 Instructions to the Applicants

1) The proposal completes in all respect, in three copies should be submitted along with
prescribed fee by using RTGS or NEFT systems, University E-payment Gateway or in the
form of Demand Draft drawn on Nationalized Bank in favor of The Registrar, MUHS, Nashik
and payable at Nashik before the last day of the October every year (Name & Address of the
trust should be written on the overleaf of the D.D. / RTGS / NEFT / University E-payment
Gateway Transaction Slips).
2) Each page of the proposal should be serially numbered and to be submitted in one box file
& two ring files only (The original should be in box file remaining two sets in ring file)
3) Before submitting the proposal, go through the Information Brochure and the existing
Perspective Plan available on MUHS web site. Also verify the checklist of documents and
ensure that all copies of supporting documents are enclosed along with the proposal
(Perspective Plan is applicable to all pathies.)
4) Proposal should be submitted only in person to the University before the last day of
October every year, the proposals sent by post or by private courier and received after
last working day of the October, will not be entertained.
5) Once the proposal is submitted to the University, no change in the proposal or documents /
no additional papers as supporting documents will be accepted by the University.
6) a) In order to promote undeveloped areas, proposals from those districts where no health
science college of any pathy is in existence will be recommended to the Government. The
proposals of any pathy of any college from the districts where that ‘pathy college’ is not in
existence will be recommended to the Government.
b) Also, considering infrastructure and availability of faculty, cities where Municipal
Corporation exists, one college for every Five lakh population will be recommended (for this
purpose proposals submitted within the radius of 30 kms. beyond Municipal Corporation
boundary will be considered in Corporation area.) This will be applicable for all the pathies.
If Essentiality Certificate is issued by the Government to the college which is not
recommended by the University, because of geographical restriction of Perspective Plan,
then Three times of prescribed fee will be levied by the University from such a college at the
time of grant of First Time Affiliation.
c) For rest of the district, Number of Colleges already existing within Municipal Corporation
areas will not be considered for that particular district. That means excluding Municipal
Corporation area (plus radius of 30 kms. beyond Municipal corporation boundary), that district
will be considered as separate unit. For such a separate unit i.e. rest of the district area
excluding Municipal Corporation area as defined above, a college per Five lakh population
will be recommended. This will be applicable for all the pathies. However if the same pathy
college exists in the Tahsil area where proposed college is located, then that proposal will
not be recommended.
If essentiality certificate is issued by the Government to the college which is not
recommended by the University, because of geographical restriction of Perspective Plan,
then Three times of prescribed fee will be levied by the University from such a college at the
time of grant of First Time Affiliation.

7) Do not submit the proposal if:

i) Applicant does not have its owned and managed running hospital in that particular
pathy as per respective Central Council / University norms.
ii) The 1st year requirements for the proposed college as per respective Central Council/
University norms are not fulfilled.
8) If the proposal is Not Recommended to the State Govt. by the University, fee will be
refunded as follow:-
(i) If Institute / College claim the refund within three years from the date of the issuance
of the letter by which the Non-recommendation is intimated, 50% of the amount of
the deposited fee will be refunded.
(ii) If Institute / College claim the refund after three years but before five years from the
date of the issuance of the letter by which the Non-recommendation is intimated, 30%
of the amount of the deposited fee will be refunded.
(iii) If Institute / College claim the refund after five years from the date of the issuance of
the letter by which the Non-recommendation is intimated, No Refund will be
permissible.
9) Institutions / Colleges those who had already applied in previous academic year for opening
of New Colleges / Starting of New Post Graduate Courses / Increase in Intake Capacity, but
could not obtain Essentiality / No Objection Certificate / Government Resolution (as
applicable) from Maharashtra Government for that particular Academic Year, should apply
every year for revalidation of the proposal by paying revalidation fee as prescribed in
Affiliation fee Notification No. 42/2017, Such proposals can be revalidated up to five
Academic Years (i.e. six years from the date of recommendation of proposal to the State
Government.) After Six years such proposals will be treated as closed and such institutes will
have to apply a fresh along with prescribed fee.
10) Those Institutions / Colleges who have received Consent of Affiliation of University in
previous Academic Year for opening of New College / Starting of New PG courses
/ Increase in Intake Capacity (UG & PG), but could not obtain Letter of Permission (LOP)
from Central Government within one year from the date of its issuance, should apply for
Extension of Consent of Affiliation by paying fee as prescribed in Affiliation fee
Notification No. 42/2017 for 1st year, 2nd year & for 3rd year. However those institutions /
colleges who have not received Permission from Central Government within 10 years from
the date of recommendations of proposal to the state Government, then that proposal will be
treated as closed and such institute / college will have to apply a fresh with prescribed fee.

