Subject: Grievance against immoral behavior of Maharaja Agrasen Institute of


Management Studies, Rohini and request to issue instruction/order to release salary
withheld by the Institute unduly

Dear Sir / Ma’am,

I, Surya Saxena, S/o Shri Sanjai Saxena, R/o Flat No. 2, Savarkar Apartments, 39, IP
Extension, Patparganj, Delhi - 110092 would request you to please attend to my plea as
highlighted below and help me in getting my rightfully earned salary, which has been immorally
held by my previous college Maharaja Agrasen Institute of Management Studies, Rohini
(MAIMS).

Background:

1. I have been a teacher since 2019. I am a teacher by choice and by need. I have chosen
“teaching” as my livelihood since I believe that every little contribution from an
individual towards building up a better society counts. I love teaching as it gives me a
platform to reach young influential minds which if guided right, can take our nation to
better and developed state. However, teaching is also my livelihood, my source of income
through which I fulfill the basic financial needs of my family.

2. I come from a humble middle class family. My father was a service man and earned just
enough to fulfill basic needs of our family of 6 (six). My mother is a simple housewife
who has devoted her life to take care of us and our house and to build good morals and
principles in us.

3. Since I was good in studies, I completed my graduation and then post-graduation in Law
from Delhi and Jodhpur and joined the profession of teaching with a hope to live a
simple, happy and fulfilling life; only to understand the colleges and schools these days
see imparting education as only a profitable business and treat teachers as a burden to
whom they have to share part of their profits in form of salary and would go to any means
to exploit them and leave no opportunity to cut their salaries or terminate them
wrongfully or withhold their rightfully earned salaries.
Details of Issue:

4. I joined MAIMS in October 2022 as Assistant Professor and the Institute issued me an
appointment letter [enclosed as Annexure-A], as per which I was required to serve my
probation period from 17th October 2022 to 17th October 2023, before being confirmed as
a regular employee in writing.

5. While working with the Institute, I fulfilled all my responsibilities like teaching,
administration, etc. till the very last date of my duties including the NAAC visit.

6. However, since the behavior of administration is very exploitive towards the teachers
here and they fail to provide a harmonious environment and also the pay scale is much
less as compared to the pay available is market; I made up my mind to take up a better
opportunity that came to me and tendered my resignation as on 31 st July, 2023. Please
find enclosed copy of resignation [enclosed as Annexure-B]. I must highlight to your
goodself here that my resignation has been tendered in pure professional manner with
respect and gratitude towards the institute for providing me a platform and experience.

7. As per terms of my appointment letter, I should not resign from his job in the middle of
the Semester and I duly complied with this requirement by completing my services till
the end of semester and served my resignation only after completion of semester. The
appointment letter has no clause on requirement to serve any notice period during
probation. Further, I should highlight here that it has been stated in Paragraph 5 that the
management reserves the right to terminate the employee during the probation period.
Therefore, the resignation is due and valid as per the signed and agreed terms of
appointment between the institute, MAIMS and myself.

8. However, I faced the adversity which I believe many vulnerable powerless teachers face
from big Institutes. The Institute denied releasing my salary amounting to Rs.72,000
(Rupes Seventy Two Thousand only) for the month of July 2023 and even after my
several requests and warnings; they had been trying to pressurize me to accept that the
provision of 30 days’ notice period should have followed by me which is applicable to
regular employees i.e. after probation period. However, your goodself may kindly take
note of Paragraph 5 which clearly states that notice period of 30 days is applicable to
employees whose probation has been confirmed.

9. In good faith, I resigned in a timely and professional manner so that there are no
difficulties that may arise for the institute and there is enough time for recruiting
additional candidates. I could have waited for the salary to be credited and then suddenly
dropped a letter/message to resign which would project a very unprofessional behavior.
But my ethics didn’t allow me to follow this immoral option.

My Plea and request:

10. Your goodself! Teachers are one of the main pillars of a sound and progressive country.
They bear the weight and responsibility of teaching and apart from parents; they are the
main source of knowledge and values for children. However, it is a known act that in our
society, teachers are being exploited and are being forced to do work at the mercy of such
Institutions. Teachers work on the strict terms and conditions of such Institutions which
try to exploit them on bare minimum pay since most of labour laws keep teachers out of
their purview and we do not even have an option to compliant at consumer courts; which
is why such Institutes take advantage of the situation and impose immoral and impartial
terms on teachers.

11. Every individual has certain rights, and any infringement of those rights constitutes an
attack on the state. And these attacks may be even more grievous if the victims are
teachers, shapers of youth. In the case of Somesh Thapliyal Vs. V.C. HNBGU [2021
(SC)] the Hon'ble Justice Ajay Rastogi held that, "This court can take judicial notice of
the fact that if an employee takes initiation in questioning the terms and conditions of
employment, that would cost him/her job itself." This implies that the courts are also
aware of the working conditions in these institutions. The employer is always in a
dominant position, and we observe that the employee on the receiving end can hardly
complain of arbitrariness in employment terms and conditions. Thus, the employer has
the authority to dictate employment terms, which is unethical and immoral, and certainly
violates the principles of 'Equity and Justice' inherent in the 'Basic Structure of our
Constitution.'

12. I humbly request your goodself to kindly help me in this situation to fight against
the injustice been done to me and instruct the Institute to release my salary
amounting to Rs.72,000 immediately. Because it is Guru Shishyaprampara's legacy
and not management Shishyaparampara's legacy that our culture inherits. I am the
sole bread earner of my family and my wife, and retired old parents are dependent
on me. This salary is my rightfully earned income that would help me and my
family to live a basic life. Also, I believe in fighting for the right and to stand firmly
to fight against the domination of such unfair management. I am dedicated to
addressing any concerns or issues that might have arisen, and I am committed to
resolving any misunderstandings or discrepancies. I kindly request a thorough
review of the situation and a prompt release of the withheld salary, as stated in my
appointment letter.
Hopeful of your quick response and full support in this matter please. I would be highly obliged
for your assistance in this situation.
