AFFIDAVIT OF DESISTANCE I, IMELDA DELA CRUZ, of legal age, married, Filipino citizen, and a resident of Brgy. Parsolingan, Gerona, Tarlac, after having been duly sworn to in accordance with law, hereby depose and say:
1. That I am the complainant in a criminal case for Violation of Sec. 5 (e)(2) of R.A. 9262 under Crim. Case No. 5949-2016;
2. That with the accused’s commitment to provide sufficient financial assistance on a
regular basis to her minor child, ANGEL ANA D. TINGCO, I have come to a realization that it would be to the best interest of the said child to give accused the chance to contribute to the promotion of the general wellbeing and development of the said child;
3. That I am executing this Affidavit of Desistance out of our free will and act and that no person forced, coerced or intimidated me to execute the same;
4. That I was fully informed in a language known to me of the consequences of
executing this Affidavit of Desistance, subject however to the compliance of the accused with his Undertaking before this Honorable Office;
5. That I am executing this Affidavit to request the Honorable Court for the dismissal of the case against the above-named respondent.
