END USER LICENSE AGREEMENT

FOR ORBITAL SERVICES® LEXTEDIT SOFTWARE PRODUCT

ORBITAL SERVICES, INC. LICENSES THIS DESKTOP SOFTWARE PRODUCT TO YOU SUBJECT
TO THE TERMS CONTAINED IN THIS END USER LICENSE AGREEMENT (“EULA”). READ THE
TERMS OF THIS EULA CAREFULLY. BY INSTALLING, COPYING OR OTHERWISE USING THE
SOFTWARE (AS DEFINED BELOW), YOU AGREE TO BE BOUND BY THE TERMS OF THIS
EULA. IF YOU DO NOT AGREE WITH THE TERMS OF THIS EULA, DO NOT DOWNLOAD,
INSTALL, COPY OR USE THE SOFTWARE AND IF YOU HAVE PROOF OF PAYMENT, YOU MAY
RETURN THE UNOPENED SOFTWARE TO THE LOCATION AT WHICH YOU ACQUIRED IT
WITHIN THIRTY (30) DAYS FOR A REFUND OF THE LICENSE FEE.

NOTICE TO CUSTOMER
This EULA is a contract between you (either an individual or an entity) and Orbital Services, Inc. (“Orbital
Services”), which governs your use of the Orbital Services software product that accompanies this EULA
and related software components, which may include associated media, printed materials, and online or
electronic documentation.

The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as
other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.

1. GRANT OF LICENSE.

The Software is licensed, not sold. Subject to the terms and limitations of this EULA, Orbital Services
hereby grants you a nonexclusive, nontransferable license, without rights to sublicense, to (i) make a number
of copies of the Software less than or equal to the Number of Licensed Users for the purpose of installing a
single copy of the Software on an equivalent number of computers, each of which is running a validly
licensed copy of the operating system for which the Software is designed; (ii) use the Software License Key
to activate each copy of the Software for each User to the extent permitted by your payment of applicable
license fees under a Orbital Services approved licensing model; (iii) have up to the Number of Licensed
Users use the Software (in object code form only) solely for your own internal information processing
services and computing needs; and (iv) use the documentation accompanying the Software in connection
with permitted uses of the Software. If you are an entity, each copy of the Software may be used by one
designated individual user only, unless permitted otherwise by your payment of applicable license fees under
a Orbital Services approved licensing model. The total number of designated users may not exceed the
Number of Licensed Users. The Software License Keys have an expiration date (“Expiration Date”). When
you activate the Software with Software License Key you may only use the Software until the Expiration
Date. Subject to the above, each copy of the Software may not be used by any other person, whether or not
such person is employed by or otherwise associated with your entity.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

* Prerelease Software. If any component of the SOFTWARE PRODUCT or any of its components is
marked "Prerelease" or "Beta", the component of the SOFTWARE PRODUCT constitutes pre-release code
and may be changed substantially before commercial release. You may not use such component in a live
operating environment where it may be relied upon to perform in the same manner as a commercially
released product or with data that has not been sufficiently backed up.
* Development. Orbital Services may grant the Licensee a Component License which entitles them to utilize
the SOFTWARE PRODUCT in developing other end user applications subject to a Orbital Services
approved licensing model.

* Maintenance of Copyright Notices. You must not remove or alter any copyright notices on all copies of the
SOFTWARE PRODUCT.

* Distribution. You may not distribute copies of the SOFTWARE PRODUCT to third parties, except as
expressly provided in Section 1.

* Prohibition on Reverse Engineering, Decompilation, and Disassembly. The Licensee may not reverse
engineer, decompile, create derivative works, modify, translate, or disassemble the SOFTWARE
PRODUCT, and only to the extent that such activity is expressly permitted by applicable law
notwithstanding this limitation. The Licensee agrees to take all reasonable, legal and appropriate measures to
prohibit the illegal dissemination of the SOFTWARE PRODUCT or any of its constituent parts and
redistributables to the fullest extent of all applicable local, US Codes and International Laws and Treaties
regarding anti-circumvention, including but not limited to, the Geneva and Berne World Intellectual
Property Organization (WIPO) Diplomatic Conferences.

* Rental. You may not rent, lease, or lend the SOFTWARE PRODUCT.

*Separation of Components, Their Constituent Parts and Redistributables. The SOFTWARE PRODUCT is
licensed as a single product. The SOFTWARE PRODUCT and its constituent parts and any provided
redistributables may not be reverse engineered, decompiled, disassembled, nor placed for distribution, sale,
or resale as individual creations by the Licensee or any individual not expressly given such permission by
Orbital Services. The provision of Source Code, if included with the SOFTWARE PRODUCT, does not
constitute transfer of any legal rights to such code, and resale or distribution of all or any portion of all
Source Code and intellectual property will be prosecuted to the fullest extent of all applicable local, federal
and international laws. All Orbital Services libraries, Source Code, Redistributables and other files remain
Orbital Services's exclusive property. The Licensee may not distribute any files, except those that Orbital
Services has expressly designated as Redistributable.

