty. Niño Angelo C. Etulle with office
address at San Francisco St., Panabo City.
I am answering all these Questions fully conscious and aware

that I do so under oath and may face criminal liability for False
Testimony and Perjury for any false statements taken under oath.
QUESTIONS were propounded by counsel, in Visayan dialect,

which the affiant fully understands, while ANSWERS were
given/made by Nicole G. Cruz in Visayan dialect and the
corresponding translation of her answer is provided in each question.
PURPOSE:
The testimony is offered for the following purposes:
(1) To prove that ROBERTO S. CRUZ on February 03, 2021

and February 04, 2021 respectively committed the acts
constituting rape against complainant;
(2) To prove that ROBERTO S. CRUZ threatened the

defendant by the use of a knife, that he will harm her and

her family if she will report to her parents the bestial acts
committed on her;
(3) To prove that ROBERTO S. CRUZ is the uncle of the

complainant, being the sibling of her father;
(4) To prove all other matters as may be discussed in the

judicial affidavit.

QUESTION 1:
Unsay imong pangalan, edad ug pinuy-anan?
ANSWER:
Ako si NICOLE G. CRUZ, onse anyos ug naka puyo sa San

Vicente, Panabo City, Davao del Norte.
(I am NICOLE G. CRUZ, eleven (11) years old, and a resident

of San Vicente, Panabo City.)
QUESTION 2:
Unsay tuyo nimo ngano naa man ka diri karon sa opisina?
ANSWER:
Sir, para magsaysay sa nahitabong pagpanglugos kanako

niadtong Pebrero 4, 2021 sa amoang balay sa akong uyuan nga si
ROBERTO S. CRUZ.
(Sir, to narrate the events that took place last February 4,

2021when my uncle ROBERTO S. CRUZ raped me at our
residence.)
QUESTION 3:
Unsay may nahitabo?
ANSWER:
Sir, adtong gabie sa Pebrero 4, 2021, ang nabilin sa amoang

balay kay ako ra ug akong uyuan kay wala man akong ginikanan
adtong gabhiona.

(Sir, on the night of February 4, 2021, the only ones left at our
house was my uncle and me because my parents were out that
night.)
QUESTION 4:
Asa man diay imong ginikanan atong gabhiona?
ANSWER:
Niadto sila ug lamay sa Tagum Sir, kay naa mi parente

namatay.
(Sir, they went to Tagum City since we had a relative who

passed away.)
QUESTION 5:
Unsa may nahitabo?
ANSWER:
Niuli akong uyuan nga si ROBERTO S. CRUZ pasado alas

otso sa gabii nga hubog unya nangutana sya nako asa akoang papa
ug mama.
(My uncle ROBERTO S. CRUZ went home drunk and he asked

me of the whereabouts of my parents.)
QUESTION 6:
Paghuman?
ANSWER:
Giingnan nako sya nga niadto silag Tagum kay nakiglamay sa

amoang paryente. Gitubag ko nya ug awh maayo human ningisi sya
ug nitutok nako.
(I told him that they went to Tagum City to attend the wake of
our relative. He then replied ok and smiled and stared at me.)
QUESTION 7:
Unsa may sunod nahitabo?
ANSWER:

Wala lang nako sya gipansin ug nisulod na sya sa iyang
kwarto. Paghuman nakog tan aw tv mga alas 10 sa gabii nisulod
nako sa akong kwarto para matulog.
(I did not mind his actions and he then entered his room. At
around 10pm after watching tv, I entered my bedroom to sleep.)
QUESTION 8:
Paghuman?
ANSWER:
Nakatulog nako ato taod taod human nakamata nalang ko kay

nabatian nako naay nakapatong nako ug nakapanimaho pud kog
ilimnon.
(After a while, I was already asleep when I felt that someone

was on top of me and I smelled the smell of liquor.)
QUESTION 9:
Unsa pay nahitabo?
ANSWER:
Giingnan nako sya “Unsa mani kol?!!” Gitubag ko nya ug

