 Question Nos. 28 – 30 in Section E are Case Based Questions carrying 4 marks each.

reference to this, what does the Freedom of Religion encompass? Support

SECTION – E CASE BASED QUESTIONS (4 x 3 = 12)


28. Read the passage and answer the questions that follow: (4)
The South African Constitution was inaugurated in December 1996. Its
creation and promulgation took place at a time when South Africa still
faced the threat of a civil war after the dissolution of the Apartheid
government. The South African Constitution says that its “Bill of Rights
is a cornerstone of democracy in South Africa”. It forbids discrimination
on the grounds of “race, gender, pregnancy, marital status, ethnic or social
origin, colour, age, disability, religion, conscience, belief, culture,

language and birth”. It grants perhaps the most extensive range of rights
to the citizens. A special constitutional court enforces the rights enshrined
in the constitution.
Some of the Rights included in the constitution of South Africa include:

i) Why has the new Iraqi Constitution been portrayed as the castle of
cards?
ii) Would this description apply to the Indian Constitution? Give reason.
iii) How is the Indian constitution a true example of a balanced
institutional design?
