CONTRACT
This AGREEMENT is made on this ……….... DAY OF
NOVEMBER THE YEAR TWO THOUSAND AND TWENTY
BETWEEN SK. ARIF HOSSAIN, son of late Sk. Sahauddin, by
faith- Muslim, by occupation - Physiotherapist residing at Chilinga,
Purba Medinipore, West Bengal= 721631, Police Station -
______________________hereinafter called as SERVICE
PROVIDER of the FIRST PART
AND
GD HOSPITAL & DIABETES INSTITUTE, having its registered
office at 139A, Lenin Sarani, Kolkata – 700013, represented through
_____________________ of the SECOND PART
WHEREAS the party of the first is by qualification a duly trained
physiotherapist having been so acclaimed and learned from, by
_______________ institution and is in this field of providing
physiotherapy to numerous patients, individuals over the last _____
years, under recommendation from doctors, and /or otherwise and
being so thereof approached this 2nd party hospital for engaging him
as an outsourced physiotherapist working for and within the hospital
for the COVID patients exclusively and the 2nd party hospital on due
verification of the documents, testimonials of his relevant credentials
have duly decided and agreed to engage him for the same and the
parties on so deciding the above for smooth and hassle free
functioning have agreed to work the terms binding both as appearing
hereinafter:
NOW THIS AGREEMENT WITNESSETH AS HEREUNDER:-
1. That this agreement is being entered into and executed on this
_______________ day of _____, 2020 and shall remain in force
for a term of ___________________, ending on __________,

unless otherwise mutually extended by both the parties in
writing duly executed, signed and approved.
2. That the service provider is aware that he shall provide
physiotherapy to the COVID positive patients only and he shall
have no objection to the same.
3. That the service provider shall make available his service in the
hospital from ______________ to _____________
everyday/……….. and shall attend patients as directed,
recommended, advised by the respective doctors treating Covid
patients.
4. That the agreed rate for providing physiotherapy to each patient
shall be Rs. 1200.00(Rupees one thousand two hundred only)
out of which Rs. 500.00(Rupees five hundred only) shall be
deducted by the hospital and the balance of Rs. 700.00(Rupees
seven hundred only) shall be paid to the first party service
provider after due initiation of bill on TDS after the expiry of
the month.
5. That the service shall be provided at the above rate for every
patient attending the 2nd party hospital covering OPD,DVP,
SINGLE BED CABIN,3 BED CABIN, 4 BED CABIN, 5 BED
CABIN,6 BED CABIN, CCU, & CORPORATE PATIENTS.
6. That both parties shall ensure maintenance of proper register for
the patients attended and/or provided service/sitting and the
same shall bear necessary endorsement of authorised persons
duly representing the hospital to maintain transparency of
number of sittings.
7. That the first party service provider shall ensure service to each
patient with due diligence and acumen, expertise leaving no
room for grievance to the best of his professional ability and
shall keep the hospital indemnified against any third party claim
raised from the patient end.

8. That the first party service provider shall carry his own
instruments as well as use instruments provided by the hospital
taking due care and caution for performing such physiotherapy.
9. That this agreement shall be terminable from either side after
giving 2 months’ notice duly written and served on the other
side in writing.
10. In respect of other matters not covered under this
agreement, the guidelines/directions of GDHDI as amended
from time to time shall be applicable mutatis-mutandis.
11. This Agreement can be modified or amended only in
writing signed by both the parties on prior approval.
12. The agreements shall be made in duplicates with each
party retaining a copy.
13. That this engagement is on a contractual basis and there
exists no employer employee relationship between the parties.
