(EVOLUTION OF PHILIPPINE CONSTITUTION)

Answer the following questions and cite the relevant Article/s and Section/s found in the 1987 Philippine
Constitution (5 points each).

1. What are the qualifications of the following public servants?

A. President

According to the Article VII, Section 2 of the 1987 Philippine Constitution, An individual may become
President if he/she meets the following criteria:

 Natural born Filipino;


 A registered voter;
 Must be able to read and write;
 40 years of age at the day of the election; and
 Must have resided in the Philippines ten years before the election is held

B. Senator

According to the Article VI, Section 3 of the 1987 Philippine Constitution, An individual shall meet the
following criteria:

 A natural-born citizen of the Philippines;


 At least thirty-five years old;
 Is able to read and write
 A registered voter; and
 A resident of the Philippines for not less than two years before Election Day.

C. District Representatives

According to the Article VI, Section 6 of the 1987 Philippine Constitution, No person shall be a member of the
House of Representatives unless s/he is;

 A natural-born citizen of the Philippines;


 At least twenty-five years old;
 Is able to read and write; and
 Except the party-list representatives, a registered voter and a resident for at least one year in the
district where s/he shall be elected.

2. How can we say that the claim of the State over the islands in West Philippine Sea is constitutional?
-It is not only a mere claim that West Philippine Sea is ours because we have rights that strengthens it
because according to the Article XII, Section 2 of our 1987 Constitution: constitution that “The State shall
protect the nation’s marine wealth in its archipelagic waters, territorial sea, and exclusive economic zone,
and reserve its use and enjoyment exclusively to Filipino citizens.” We have proved that West Philippine Sea
is our territory and it is part of our history and we have exclusive economic zone. It our treasure to be kept
and protected and we should not prevail or let others conquers our country.

3. Is death penalty constitutional? Explain your answer.

-No. It is not, because Philippines don’t allow death as a penalty to a certain crime and is under the Bill of
Rights in 1987 constitution Article 3, Section 1 that "No person shall be deprived of life, liberty, or property
without due process of law, nor shall any person be denied the equal protection of the laws." In the old
constitution during Marcos administration it has been tolerated but in the new constitution it is different
until now. Furthermore, since we are a Christian country we cannot simply kill a person even he or she do
things bad it is morally wrong. And it is not acceptable in view of the church and the government doesn't
approved killing as a penalty. Even it is a drug lord we shouldn't kill them, we can punish a person buy simply
putting him or her into jail.

4. How does extrajudicial killing violate the Constitution?

-In the time of war against drugs many people would say that extrajudicial killing happens in our country
but we cannot conclude with the situations we have without further and due processes or analysis. But in
the other hand, extrajudicial killing violates the constitution because according to the Bill of Rights in the
1987 constitution Article 3, section 1 that "No person shall be deprived of life, liberty, or property without
due process of law, nor shall any person be denied the equal protection of the laws." so if that is being
violated by the authorities they are responsible to it and it is punishable by the law. Maybe it happened or it
is happening and it is a very brutal and unacceptable by the law, government and even the church because it
is morally wrong. Extra judicial killing is killing without any or due processes that the authority says that
"they strive or fight against us and we are to protect ourselves" Maybe correct but we don't know because
we are not in the situation.

5. Is the declaration of Martial Law adherent to the 1987 Constitution? Explain your answer.

-The 1987 constitution does not adhere or follow the declaration of the martial law in 1972. It was
Marcos who was proclaimed martial law in his own constitution for several years under him. He declared
martial law and revised constitutions to have powers in his terms.

6. Is the granting of emergency powers or authority to President Duterte as stated in the “Bayanihan to
Heal as One Act” constitutional? Support your answer.
-Yes it is, in this time of crisis it should be but it the congress and senate should be able to look for the
power that they would give because it would probably be an over powered president but then the congress
and senate did it very well and they gave additional power only for this crisis. It is constitutional because the
people of this nation would be benefited from this and it is for our own good as a citizen. A constitution is
primarily a set of rules and principles specifying how a country should be governed by the president or the
authorities in times of crisis and on how to control a situation of the country to protect us from this
pandemic.
