December 7, 2022

AN ORDINANCE ESTABLISHING GUIDELINES AND PROCEDURES IN THE


AVAILMENT OF BACOLOD CITYCOMPREHENSIVE HEALTH PROGRAM (BacCHP) AND
PROVIDING FUNDS THEREOF,

WHEREAS, Section 15 of Article Il of the 1987 Philippine Constitution provides that the
State shall protect and promote the right to health of the people and instill health
consciousness among them;

WHEREAS, Section 16 of Republic Act 7160 otherwise known as the Local Government
Code provides that “Every Local Government Unit shall exercise the powers expressly
granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or
incidental for its efficient and effective governance, and those which are essential to the
promotion of the general welfare

WHEREAS, Article Section 11 of the 1987 Philippine Constitution states that “ The

shall endeavor to make essential goods, health, and other social servicesto all the people
at affordable cost

WHEREAS, Section 6 (b) of the Republic Act No. 11223 or the Universal Health Care
Actfurther provides that “(c) The DOH and the local government unit (LGUs) shall endeavor to
provide a health care delivery system that will afford every Filipino a primary care provider
that would act as the navigator, coordinator, and initial and continuing point of contact in the
health care delivery system.”

WHEREAS, Section 6 of the Implementing Rules and Regulations of the Universal


Health Care Act (Republic Act 11223) it provides that every Filipino shall be granted
immediate eligibility and access to preventive, promotive, curative, rehabilitative, and
palliative care for medical, dental, mental and emergency health services, delivered as
population-based or individual-based health services

NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the Sangguniang


Panlungsod in session assembled, that:

Section 1. Short Title.


This ordinance shall be known as the “BACOLOD CITY

COMPREHENSIVE HEALTH PROGRAM”

Section 2. Declaration of Policy. - The Bacolod City Comprehensive Health Program


(BacCHP) is a priority flagship program of the City of Bacolod which aims to maximize
government resources for the implementation of an adequate & responsive healthcare system
in the city.

Section 3. Objectives. - This ordinance shall have the following objectives:

1. The program shall support the implementation of an annual health check-up and
regular distribution of free maintenance medicines in conjunction with the City Health
Office through the preventive healthcare program of the Philippine Health Insurance
Corporation (PhilHealth).

The program shall optimize the service of private healthcare facilities for preventive
and curative healthcare for all its members.

3. The program shall ensure sufficient administrative support to facilitate and


coordinate the delivery of healthcare services to the city, and enhance the
facilities and services in existing primary health care stations in each barangay.

The program shall endeavor to secure and utilize all available government resources
for healthcare in order to eliminate out of pocket expenses of all its members.

Section 4. Definition of Terms. - For purposes of this ordinance, the following


terms are defined:

a) Accredited Health Care Providers - refers to private hospitals and other health
care providers within the jurisdiction of Bacolod City with an existing Memorandum
of Agreement (MOA) with the City of Bacolod relative to the Bacolod City
Comprehensive Health Program. These Health Care Providers should be accredited
by the Philippine Health Insurance Corporation.

Health Care Provider - A health facility which may be public or private, devoted
primarily to the provision of services for health promotion, prevention, diagnosis,
treatment, rehabilitation and palliation of individuals suffering from illness, disease,
injury, disability, or deformity, or in need of obstetrical or other medical and
nursing care.

Beneficiary - refers to Bacolod City residents who are duly registered and qualified
to receive benefits under the BacCHP program. Qualified beneficiaries are residents
of Bacolod City for at least one (1) year, members of the Philippine Health Insurance
Corporation (PhilHealth) as principal or dependent with updated premium payments,
and have submitted requirements requested by the BacCHP Operations Center.

Technology Officer Il (SG 22) with at least five (5) years relevant experience in
Health Information Technology or Health Program Implementation reporting
directly to the Mayor or his authorized representative, supported by two (2) Health
Program Officers Il (SG 15) with atleast three (3) years relevant experience in
Health Information Technology or Health Program Implementation, and
complemented by at least fifteen (15) encoders and administrative assistants.

e) Bacolod City Comprehensive Health Program (BacCHP) - a priority


program of
the City of Bacolod that will ensure the delivery of preventive and curative
healthcare services to all qualified residents of the city that shall endeavor to
maximize government resources for the implementation of an adequate & responsive
healthcare system in Bacolod City.

Bacolod City Comprehensive Health Program Family Card -a document duly


issued by the BacCHPOC to a qualified beneficiary and his dependents.

Indigent —
any person who have no visible means of income, or whose income in
insufficient for family subsistence as identified by the Department of Social Services
and Development (DSSD).