 General Requirements for opening of new Health

Science Colleges “Degree courses”
(Based on the respective Central Councils & University Norms)
Note: - Before filling applications applicant should refer latest Respective Central
Council’s norms
Society / Institute / Trust who desires to open a new college of degree course must fulfill the
following criteria:-
A) Eligibility Criteria: - The following organizations shall be eligible to apply for permission to
set up degree colleges, namely:-
i) A State Government/Union territory;
ii) A University;
iii) An autonomous body promoted by Central and State Government by or under a
Statute for the purpose of medical education;
iv) Under Public Trust Act, 1950 (Charity Commissioner),
v) A society registered under the Societies Registration Act, 1860 (21 of 1860) or
corresponding Acts in States; or
vi) A public religious or charitable trust registered under the Trust Act, 1882 (2 of 1882)or
the WAKFS Act, 1954 (29 of 1954).
vii) Companies registered under company act may also be allowed to open medical
college.
B) Qualifying Criteria: -
The desirous Institute/Trust / Management should submit following documents along with
the application / proposal.
i) The aims and objectives of the constitution of the Society / Institute / Trust must have
mentioned about “Medical education is one of the objectives” of the applicant in case
the applicant is an autonomous body, registered society or charitable trust.
ii) A certified copy of resolution of management regarding opening of a new health
sciences college (mention pathy). The resolution regarding opening of a new health
science college should be on the letter head of Society / Institute / Trust mentioning the
names of the Proposer and secondar.
iii) Latest list of members of Executive committee of the Society / Institute / Trust.

 Requirements for Increase in Intake Capacity of Health

Science Colleges “Degree course”
(Based on the respective Central Council & University Norms)
Note: - Before filling applications applicant should refer latest Respective Central
Council’s norms
Colleges who desire to apply for Increase in Intake Capacity of degree courses
must fulfill the following criteria:-
1) In order to strengthen the existing colleges and to insure the viability of colleges, the
proposal of such colleges will be recommended for Increase in Intake Capacity, provided
such colleges fulfils the norms as per respective Central Councils of India and whose first
batch has passed out from that college.
2) Before applying for increase in intake capacity, the applicant should see that the college
must be recognized by the respective Central Council of India for running their Course.
The college, which is not recognized by respective Central Council, should not apply for
increase in intake capacity.
3) The College should appoint the teaching staff and create infrastructure of teaching
facilities for the present Intake Capacity as per respective Central Councils norms and
attach the documents as given below :-
a) List of required approved 100 % teaching staff /Additional Staff for existing Intake
and required intake capacity as per the respective Central Councils norms.
b) List of required Para medical & non-teaching staff as per the respective Central
Councils norms.
c) Information regarding College building, Hostel, Library etc.
4) Hospital: Refer Application form for details of Hospital of respective pathy, The
number of beds should be made available for Increase in Intake Capacity as per
respective Central Councils norms in the following table. There should be a proper
distribution of beds in the wards as per Council norms. Attach the list of ward wise
distribution of beds.

Note :- The college should give the undertaking on stamp paper of Rs.100/- duly notarized,
stating that the teaching staff required for Increase in Intake Capacity in addition
to existing staff will be appointed before the visit of the Local Inquiry Committee
for the grant of First Time Affiliation for Increase in Intake Capacity.
3) As per fee schedule prescribed by the University, the college should pay the requisite
fee, in the form of Demand Draft drawn on any nationalized Bank in favour of “The
Registrar, MUHS, Nashik”, payable at Nashik or credit the prescribed amount by using
NEFT / RTGS & forward Demand Draft / NEFT / RTGS receipt along with the proposal
to the Registrar, MUHS, Nashik.
Note: - A) Once the proposal is submitted to the University, thereafter no change in the
proposal or documents i.e. no paper regarding supporting documents to the
proposal will be accepted by the University.

for Opening New Health Science College /Starting of New P.G.Courses/
Increase in Intake Capacity
1) As per MUHS, Act, 1998, section 64(3) Institute submits the proposal

