AGREEMENT

Re Execution of Front & Side Elevation in connection with the Constraction of the Residential
Building At 65/2, Hindustan Park, Kolkata- 700 029, State – West Bengal .

THIS INDENTURE made this the day of the 2nd MAY , Two Thousand and sixteen between
INHOUSE EXPRESSIONS having office at 450 Ashoke Road , Kolkata – 700 084 hereinafter called
the CONTRACTOR.
AND
ALAUDDIN SEIKH , son of Daud Seikh aged years , by occupation Business , residing at
Masjid Bari Road , Rajpur Sonarpur ,Sonarpur , South 24 Parganas , Pin – 700103 hereinafter
called the SUB – CONTRACTOR.
TERMS & CONDITIONS OF CONTRACT :
1. All works are to the executed as Per CONTRACTORS drawing submitted by architect .

2. Labour cost includes cost for Masonry work , RCC work ( including reinforcement ,
shuttering & necessary welding ) , dismantling , scaffolding , plastering , debris removal ,
including all lead & lifts , including all tools & tackles .

3. Rate also includes board making , chali making associated with scaffolding .

4. No payments will be made for Idle Labour .

5. Time of Completion : Total works shall have to be completed in all respect within one
month and 15 days from the date of issue of this letter . Time is essence of the contract .
This should be strictly ensured .

6. You must depute one experienced skilled supervisor Duty authorize by you for looking
after the day to –day works and receive instructions from our end in your absence .

7. You will make weekly work programmed (jointly) with quantity of work and also reviews
programmed after the week and submit to our end for taking further course of action .

8. Payment Terms :
i. Payment will be made after submission & checking of bill duly submitted by him
frequently
as per the payment schedule jointly decided (Enclo : Annexure –B) .

9. RETENTION Money : Retention towards performance 5% (five percent) of each running


account will be kept as retention money for
entire defect guarantee period. Retention money will be released after satisfactory
completion of work & defect guarantee period.

10. Defect Liability Period : 6 (six) months form date of actual completion. If any damage
occurs due to bad workmanship , then the same have to be repaired free of cost . failing
which Security amount will be forfeited.

11. If any discrepancies in workmanship arise , that will have to be rectified immediately by
you , for which no payment will be given & cost of materials for the same will be
recovered from your bill / bills.
12. If the Sub-Contractor are not able to maintain the required progress of work as per work
program , Penalty @ 1% (one percent) of total value of work shall be recovered from
contractor’s R/A Bill / Final bill for delay of each work programme . if the subcontractor
mitigate the delayed work in next bill cycle /work programme , the deducted amount
will be reimbursed / adjusted with the next R/A bill.

13. Sub – Contractor must be careful for maintaining good quality of workmanship of work .
if any existing work for company’s property be damaged by Agency , the company will
repair the same and the proportionate amount will be deducted from your R/A bills.

14. Materials will be supplied by Contractor from site stock and Sub – Contractor to take the
same on signing the register maintained at site office and return the used materials in
good condition to Inhouse Expressions stores , otherwise proportionate recovery will be
made as market rate.

15. Safety : Safety of labour working under the Sub – Contractor should be ensured strictly .
Safety Belt , Helmet and other safety precautionary measures as required should be
adopted strictly. The Sub – Contractor will be held responsible for the safety of the
worker in all respect. Penalty @ 2 (two percent) of total value of work shall be
recovered from contractor’s R/A Bill/Final bill for non used of safety equipments . Safety
equipments.

16. In spite of all safety precautionary measures if any labour got injured during working
hours,
Arrangement for necessary medical treatment should be done by Sub – Contractor
through First aid Box to be Provided by the Contractor initially . Reimbursement of cost
of such medical bill for treatment with proper documents will be borne by Inhouse
Expressions later on after proper checking of the bills.

17. Insurance of all working labourers is a mandatory and is the responsibility of the Sub-
Contractor. Firm will reimburse the cost to the Contractor on presenting satisfactory
document.

