FIR Format

Rachna Singh purchased a plot of land from Avani Realtech Builders in 2012 for Rs. 4,30,000. Sub.: FRAUD AND CHEATING COMMITTED BY AVANI REALTECH BUILDERS THROUGH ITS PARTNERS

Respected Sir,

I would like to bring the following facts to your kind notice:

1. I Rachna Singh d/o Sri U.S. Chauhan, R/o B-347 Swarn Jayanti Puram, Ghaziabad visited a
property mela held in pragati maidan dated … and representation made by representatives
of Avani realtech builders purchased the plot in name of my daughter Ms. Shivika Singh
bearing No. 164 measuring 200 sq. yard in “AVANI ENCLAVE” situated at village
Mokhampura on Jaipur Ajmer Expressway, NH-8, Jaipur, and advance payment of Rs One
Lakh seven thousand five hundred only (Rs. 1,07,500/-) dated 24 December 2012 with
receipt bearing No. AVINIBU/A23 was made.

2. Thereafter, I made the rest of the amount for the abovesaid plot based on the payment plan
set out in the provisional allotment letter dated 03.03.2013. I made all the 24 EMI amount in
time. Thus, the total consideration of Rs. 4,30,000 {200 sq. yards multiplied by Rs. 2150/sq.
Yard (Total size multiplied by the basic price)} was paid.

3. I also made necessary documents via courier forwarded to the accused as required on my
part on 02.01.2016 and were duly delivered. However, on 12.02.2019 in utter surprise and
shock received letters similar to letters dated 29.10.2015 seeking registration for said plot.
Thus, I made several attempts in making contact but failed each time and thereupon, was
construed to personally visit the abovementioned allotted site and found herself astonished
on looking the condition and felt tremendous shock since, the property was supposed to be
developed by 2015. There was also no construction at all to be going on the barren land.
Moreover, I found the plots to be covered with heaps of straws.
4. Since no development is made no charges can be levied for the development charges to
make the payment for the same. Also, the registration payment request made aren’t
required since nothing is built on the purchased plot and doesn’t seem to be in near future.

5. I sent a legal Notice through my advocate via Speed post on stating the abovementioned
facts and warning of legal proceedings that will be initiated against them but they failed to
acknowledge the notice and did not bother to reply.

Till date I haven’t received any of the refund amount as demanded.

I seek your help and request you to kindly register my F.I.R in the subject matter.

For your ready reference I enclose herewith

(a) Copy of I.D. proof.

(b) Copy Legal Notice.

(c) Copy of bill received.

(d) Copy of the offer in display.

Hope you will do the needful favourably at the earliest.