Procedure for Bank Guarantee / Security deposit

Ref. MUHS Affiliation Fee Notification 42/2017, (Amended on 09/08/2017),
The need of Bank Guarantee/Security Deposit for newly affiliated colleges
arises because some of the established colleges have not admitted any students
neither have they applied for continuation of affiliation nor for closer. There are
number of complaints regarding such colleges. This problem was discussed before
the concerned authorities while finalizing the Perspective Plan of the University.
Hence, it is decided to take Bank Guarantee/Security Deposit.
1) The amount of Bank Guarantee/Security Deposit will be as per MUHS Affiliation
Fee Notification 42/2017, {Amended on 09/08/2017}, and the Ordinance
as amended from time to time.
2) The provision of Bank Guarantee/Security Deposit will be made initially for five
Years & will be renewed after every five years till the college is affiliated to the
University
3) The Bank Guarantee/Security Deposit will be (please refer Annexure ‘A’) in favor
of “The Registrar, MUHS, Nashik” OR Fixed Deposit jointly in the name of “The
Registrar, MUHS, Nashik” & “The Chairman / Secretary” of the Institute of affiliated
college.
4) The interest will be payable to the college.
5) The Bank Guarantee/Security Deposit provision shall be made by the
managements of all private colleges affiliated to University as on today.
6) The colleges getting affiliation in future will make the said provision within six
months from the date of receipt of First Time affiliation by the University.
7) The decision of taking Bank Guarantee/Security Deposit is applicable to all
colleges of private management only and will not be applicable to the Government,
Corporation & Govt. aided colleges.
8) The Chairman / Secretary of the concerned management of the affiliated college
shall submit the original notarized undertaking on Rs. 100/- Stamp paper in the
prescribed format (please refer Annexure ‘B’) along with attested photocopy of
Bank Guarantee/Security Deposit receipt to the University.
9) On maturity of Bank Guarantee/Security Deposit the college management will
submit Extended / Renewed receipt of Bank Guarantee/Security Deposit along
with notarized undertaking on Rs. 100/- Stamp paper for next five years.
10) The Provision of Bank Guarantee / security deposit shall be made in the
nationalized / scheduled bank within six months from the date of granting First
Time Affiliation by the university.

‘MUHS’) created under the provisions of the Maharashtra University of Health Sciences
Act, 1998 (hereinafter called as the Act) Act 1998, having its office at Vani- Dindori Road,
Mhasrul, Nashik – 422004 (hereinafter called MUHS which expression shall unless
repugnant to the context or contrary to the meaning thereof includes its successors and
assigns) of the other part:

AND Whereas the MUHS has agreed to grant of First Time Affiliation to the said course
with said intake capacity and to do all such other things as required by the MUHS under
the provisions of the said Act and the Statutes, Ordinance, Directions and Rules and
Regulations promulgated by the MUHS.
AND Whereas the said TRUST has agreed to abide by the provisions of the Act as
modified from time to time and the regulations framed there under and also to follow
such other statutes, ordinances, direction and / or terms and conditions as may be made
or laid down by the MUHS or the State Govt. for the purposes of starting of said graduate
degree course.
AND Whereas the Bank at the request of said TRUST agreed to provide such a
guarantee in the form acceptable to MUHS.
NOW THIS DEED WITHNESETH AS FOLLOW.
1. In consideration of the foregoing, the Bank hereby guarantees to the MUHS the
faithful performance and observation by the said TRUST of the terms and
conditions and directions as laid down in the scheme appended to the
Regulations, or made by the MUHS and also to abide by the provisions of the Act
as modified from time to time and regulations framed there under, and undertakes
irrevocably to be responsible to MUHS as surety for the said TRUST for the due
performance of its said obligations to the extent of (amount as prescribed by
ordinance) ……………………………….. and in the event of any breach of any of
its said obligations by the said TRUST agrees to pay to the MUHS, from time to
time, within 15 days of the receipt by the Bank of a notice or notices of demand in
writing from MUHS, without protest or demur and without recourse to the said
TRUST. Such amount or amounts as may be claimed by the MUHS provided that
the total of the amounts as may be claimed by the MUHS from the Bank shall not

2. That the MUHS shall be the sole Judge to determine whether the said TRUST
has failed to observe and abide by or has committed the breach or breaches of its
said obligations and decision of the MUHS in this regard shall be final and binding
on the Bank.
3. That the guarantee contained herein shall remain in full force and effect during
the period as stipulated in the Scheme / Application and shall continue to be
enforceable until the said TRUST effects full compliance of its said obligations
and all such other directions / terms and conditions as may be laid down by the
MUHS, to the satisfaction of the MUHS.
4. That the Bank shall not be released or discharged as surety nor shall the Bank’s
liabilities and obligations under these presents be in any way affected, impaired
or discharged:
a. By any, variance made, without Bank’s-consent, in the terms and provisions

of the said Scheme / Regulations of the Act or;
b. By any act or omission by MUHS for which the said TRUST may have
recourse to any legal remedy.
5. That the Bank shall not revoke this guarantee during its currency except with
previous consent of the MUHS in writing and agree that any change in the
constitution of the said TRUST or the Bank shall not discharge the Bank of its
liability hereunder.
6. Further as per the guidelines issued by IBA vide its letter L.Ac/14-16/16 dated
22.07.1998, it has been decided that the forfeiture (limitation clause in the BG
would be replaced as under that would be invariable incorporated at the end of
the text of the BG “Notwithstanding anything contained herein:
a) Our liability under this Bank Guarantee shall not exceed Rs(amount as
prescribed by ordinance)………………….
