His Highness the Sultan in Council has been pleased to enact as
follows :
Short title and commencement.
This Enacment may be cited as The Malay Reservations
Enacment, 1930 and shall come into force upon 4th day
November, 1930.

(i)

Power to repeal Sec. 82 to 86 of The Land Ent. 1926.

It shall be lawful for His Highness the Sultan from time to time by
notification to declare that from a date to be specified in such
notification the privisions of section 82 to 86 of The Land
Enactment 1926 shall cease to have effect in any part of the
State.

(ii)

Amd. Ent. 7/1938

Any notification made under this section shall have effect as its
provisions had been enacted in this Enactment.

(i)

Interpretation
Malay: means a person belonging to any Malayan race who
speaks any Malayan Language and professes the Mohammedan
religion, and shall include (a) the Majlis Ugama Islam (b) the
Official Administrator when acting as administrator of trustee of
estate of a deceased Malay.
Reservation Land means land situate within an area which has
under the provisions of Section 4 been declared to be included in
Malay Reservation.

(ii) English version to be followed in cases of doubt.

If before any Court any difficult or dispute arises as to the meaning
or object of any expression, definition or provision of this
Enacment, the meaning or object of the corresponding expression,
definition or provision of the English version of this Enactment
shall be followed and adopted.

(i)

Declaration of Malay Reservations.

His Highness the Sultan in Council may be notification declare any
area of land to be a Malay Reservation.

(ii) Such notification shall describe the boundaries of such area of land
with reasonable accuracy but it shall not be necessary for the
purpose of such notification to survey the area therein referred to.
(iii) His Highness the Sultan in Council may also by notification.
(a)

alter the boundaries of any Malay Reservation or

(b)

revoke any notification made under subsection (i) whether as

to the whole or any part of the area therein referred to: or

(c)

include any Malay Reservation any land executed thereform.

(iv) Any notification under this section shall take effect from a date to
be specified in the notification.
(v)

Any land whether State land or land held under permanent or

temporary title may be included in a Malay Reservation.
Notice of Reservation.
Prior to the date coming into force of any notification under section
4 copies of such notification shall be posted at the Land Offices of
the District where in the Malay Reservation is situate and at all
Mosques within the boundaries of the Malay Reservation and at
such other place as the Supritendent of Land or the District Officer
may direct provided that no failure to comply with the provisions
of this section shall effect the validity of any such notification.

Restriction in alienation.
No State Land included in a Malay Reservation shall be sold,
leased or otherwise disposed of ( otherwise than by Temporary
Occupation Licence for a period not exceeding one year ) to any
person not being a Malay, save as provided in this Enactment.

Restriction on transfer of interest. Amd. Ent. 3/49

Amd. Ent. 8/40.
No right or interest of any Malay Reservation land and no right or
interest in such land acquired by virtue section 13A by any person
not being a Malay shall be transferred to or transmited to or vest
in any person not being a Malay provided that lease of reservation
land shall be valid to the extent specified in subsection (ii) to (v)
below, save as provided in this Enactment.

(ii)

Subs. Ent. 7.1938

Every document purporting to be lease or agreement for lease from
a Malay to a person not being a Malay of any Reservation land not
situate within the boundaries of a town declared under the
provision of the Land Enactment in force in the State of Kelantan
shall be deemed to be lease or agreement for lease from month to
month terminable by one months notice on either side and any
lease or agreement for lease of any such land be valid and
enforceable accordingly as a lease or agreement for lease from
month to month.

(iii)

Sub. Ent. 7/1938

Subject to the approval of His Highness the Sultan in any case it
shall be lawful to register a lease for a period not exceeding three
years from a Malay to a person not being Malay of any land situate
within the boundaries if a town declared under the Land
Enacment force in the State of Kelantan and any such lease shall
be valid and enforceable provided that no such lease shall be
registered unless the lessee produces to the Land Officer a
certificate signed by the State Secretary in the form of schedule A.
Such certificate shall upon registration of the lease be attached to
the Land Office copy of the lease.

(iv)

Subs. Ent 7/1938

The provisions of subsection (ii) shall apply to all lease (not being
leases registered under subsection (iii) and to all agreement for
lease of land situate within the boundaries of any town declared
under the Land Enacment in force in the State Kelantan.

(v)

Any term in a leases or agreement for lease which gives the lessee
the rigth to renew the lease or agreement for lease at the
termination thereof shall be null and void.

(vi)

Notwithstanding anything to the contrary in any law contained it

shall be lawful for a Land Registrar to register.
(a)

a transmission of any right or interest in reservation land by a

nonMalay to his natural heirs, or to his survivng spouse,
parents, brothers, or sister, or in the case of minors to their
Guardian or Trustee, or to a duly appointed Administrator, as
the case may be, and

(b)

a transfer by such Guardian, trustee or Administrator to the

persons legally entitled to such right or interest in reservation
land under such tranmission. (Amended by Ent. No. 3 of
1949).

