MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement made and entered into by and between:

BUENASUERTE INTEGRATED SCHOOL one of the elementary schools in Pio V. Corpus


District, SDO Masbate Province, with address in Buenasuerte, Pio V. Corpus, Masbate, represented by its
School Head, CLINTON D. ABILONG, hereinafter referred to as the “EDUCATIONAL INSTITUTION,”

and

The BARANGAY COUNCIL OF BUENASUERTE, PIO V. CORPUS, MASBATE a government


legislative body existing under the laws of the REPUBLIC OF THE PHILIPPINES, with address in
Buenasuerte, Pio V. Corpus, Masbate, represented herein by the Punong Barangay, BENEDICTO A.
CESAR, and hereinafter referred to as the “PARTNER STAKEHOLDER.”

WITNESSETH, that:

WHEREAS, the EDUCATIONAL INSTITUTION is in need of Security and Safety Officer to assist
the administrative and teaching personnel in ensuring the safety of learners and security of all school
facilities;

WHEREAS, the EDUCATIONAL INSTITUTION proposes that the PARTNER STAKEHOLDER


shall assign a Barangay Public Safety Officer (BPSO) of Barangay Buenasuerte, in the person of MR. JOSE
A. MARTINEZ, who will assist the school in its proper implementation of security and safety protocols
and shall have the following duties and responsibilities:

a. Patrol and monitor the gate, hallways, stairways, toilet facilities, outside facilities, and other
public and unsupervised places of the school to ensure facility security and safety of learners
and staff;
b. Ensure smooth traffic flow of learners through the hallways, assisting they with on-time
arrival to class and to assigned locations;
c. Assist learners in crossing the streets especially with their arrival and dismissal;
d. Assist the teaching and administrative staff, police, and emergency personnel in handing
emergencies or disruptive situations;
e. Encourage and ensure that learners wear identification badges;
f. Assist visitors with directions and secure proper identification;
g. Report any discipline infractions, emergency, potentially dangerous and unusual situations to
the school head;
h. Promote learners responsibility for behavior and attitude by serving as a role model by
dressing and grooming professionally; and
i. Display ethical and professional behavior in working with learners, parents, school
personnel, and outside agencies associated with the school.

WHEREAS, the PARTNER STAKEHOLDER agreed to accept the proposal of the


EDUCATIONAL INSTITUTION as part of their duties and responsibilities and in support of the
EDUCATIONAL INSTITUTION’s proper implementation of its security and safety protocols;

NOW, THEREFORE, for and in consideration of the foregoing premises, the EDUCATIONAL
INSTITUTION and the PARTNER STAKEHOLDER agree and stipulate the following:

A. The EDUCATIONAL INSTITUTION shall;

1. Orient the BPSO about the plan of action to be implemented inside Buenasuerte Integrated
School’s premises; and

2. Set guidelines and proper scheduling to be followed by the assigned BPSO.

B. The PARTNER FRONTLINER shall:

1. Assign work assignments for the proper implementation of security and safety protocols;

2. Accomplish the necessary forms required by the EDUCATIONAL INSTITUTION in connection


with the implementation of security and safety protocols; and

3. Set and enforce norms and proper scheduling of the task to be carried out. The said rules shall
be made known to the EDUCATIONAL INSTITUTION and the members before the start of the
implementation.

C. Under this Agreement the following terms and conditions are likewise included;

1. The PARTNER FRONTLINER and BPSO shall abide by the EDUCATIONAL INSTITUTION’S
rules and regulations and comply with those imposed for the proper implementation of security
and safety protocols in the school;

2. That both parties shall exert all efforts necessary to achieve the objectives of this joint
undertaking. For this purpose, the parties shall execute and deliver such instruments and
documents may be reasonably requested by the other party in order to carry out the intent and
accomplish the purpose of this Agreement and the transaction covered hereby; and

3. That neither of the parties shall be liable in any way for the failure to observe or perform any
provision of this Agreement if such failure shall be caused by any law, rule or regulation of any
constituted public authority or shall be due to any force majeure event or any cause beyond the
control of the party in default.

D. Duration: This Agreement shall take effect immediately upon signing hereof and shall continue for a
period of three (3) School Years thereafter. Unless otherwise advised in writing by either party, this
Agreement shall automatically be renewable for the same period under the same terms and conditions.

Notwithstanding the foregoing, the PARTNER STAKEHOLDER or the EDUCATIONAL
INSTITUTION reserves the right to terminate this Agreement, subject to a fifteen (15) day prior written
notice to the other party.

E. Miscellaneous: This Agreement shall be governed by and construed in accordance with the laws of the
Republic of the Philippines.

In case any one or more of the provisions contained herein shall, for any reason, be held to be
invalid, illegal, or unenforceable in any respect, such invalidity, illegality or unenforceability shall not
affect any of the provisions of this Agreement. In such event, the parties shall consult each other as to the
manner by which their original intention can be fulfilled as closely as possible and they will amend this
Agreement accordingly.

IN WITNESS WHEREOF, the parties hereof have signed this Agreement on this 22nd Day of
August 2023 in Buenasuerte, Pio V. Corpus, Masbate.