Section 5. GUIDELINES FOR THE AVAILMENT OF THE BACOLOD CITY


COMPREHENSIVE HEALTH PROGRAM (BacCHP) SERVICES.

A. Preventive Health Services

1. The BacCHP member/beneficiary shall go to his assigned Barangay Health Station


and present the BacCHP Family Healthcard to avail of an annual medical
check-up and consultation ondates scheduled by the City Health Office through
the Barangay.

The BacCHP member/beneficiary shall undergo an initial health screening by a


barangay health worker, and nurse or midwife. Ifthe health condition of the
member/beneficiary requires, he/she shall be subject to laboratory services, after
which he/she shall undergo consultation by a physician, and prescribed maintenance
medicines. The laboratory services and maintenance medicines shall be within
the parameters of the Primary Care Benefit Program of the Philippine Health
Insurance Corporation (PhilHealth) and shall be of no costto the patient.
In the event that the member/beneficiary requires additional laboratory tests not
covered by PhilHealth’s Primary Care Benefit program, the BacCHPO shall assist the
member/beneficiary to obtain the additional laboratory tests at any government or
private health care provider.

The City Health Office shall analyze the data gathered during the annual
check-up and enhance existing health programs usingthe said data. The health
programs shall include specific needs of each barangay and shall be implemented in
coordination with or through the Barangay Health Workers, Barangay Nutrition
Scholars, Office of Senior Citizen's Affairs, and other sectors representing the
various communities.

B. Curative Health Services (Availment of Private Hospital Services)


1. The BacCHP member/beneficiary shall be initially assessed at his/her barangay by
the authorized health center personnel.

to handle, they shall immediately inform the City Health Office.

The City Health Office shall evaluate and recommend the proper course of action to
be taken by the barangay personnel that couldbe either, but not limited to, the
following:

a. Member/Beneficiary be evaluated by physicians from the City Health Office or


other specialists at the barangay through in person or tele-consult;

b. Member/Beneficiary be brought to the City Health Office for treatment or


examination by the City Health Officer on duty;

¢. Member/Beneficiary be brought to the hospital for treatment or confinement.

4. In the event that a member/beneficiary requires hospitalization, the City Health


Office shall immediately informthe BacCHP Operations Center;

5. The BacCHP Operations Center shall immediately coordinate with, and refer the
patient to the accredited health care provider with available BacCHP beds that can
provide the service requiredby the patient. Provided, that if there are more than
two (2) hospitals that can provide the services, the referral shall be made to the one
nearest to the patient's residence. Provided further, in the event that all BacCHP
beds in the private hospitals are occupied,the patient can be accommodated in
the next room category.

6. In cases of extreme emergency, the BacCHP beneficiary may be brought


directly to the nearest available hospital. Provided, that the maximum amount of
Fifteen Thousand Pesos (P 15,000.00) shall be given as assistance to the
beneficiary. Provided further, that the assistance shall be used only after
exhausting PhilHealth benefits, and other government health care grants/
assistance.

Section 6. BacCHP Family Cardholders Benefits

A BacCHP Family Card holder shall be entitled to a maximum of Fifteen Thousand


Pesos (P15,000.00) that will serve as grant for health related expenses. Provided, that the
beneficiary shall be classified in accordance with Republic Act No. 747 and its latest
Implementing Rules and Regulations. Provided further, that the grant shall be used only
after exhausting Philhealth benefits,and other government health care grants/assistance.

Section 7. CREATION OF THE BacCHP OPERATIONS CENTER

1. BacCHP Operations Center (BacCHPOC). The BacCHpP Operations Center shall


be a Section under the Office of the City Mayor and shall be under the direct

2. Creation of Plantilla Items. The operation center shall be headed by an


Information Technology Officer Il (SG 22) with at least five (5) years relevant
experience in Health Information Technology or Health Program Implementation
reporting directly to the Mayororhis authorized representative, supported by two (2)
Health Program Officers Il (SG 15) with at least three (3) years relevant experience
in Health Information Technology or Health Program Implementation, and
complemented by at least fifteen (15) encoders and administrative assistants.
A. FUNCTIONS OF THE BacCHP Operations Center

1. Maintain and keep an updated list of BacCHP members/beneficiaries for Sixty-one


(61) Barangays of Bacolod City.

2. Formulate and implement an effective information program to ensure qualified


families and individuals are enrolled to the program. The information program
should ensure that all members/beneficiaries are informed of the coverage of the
process to access the benefits procedures;

3. Monitor and evaluate the performance of the program and submit an annual report.

4. Conduct an annual validation and update of requirements to ensure the accuracy of


the membership data.