Power of Attorney.
No. person not being a Malay shall by virtue of any Power of
Attorney registered after the commencement of this Enactment
and granted to him by a Malay to entitle to sell, charge, lease or
otherwise deal with or to occupy or manage or to authorise any
other person to sell, charge, lease or otherwise deal with or occupy
or manage any reservation land or interest therein belonging to
such Malay and any such Power of Attorney shall in so far as such
reservation land is concerned be absolutely null and void.

Restriction on execution sales, etc.

No. right or interest of any Malay in Reservation land shall be sold
in execution of a decree or by order of any Court of for non
payment of rent due to the Government to any person not being a
Malay.

9A.(i)

Notwithstanding anything here in before contained the proprietor
of any reservation land may charge such land or any part there of
to any person specified in Schedule D, and may in favour of any
such person create, subject to the provisions of section on 128 of
the land enactment a lien by deposit of the issue document of title
for such land.

(ii)

His Highness the Sultan in Council may from time to time by order
published in Gazette add to, delete from or amend Schedule D.

10.(i)

(ii)

Charges Sales.
No right or interest of a Malay in reservation land shall at the
instance of a chargee be sold or transferred to any person not
being a Malay provided that
(a)

in the case of a charge registered before the 1 st day April

1930, if the chargee is not Malay, it shall be lawfull on the
application of the chargee for His Highness the Sultan may
direct that persons not being Malays may be allowed to bid at
the sale and to purchase the charged land:

(b)

in the case of a charge registered after the 31 st day of March,

1930 and before the commencement of this Enactment if the
chargee is not a Malay but proves to His Highness the
Sultans satisfaction that he is a native of Kelantan it shall be
lawfull on application of the chargee for His Highness the
Sultan to direct that such chargee may bid at the sale and
purchase the charged land.

The sanction of His Higness the Sultan under the provisos to sub
section (i) shall only be valid if prior to the date of the sale the land
Officer who has ordered the sale has received a certificate signed
by the State Secretary in the form of Schedule B and such
certificate shall upon registration of the transfer of the land be
attached to the document of transfer.

Repealed by Ent. No. 7 of 1938

12.(i)

Dealing contary to the Ent.

All dealing or disposals what so ever and all attempts to deal in or
dispose of Reservation land contary to the provisions of this
Enactment shall be null and void.

(ii)

(a)

No money paid or valuable thing handed over in respect of

any dealing in or disposal of or any attempt to deal in or
dispose of any Reservation land contrary to the provisions of
this Enacment shall be recoverable

(b) No action shall lie for breach of contract in respect of any

dealing in or disposal of or any attempt to deal in or dispose of
any Reservation land contrary to the provisions of this
Enacment. Amended by Enacment No. 7 of 1938).

(iii)

No land Officer shall register any dealing which is null and void
under this section and if such dealing is registered upon
application being made in a summary way to the High Court by
any party interested or by the Sipritendent of Lands or by a
District Officer such Court may subject to the rights of any bona
fide purchaser for value order that such dealing de delected from
the register.

13.

Decision of doubtful points by His Highness the Sultan in

Council.
If any doubt shall arise to whether any person is a Malay within
the meaning of this enhancement or as to the mode of operation
this Enactment or as to the manner in which the provisions
thereof are to be construed or carried into effect or otherwise in a
relation there to, the same maybe and every such decision when
certified under the hand of the State Secretary shall not be
questioned or revised by any Court.

13A.
(i)

Aproval
His Higness the Ruler may approve.
(a)

The alienation of any State land included in a Malay

Reservation.

(b)

The transfer or transmission of the right or interest of any

Malay in reservation land, and

(c)

The transfer or transmission of any reservation land acquired

by virtue of this section, by any person not being in Malay.

to any other person not being in Malay, subject to the imposition

of such restriction in interest and such conditions in the document
of title and such terms of rent as he may think fit: and the
Approved Application, Memorandum of Transfer of Application for
Registration, as the case may be, under the Land Enactment may
be registered if presented with certificate signed by the State
Secretary in the form of Schedule C.
Upon registration such certificate shall be attached to the
Approved Application, Memorandum of Transfer or Application for
Registration, as the case may be.
(ii)

Upon registration of such Approved Application, Memorandum of

transfer or Application for registration, as the case may be, the

land affected there by shall remain subject to all the provision of

Malay Reservations Enactment.

(iii)

14.

Nothing in this section shall prevent the transfer or transmission of

the right or interest in the reservation land of any person not being
a Malay to other person not being a Malay always provided that
such right or interest shall have been acquired prior to the creation
of the Malay Reservation in which the land is included. (Amended
by Ent. No. 3 of 1949).
Except as otherwise in this Enactment provided the provisions of
the Land Enactment in force in the State of Kelantan and Rules
made the under shall apply to Reservation Land. (Amended by
Enactment No. 7 of 1938).