18. Name and address of the worker working under the agency have to be intimated dails to
the in-charge of the work site to enable Inhouse Expressions to maintain a register for
the same.
19. No child labour should be engages as per statuary Act . Female labour should not be
engaged within limit of cantonment.

20. Arrangement for payment of labour / labours working at site should by sub-Contractor
regularly.

21. If any complain is received for non payment of labour since long , payment for such
labour will be made by the Contract with due intimation to you . Such payment made
will be deducted from your bills.

22. Contractor will not be liable for any complain for Creating Nuisance and public
incontinence at work site by the labour /labours.

23. The Sub-Contractor should keep the materials , supplied by the Contractor , for the
works in proper manner . Any damage of materials done due to mishandling of
materials will be viewed seriously and necessary deduction of cost of such damaged
materials will be made from his bill.

24. Time extension on genuine ground may be ground may be granted by the Contractor on
application with valid reasons.

25. If Sub-Contractor leaves the work incomplete , company will complete the balance work
by engaging separate agency at his risk & cost . No further claim will be entertained in
any circumstances.

26. Building premises should be clear of all debris’s (construction rubbish) and extra
materials ,(if any) should be bags as per market rate will be deducted from your R/A
Account Bill.

27. Empty cement bags in good condition to be returned daily to our stores , otherwise the
value of non return cement bags as per market rate will be deducted from your R/A
Account Bill.

28. Rate of any supplementary items of works will be finalized mutually.


29. Statutory Taxes will be deducted as per norms . Photo copies of pan card with agency
signature & Status (whether it is proprietor/ partnership/company) will be submitted in
each R/A Bill.

30. All disputes Will be settled under the jurisdiction of Kolkata High Court.

31. Tax deduction will be made @1% (one percent) over the gross bill finalized on a monthly
basis and TDS Certificates for the deducted amount will be handed over after every
3(three) months.

1 Dismantling all types of plain cement works, stacking serviceable materials at site
and removing rubbish as directed by the consultant architect.

2 Stripping off worn out plaster and raking out joints of walls, ceilings etc. upto any
height and in any floor including removing rubbish within a lead of 75m as directed
by the consultant architect.
3 Removal of rubbish , earth etc. from the working site and disposal of the same
beyond the compound , in conformity with the Municipal / Corporation Rules for
such disposal , loading into truck and cleaning the site in all respect as directed by
the consultant architect.
4 Ordinary Cement concrete (mix 1:1.5:3) with graded stone chips (20mm nominal
size) excluding shuttering and reinforcement if any , in ground floor as per relevant
IS codes as directed by the consultant architect.
5 Hire and labour charges for shuttering with centering and necessary staging upto
14.50m using approved stout props and thick hard wood plank of approved
thickness with required bracing for concrete slabs , beams and columns lintels
curved or straight including fitting , fixing and striking out of completion of works
upto roof of ground floor.
6 Reinforcement of reinforced concrete works in all sorts of structural including
distribution bars , stirrups , binder etc. initial straightening and removal of loose rust
(if necessary) cutting to requisite length , hooking and bending to correct shape ,
placing in proper positions and binding with 16 gauge black annealed wire at every
intersection , complete as per drawing and as directed by the consultant architect.
7 Executing welding works to reinforcement at all levels with necessary clearing of
rubbish.
8 100mm thick Autoclave aerated concrete blocks work with its size 625mm x 250mm
x 100mm made of fly ash , lime & cement conforming to IS 2185 (Part-3) 1984 in
cement mortar (1:4) complete in all respect.
9 R.C. weather boards (1:1.5:3) with stone chips and necessary reinforcement upto
1% (including main and distribution bars) shuttering and 10mm thick cement plaster
(1:4) including all moulding , drip course etc. complete in all floors.
10 Plaster(to wall , floor, ceiling etc.) with sand cement mortar including rounding off
or chamfering corners as directed and raking out joints including throating , noising
and drip course , scaffolding / staging where necessary (Ground Floor) excluding
over concrete surface.
