N J. AN ORDINANCE AMENDING CERTAIN PROVISIONS OF CITY ORDINANCE NO. 167-14, OTHERWISE KNOWN AS THE
ESPA CODE OF ECONOMIC ENTERPRISE OF THE CITY OF MASBATE
RES BE IT ORDAINED by the Sangguniang Panlungsod of the City of Masbate in session duly assembled, that:

SECTION 1. Amendments. The following sections of City Ordinance No. 167-14, or the Code of Economic Enterprise of
Counci the City of Masbate are hereby amended as follows:

C. Market – refers to City Public Market Premises.

SECTION 30. Market Rules and Parking Area Regulation. The following market rules and parking area
regulations shall be strictly observed:

RUBY I. Market Rules.


M. A. No person shall utilize the public market for residential purposes;
SANC B. It shall be unlawful for any person to resist, obstruct, annoy, or impede any market employee
HEZ- or personnel in the performance of his duties;
MORA C. No children shall be allowed to play in the market premises;
NO D. No lessee shall remove, construct, or alter the original structure of any stall/table/space, or
City electrical wirings or water connection without prior permit from the Market
Counci Administrator/Supervisor, and approved by the City Engineer;
lor/Te E. All weights and measures being used by the lessee shall be sealed or calibrated by the City
mporar Treasurer upon payment of the fees thereof;
y F. The City Government of Masbate shall not be responsible to the occupants of a stall for any
Presidi loss or damage caused by fire, theft, robbery, “force majeure” or any other causes. All articles
ng or merchandise left in the market during closed time shall be at the risk of the stall holder or

G. All items lost and found in the public market premises shall be turned over to the Market
Administrator for custody. Perishable items not claimed within twenty-four (24) hours, shall be
disposed of in the manner directed by the Market Administrator. Non-perishable items must be
claimed within ten (10) days, otherwise, said article shall be sold at public auction, and the
proceeds shall be turned over the City Treasurer;
SOCR H. Urinating/Defecating in market buildings posts, walls alleys, drainage canals and the like is
ATES strictly prohibited;
M. I. Dummies/Subleasing and selling of privilege are not allowed. No lease holder shall subject or
TUAS sublease the stall so awarded nor shall any privilege acquired be sold. Any person other than
ON the stallholder found selling in the latter’s stall shall be considered prima facie evidence of
City subleasing and shall subject the stallholder outright revocation of his/her award;
Mayor J. No person shall be allowed inside the Market Premises after Market hours except the
assigned Market Personnel performing their duties and responsibilities;
K. Extensions of stalls beyond the leased areas are prohibited. The goods found in the extended
area shall be confiscated. Perishable goods shall be turned over to the City Social Welfare and
Development Office (CSWDO) for their proper disposal;

DANN L. Bringing bicycles and using heavy-duty folding carts (pushcart) inside the Market Premises are

orderliness of the Market;

the the public address system used by the City Market Administrator;

gsod Q. Any authorized Market personnel on duty shall have the authority to confiscate items and
goods displayed and/or sold on alleys, passageways, and corridors of the Market Premises;
and
R. Any authorized Market personnel on duty shall have the authority to reprimand any person
who shall commit any act in violation of the rules and regulations set forth in the Market
Premises.
JAMO II. Parking Area Regulation.
N J. A. Parking Area Utilization.
ESPA a. The City Market Administrator shall be responsible for implementing the rules and
RES regulations on utilizing the parking area in the New City Public Market as defined under

Counci b. Parking areas as defined under Section 30 (B) of this Ordinance shall be used only for

c. No vehicle is allowed to be parked at the City Public Market area overnight.
d. Users of the Market Parking area shall obey all posted signs and park only in the
designated areas for parking.
e. Delivery and unloading of goods shall be allowed from 2:00 o’clock in the morning to 9:00
o’clock in the evening.
RUBY f. Unless otherwise instructed, every market customer using the parking area is required to
park and lock his vehicle. The Market Administrator shall not be responsible for any

damage to a vehicle, injury to persons, or loss of property, all of which are risks to be

g. Repair and maintenance of vehicles in the Market Parking area or common areas are

The City Economic Enterprise Manager shall provide a designated free parking area for private
vehicles for an allowed maximum time of one (1) hour only; and a free parking area for all
motorcycles during market hours.

N J. SECTION 94. Grave Offenses. The following are the grave offenses under this Ordinance:

City I. Resisting, obstructing, annoying, or impeding any market employee or personnel engaged in the

L. Arrogant and insulting market vendors towards authorized market Personnel/Eco-Aides; arrogant
and insulting authorized market employees towards market vendors.
SECTION 2. Repealing Clause. All previous ordinances, executive orders, rules, and regulations or parts thereof that are
inconsistent with this ordinance are hereby repealed and/or modified accordingly.
RUBY SECTION 3. Separability Clause. If any provision/s of this Ordinance or the application of such provision/s to any person
M. or circumstances is declared invalid, the remainder of the Ordinance or the application of such provision/s to
SANC other person/s or circumstances shall not be affected by such declaration.
HEZ- SECTION 4. Effectivity Clause. This Ordinance shall take effect after compliance with the publication requirement as
MORA provided for under Republic Act No. 7160 or the “Local Government Code of 1991”.