5. Assure the complete and correct filing of primary care benefit claims to PhilHealth.

B. DUTIES OF THE BacCHP OPERATIONS CENTER

1. Preventive Health Care

1.1 The BacCHP Operations Center (BacCHPOC) shall coordinate with the Barangays
and the City Health Office regarding the Primary Care Benefit program of
PhilHealth, specifically thedocumentation, encoding, and prompt submission of the
claims.

1.2 The BacCHPOC shall coordinate with other government agencies to request for
assistance for the additional laboratory procedures and medicines required for the
member/beneficiary that is not covered by the Primary Care Benefit program.

1.3 The City Health Office shall coordinate with the BacCHPOC regarding the schedule
of consultations in the barangay health centers. The BacCHPOC shall provide the
necessary technical support during the conduct of the consultations and shall
encode, process and submit all claims to PhilHealth for the primary care benefit
program.

2. Curative Health Care

2.1 The BacCHPOC shall provide the hospital with the name and BacCHP card
number of the member/beneficiary and referral form from the City Health Office.
Priority shall be given to government hospitals located in Bacolod City before the
member is referred to a private hospital.

2.2 The BacCHPOC shall coordinate with government hospitals located in the City of
Bacolod to ascertain if the patient may be confined in the hospital. In the event that
the government hospital has reached full capacity or is unable to provide the service,
the BacCHPOC shall request for a certification and arrange for the accommodation
of the beneficiary in a private hospital.

2.3 Upon receipt of the certification from the government hospital, the BacCHPOC
will refer the member/beneficiary to a private hospital.

2.4 The BacCHPOC shall inform the patient of his pre-approved admission in the
hospital and shall coordinate with the barangay of the patient regarding assistance to
transport the patient to the said hospital.

2.5 The BacCHPOC shall coordinate with other government agencies to assist patient in
procuring financial assistance for his confinement.

2.6 The BacCHPOC shall coordinate with the PhilHealth regional office regarding the
prompt payment to the partner health care providers for the service provided to
BacCHP members/beneficiaries.

Section 8. GUIDELINES FOR ENROLLMENT OF THE PROGRAM

1. Allqualified residents shall register to the program through their barangay, Office of
Senior Citizens Affairs (OSCA), BacCHP Desk, or the City Health Office.

2. Applicants shall be required to sign a consent for the use of their data for the
program.

3. The data collected shall be submitted to the BacCHPOC for validation through the
Philippine Statistics Authority and Philhealth.

4. Upon validation of the identity, PhilHealth status, and submission of requirements of


the registrants, the BacCHP Family Health Card shall be issued.

5. The data in the BacCHP Family Health Card may be used for the creation of an
Electronic Medical Record of its members.

Section 9. BacCHP MEMBERS DATA PRIVACY

The data privacy provisions under Republic Act No. 10173 otherwise known as the Data
Privacy Act of 2012 shall be strictly complied with to ensure that the data privacy rights of
BacCHP Family Health Card holders are respected and protected.

Section 10. OBLIGATIONS AND RESPONSIBLITIES OF THE ACCREDITED HEALTH


CARE PROVIDERS

The accredited health care providers (AHCP) shall sign a Memorandum of Agreement
(MOA) with the City of Bacolod that should include the following:

1. The AHCP shall provide the BacCHP member and theirqualified dependents ward
or small private room accommodation equivalent to at least five (5%) percent of
their authorized bed capacity in partial compliance with Section 29(c) of the
RepublicAct 11223 otherwise known as the Universal Health Care Act;

2. No Deposit shall be required from BacCHP cardholders as a requirement for


admission in any government or private hospital in the City of Bacolod.

3. The AHCP shall assign a coordinator who shall coordinate with the BacCHP
personnel in order to provide needed assistance of the cardholders:
4. The AHCP shall abide by their performance commitments to the Philippine Health
Insurance Corporation especially with regard to the No Balance Billing (NBB) policy
for those confined in a ward or basic accomodation.

Section 11. Appropriation - The fund needed for the initial implementation of this
Ordinance in the amount of EIGHTY MILLION PESOS (P 80,000.000,00) shall be sourced from
the Assistance to Individual in Crisis Situations (AICS) Fund.

Section 12. Separability Clause - If any part, section or provision of this Act is held
other provisions not affected thereby shall remain in full force and
invalid or unconstitutional,
effect.

Section 13. Repealing Clause - All laws, decrees, orders, issuances and rules and
regulations or parts thereof inconsistent with the provisions of this ordinance are hereby
repealed or modified accordingly.

Section 14. Effectivity - This ordinance shall take effect fifteen (15) days after
its publication in a newspaper of general circulation in Bacolod City.
