Statutory Variation Clause

1 Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in
respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery
period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account.
Only such variation shall be admissible which takes place after the submission of bid. No claim on account of
statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his
offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be
admissible on account of misclassification by the supplier/ contractor.

4 Detailed Eligibility Criteria (Please refer Special Terms and Condition Yes Yes Allowed
Annexure): A) Qualifying Requirement of Tenderer 1. The tenderer shall (Optional)
provide satisfactory evidence, acceptable to the purchaser to show that he
is a regular manufacturer and has adequate machine and manufacturing
capacity and a Quality Assurance Programm. The manufacturer must
have a valid ISO 9001 certificate (or latest) on the original date of closing of
bid and a copy of same should be submitted along with the bid.
Manufacturing of CNC VTL shall be in the scope of ISO certificate. 2. The
tenderer must have manufactured & supplied at least 03 nos. of
same/similar machines in last 05 years to be reckoned from the original
date of closing of bid. The list of past supplies made in last 5 years of the
same/similar machine asked for shall be attached along with the offer
specifying Purchasers name and address, phone no. and e-mail of
contract person, purchase order number and date, quantity supplied, date
of supply and commissioning. Copy of such purchase order(s) mentioned
in the list of past supplies indicating the parameter/specification shall also
be attached with the offer to establish equivalence/similarity aspect of
machine as mentioned in para 3. below. 3. For the purpose of similarity,
similar machine required under clause 2 means CNC Vertical Turning
Lathe with table diameter of 1200 mm or bigger. 4. Performance certificate
of at least 1 no. of such machine which is counted for the purpose of
meeting qualifying criteria, supplied in the last five years (to be reckoned
from the original date of closing of bid) and working satisfactorily for at least
one year shall be enclosed with clear signature and address of the user in
whose premises the machine is installed and commissioned. The
certificate shall not be older than one year from the original date of closing
of bid. 5. All necessary information/documents required for establishing
reference requirement as per para 2 to 4 should be submitted by the bidder
along with the original offer itself. No clarification /correspondence will be
sought/entertained in this regard. In case no information or incomplete
information is furnished by the bidder, their offer will be summarily rejected

extent required by higher tax billed as per invoice to match the all inclusive
price as mentioned in the Purchase Order. (F) Any amendment to GST
rate or HSN number in the contract shall be as per the contractual
conditions and statutory amendments in the quoted GST rate and HSN
number, under SVC.

7. RESPONSIVENESS

4 CAMC rates must be quoted in its relevant rate tab else firm's offer will be summarily rejected.
Evaluation Criteria: The CAMC charges would be added to the FOR destination price quoted for M&P for the
purpose of comparative evaluation of offer. In order to equitably compare different CAMC charges for different
years, the concept of NPV (Net Present Value) will be used at a rate of 10% per annum discounting for five years

period to bring the CAMC charges at the same footing in the assessment of FOR destination price and evaluation
of offers will be on the basis of total Rate of material, Freight, Forwarding charge, Rates of Spares, CAMC rates
for 5 years for each Set adjusted with NPV factor with applicable GST

The tenderers in their bid shall indicate the details of their GST Jurisdictional Assessing Officers (Designation, Address &
email id). In case of a contract award, a copy of Purchase Order shall be immediately forwarded by Purchaser to the
GST Jurisdictional assessing officer mentioned in Tenderer's bid

This tender complies with Public Procurement Policy (Make in India) Order 2017, dated 15/06/2017, issued by
Department of Industrial Promotion and Policy, Ministry of Commerce, circulated vide Railway Board letter no.
2015/RS(G)/779/5 dated 03/08/2017 and 27/12/2017 and amendments/ revisions thereof.
