nearly anyone can generate sales copy, for
free, with AI and yknow, copyright.

you should though. Considering that AI
Generated images can’t be copyrighted.

Answer: Yes, but, your client is going to be
very angry when they realise they can’t
Copyright the AI output and don’t actually
own it. Even though they paid for it.

Answer: You have to be upfront with your
client that you’re using AI. Especiailly, if you
don’t plan on editing it and adding significant
human-based changes.

You also need to somehow prove that you


made those human changes.

If this were graphic design, this would mean


providing raws, etc.

Imagine, as a business owner, you pay for a
logo or a blog article to be written.

The freelancer charges $50.

You get back good quality work with fast turn


around. You post it or use it.

The next day, someone steals your logo or


blog.

There’s now nothing you can do about it.


Because the generated content is Fair Use.

You ask the Freelancer to prove it’s their work.

They can’t.

Because it’s AI Generated.

In the UK and the US, the answer is No.

There are no copyright protections for work


generated solely by AI.

Unless you can prove there was substantial


human input.

Answer: You COULD sell it. Though it doesn’t
mean you should from a moral and legal
perspective.

For instance, in September of 2022, the US
Copyright Office gave the greenlight and a
“first of its kind” registration for a comic book
that was made with Midjourney’s input.

Which, for those who don’t know, uses


text-to-image technology.

The comic itself contains 18 Pages with
Characters. Containing Dialogue.

All set in a comic book layout.

However, the United States Copyright Office
are currently reviewing their decision about
granting the comicbook copyright protection.

What the USCO will be reviewing will be the
degree of human input that was involved
while creating the comic.

Well it’s not just art. Keep that in mind. We’re
talking about ANY output from Generative AI.

That does include copywriting, scripts,


code, etc.

Unless you can prove you had significant


involvement in changing it.

Answer: This is a very tricky question.

For a majority of AI generated content, no.

If you can prove Human Authorship, yes.

That wouldn’t justify it.

Not technically at least. Unless you can prove


that the way you used the prompt or the AI
tool was substantial. Here’s what I mean by
that:

One to two lines. Maybe some user context to
tailor it. Single shot usage.

This is not eligible for copyright.

Super Prompt:
Multiple lines. Added user context to tailor it.
Single or Few Shot usage.

Could be eligible for copyright depending


how much output and unqiueness the
prompt has to that person/company.

Tree of Life Style. Multiple Shot Prompting.
Lots of User Context. Predefined Rules.
Predefined boundaries.

Answer: Because there hasn’t been a
demonstrable court ruling or decision made
that Copyright/Protects output yet.

Even with Engrammic/Hyper/Super


Prompting.

Consider when making prompts, fine tuning,


seed usage, engineering more.

Though this still doesn’t guarantee copyright.

Keep in mind he hasn’t had his work copyright
protected.

The creator of this AI work said that he spent


weeks working on his prompts. Manually
finishing and editing the piece.

Which would imply that there’s a lot of human


involvement.

Remember that if you’re going to sue someone
for copyright infringement, you need first hold
copyright.

So in short? Can you sell AI generated content?

Of course. Anyone can sell AI Generated content.

But in the process of you selling that content fopr


a quick buck, you’ll potentially be massively
jeopardizing a company.

Not only is it unethical, it’s immoral and


borderline illegal.

As well as potentially causing damage.

And is that really the reputation you want? For a
small payout? You’re better than that.