* You may not (i) sell, lease, license, sublicense, distribute or otherwise transfer in whole or in part the
Software or the Software License Key to another party; (ii) provide, disclose, divulge or make available to,
or permit use of the Software in whole or in part by, any third party without Orbital Services's prior written
consent; (iii) modify or create derivative works based upon the Software.

* Support Services. Orbital Services may provide you with support services related to the SOFTWARE
PRODUCT ("Support Services"). Use of Support Services is governed by the Orbital Services policies and
programs described in the user manual, in "on line" documentation and/or other Orbital Services-provided
materials. Any supplemental software code provided to you as part of the Support Services shall be
considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA. With
respect to technical information you provide to Orbital Services as part of the Support Services, Orbital
Services may use such information for its business purposes, including for product support and
development. Orbital Services will not utilize such technical information in a form that personally identifies
you.

* Compliance with Applicable Laws. You must comply with all applicable laws regarding use of the
SOFTWARE PRODUCT.

3. TERMINATION.
Without prejudice to any other rights, Orbital Services may terminate this EULA if you fail to comply with
the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE
PRODUCT.

4. PROPRIETARY RIGHTS RESERVED BY ORBITAL SERVICES.

Orbital Services retains all right, title, and interest in and to the Software and the Software License Key and
in all related copyrights, trade secrets, patents, trademarks, and any other intellectual and industrial property
and proprietary rights, including registrations, applications, renewals, and extensions of such rights. All title
and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE
PRODUCT is the property of the respective content owner and may be protected by applicable copyright or
other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights
not expressly granted are reserved by Orbital Services.

5. U.S. GOVERNMENT RESTRICTED RIGHTS.

The SOFTWARE PRODUCT is provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by
the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical
Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the
Commercial Computer Software Restricted Rights at 48 CFR 52.227-19, as applicable. Manufacturer is
Orbital Services/1220 Woodsey CT/Southlake, TX 76092.

6. EXPORT RESTRICTIONS.

You agree that you will not export or re-export the SOFTWARE PRODUCT to any country, person, entity
or end user subject to U.S.A. export restrictions. Restricted countries currently include, but are not
necessarily limited to Cuba, Iran, Iraq, Libya, North Korea, Sudan, and Syria. You warrant and represent
that neither the U.S.A. Bureau of Export Administration nor any other federal agency has suspended,
revoked or denied your export privileges.

7. NO WARRANTIES.

Orbital Services expressly disclaims any warranty for the SOFTWARE PRODUCT. THE SOFTWARE
PRODUCT AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT
WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT
LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR
PERFORMANCE OF THE SOFTWARE PRODUCT REMAINS WITH YOU.

8. LIMITATION OF LIABILITY.

To the maximum extent permitted by applicable law, in no event shall Orbital Services or its suppliers be
liable for any special, incidental, indirect, or consequential damages whatsoever (including, without
limitation, damages for loss of business profits, business interruption, loss of business information, or any
other pecuniary loss) arising out of the use of or inability to use the SOFTWARE PRODUCT or the
provision of or failure to provide Support Services, even if Orbital Services has been advised of the
possibility of such damages. In any case, Orbital Services's entire liability under any provision of this EULA
shall be limited to the greater of the amount actually paid by you for the SOFTWARE PRODUCT or
US$5.00; provided however, if you have entered into a Orbital Services Support Services Agreement,
Orbital Services's entire liability regarding Support Services shall be governed by the terms of that
agreement. Because some states and jurisdictions do not allow the exclusion or limitation of liability, the
above limitation may not apply to you.

9. GENERAL PROVISIONS.

This EULA may only be modified in writing signed by the Licensee and an authorized officer of Orbital
Services. If any provision of this EULA is found void or unenforceable, the remainder will remain valid and
enforceable according to its terms.

10. MISCELLANEOUS.

If the Licensee acquired this product in the United States, this EULA is governed by the laws of the State of
Texas.
If this SOFTWARE PRODUCT was acquired outside the United States, then the Licensee, agrees and
ascends to the adherence to all applicable international treaties regarding copyright and intellectual property
rights which shall also apply. In addition, the Licensee agrees that any local law(s) to the benefit and
protection of Orbital Services ownership of, and interest in, its intellectual property and right of recovery for
damages thereto will also apply.