pagbigyi ko ayaw pagsaba human naa sya gikuha sa iyahang likoran
ug nakita nako nga kutsilyo kadto. Iya kong gitiunan human niingon
sya “Ayaw pagsaba sa imohang mama ug papa kung di patyon tamo
tanan.”
(I told him “What are you doing?” He then replied “Give in to

what I want!” He then got something form his behind which turned out
to be a knife. He threatened me with it and told me “Don’t tell your
mother and father about this or I will kill all of you.”)
QUESTION 10:
Wala diay ka nisyagit?
ANSWER:
Wala Sir, kay nahadlok kog pagmaayo sa kutsilyo nga iyang
gition kanako ug sa iyang bahad nga pamatyon mi nya sakoang
ginikanan ug musaba ko.

(I was not able to shout Sir since I was afraid of the knife he
pointed at me and I was afraid of his threat that he will kill me and my
family if someone will know about it.)
QUESTION 11:
Unsa may nahitabo sunod?
ANSWER:
Nihilak nako Sir sa kahadlok, ug iya nakong gihalok halokan

sakong liog ug tibuok lawas iyang gihubo sakong uyuan akong short
ug panty gi tilapan nya akong tibuok lawas ug pepe.
(I cried Sir, since I was very afraid then he kissed my neck and
all over my body and he removed my short and underwear and licked
my body and my vagina.)
QUESTION 12:
Sunod?
ANSWER:
Iyang gisulod ang iyang tintin sa akoang pepe Sir ug nagkiyod

kiyod sya nabatian nako ang hapdos ug sakit ug ni ingon ko “Ayaw
kol maluoy ka!”. Gitubag nya kog “Paghilom kundi dunggabon tika!”.
(He inserted his penis in my vagina and then he made a push

and pull movement, I felt pain and I told him to “Stop and to have
mercy on me.” He replied “Shut up or I will stab you!”)
QUESTION 13:
Paghuman unsay nahitabo?
ANSWER:
Pagkataod taod niundang sya Sir ug nabatian nako ang kasakit

ug nakita nako nagadugo akoang pepe.Giingnan nako nya mag ilis
na ug nga dili magsaba sa nahitabo. Nigawas sya sakoang kwarto.
Naghilak nalang ko ato Sir.
(After a while, he stopped and I felt pain in my vagina and I saw

blood on it. My uncle told me to get dressed and to never tell anyone
about what happened. He then went out of my room as I cried.)

QUESTION 14:
Paghuman, unsay imong gibuhat?
ANSWER:
Naghilak lang ko Sir ug wala nako mabantayi nakatulog na diay

ko. Pagmata nako buntag na ug naa na akong Mama ug Papa ako
gipamatian ug naa ba akong uyuan sa amoang balay. Sa dihang
nabantayan nako nga wala sya nityabaw ko ug gisaysay nako
sakoang Mama ug Papa ang nahitabo.
Ilaha kong gigakos ug nihilak sab sila ug gipangita sakong papa

iyang manghod kauban ang mga silingan apan wala na nila kini
makita. Giubanan ko sa akoang Mama sa police station para ma
report ug gikuha sa pulis ang akoang pahayag. Paghuman niadto mi
sa hospital aron i pa check-up ko.

(I just cried Sir and I did not notice that eventually I fell asleep.
When I woke up, it was already morning and my parents are already
around. I checked first if my uncle was around and upon realizing that
he was nowhere to be seen, I immediately went and hugged my
parents as I burst into tears, I narrated the dastardly acts committed
upon my person by my uncle. My parents hugged me and they also
cried, my father along with our neighbors looked for my uncle but
they can no longer find him.
My mother then accompanied me to the police station and the

police authorities took my sworn statement and thereafter we went to
the hospital and the physician examined me.)
QUESTION 15:
